The regular meeting of the Hills City Council was held on Monday, October November 23, 12, 2009 at the Hills Fire Sstation.
Mayor Russell Bailey called the meeting to order at 7:00 PM. Council members present were: Steve Harris, Merle Hill,Tim Kemp, Thom Kirkpatrick, Tim Kemp and Cathy Knebel.. . .Others Present:Bonnie Hansen, City Clerk;Jay Honhan, City Attorney; Ron Wolfe, Maintenance; Larry Culver, Robert Downer, Jim Malmberg, Gary Hulett, Roger Slaughter, Mark Stutsman, and Cathy Fitzmaurice Hill. Guy Sommers, Fire Chief, and Jason Van Nevel.
.A motion was made to accept the Consent Agenda approving the minutes with one correction and bills by KempKnebel and seconded by KnebelKemp. Roll Call was held . Ayes: 55 Motion passed.
Public discussion was open at 7:01 2and closed at 7:023.
Robert Downer, attorney for Stutsman, Inc presented a Memorandum Agreement between the City and Stutsman’s Feed. A stipulation of the 2008 Midwest Recovery Act allowed for bonds to be issued for companies that had adverse effect from the flooding. Due to the fact the railroad lines were flooded and not in service for several months, Stutsmans’s had increase costs. Stutsman’s are asking for a public hearing to be set for further explore this issue. The City of Hills must agree to the issuance of bonds but will not be responsible in any way. A motion was made to set a public hearing and approve a Memorandum Agreement with Stutsman, Inc for January 11, 2010 by Kemp and seconded by Kirkpatrick. Roll Call was held. Ayes; 5 Resolution and motion passed.
A complaint had been received regarding several homes that had barking dogs. The mayor will contact these residents to speak to them regarding this matter
Discussion was held regarding the building inspection procedures currently in place. Several complaints have been received regarding Johnson County Inspections. , A 30 days notice would be needed to withdraw from this agreement. A letter stating the City’s intent to withdraw from the agreement will be delivered to the County on November 24. A new inspector will be appointed at the January 11 meeting. A motion was made by Hill and seconded by Kemp to have the City attorney notify Johnson County that Hills would like to withdraw from the agreement to have Johnson County do building inspections. Ayes: 5 Motion passed.
The Planning and Zoning Commission met to review the Fringe Area Agreement with Johnson County. Members of the Planning and Zoning Commission were present to discuss their recommendation in accepting this agreement. A motion was made to accept this report by Kirkpatrick and seconded by Kemp. Ayes: 5 Motion passed.
Discussion was held regarding the de-annexation of portions of CRANDIC railroad from Iowa City to Hills. This proposal has the consent of Johnson County and CRANDIC. The City of Iowa City is agreeable. A map needs to be drawn and recorded. This will be an item on the December meeting.
It was announced that a meeting of the City Attorney Search Committee would be held after this Council meeting.
Updated water results from the DNR were discussed. Prices for RO machines are being investigated and should have a report by the next meeting of this cost.
Reports:
Discussion of the Building Inspector was held. Riverside’s building inspector submitted his basic charges of 2 hour minimum, at $35.00 an hour. There would be no trip mileage. He will be invited to the October 26 meeting to discuss further what codes, fees, and ordinances would be needed if the Council decides to go this route.
Discussion was held that the Council needs to start working on a 5 year Capital Improvement Plan. This will be on the October 26 agenda. Council members are to bring their thoughts of where the City of Hills will be going in the next 5 years.
De-annexation of the CRANDIC Railroad connecting Hills to Iowa City will be an agenda item on October 26.
Mayor Bailey proclaimed Trick or Treating will be held on October 31, 2009 from 6:30 – 8:00 PM.
Discussion of the Council Procedure Policy and Employee Handbook were held. Changes will be made and presented at the next meeting.
The Council Action sheet was discussed. Meetings continue to be held regarding the fringe area agreement. Several volunteers were mentioned for one committee for Living Roadways, Street Improvements and new signs coming into the City.

Maintenance: Ron is prepared for any snowfall and has backup plans in case Bob Zimmerman is unable to help.Absent
Attorney: No ReportAttorney Honohan has had one inspection of the Eden Property which did not pass the agreement.
Mayor: The Mayor gave a report on his first meeting with regarding the ICCSD boundary issues. One suggestion was made to bring Lake Ridge students back to Hills to help enrollment. The nex
Mayor: The mayor mentioned the semi parking on the street during the weekend in Oakcrest Hill Addition. He will be contacting the Sheriff’s department regarding this matter. The mayor discussed the recent fighting events at Hills Bar and Grill. It was the consensus of the Council that the City has no jurisdiction in this as the license etc came from the State. Signs and lights at the Casey’s intersection were discussed along with City limit signs.
Fire Chief: Guy Sommers arrived at 8:00. He gave a report that fire department elections will be held on December 21. A future item for discussion after the elections will be fire department issues. No Report
City Clerk: The Clerk updated the Council on the REAP meeting she attended and some possible grants that would correspond with the grant application for the Safe Road grant. The clerk asked about a December 28 meeting. At this time, Mayor Bailey requested that the December 14 meeting be changed as there is an ICCSD Boundary meeting that night and he would like to be able to update the Council on this matter. A motion was made by Kemp and seconded by Knebel to move the December 14 meeting to December 21 and cancel the December 28 meeting due to the Holiday season. Ayes: 5 Motion passed.
