Article 14. ParoleConsiderationHearings forYouth Offenders is addedtoreadasfollows:ARTICLE 14. PAROLECONSIDERATIONHEARINGSFOR YOUTH OFFENDERS
§ 2440.Youth Offender Defined.
(a)Ayouth offender is an inmatewhocommitted his or her controllingoffenseprior to reachingage 18,was sentenced to a determinate term oralifeterm,and is not disqualifiedbased on anyfactors listed in subdivision (c) ofthis section.
(b)Forpurposes ofdeterminingwhetheran inmatequalifies as ayouth offender, the“controllingoffense” is the singlecrime or enhancement for which anysentencing court imposed the longestterm of imprisonment. Iftwo ormoreoffenses carryidentical sentencelengthsandaretheinmate’slongestterms ofimprisonment, the controllingoffense shall be determinedas follows:
(1)If noneof thesentences were enhanced pursuant to Penal Code section 1170.12, subdivisions
(b)through (i)of section667(b)-(i),orsection 667.61, the controllingoffenseisthe earliest ofthe offenses.
(2)If one sentence wasenhanced pursuant to Penal Code section 1170.12,subdivisions (b)through (i) ofsection 667(b)-(i),orsection 667.61,the controllingoffense isthe enhancedoffense.
(3)Ifmorethan onesentence was enhanced pursuant to Penal Code section1170.12,subdivisions (b)through(i)of section 667(b)-(i),or section 667.61, the controllingoffense is theearliest oftheenhancedoffenses.
(c)Inmates who committed theircontrollingoffenses prior to reachingage18aredisqualifiedasyouth offenders under this article ifoneormore ofthe followingfactorsexist:
(1)Theinmatereceiveda sentence oflifewithoutthe possibilityof parole;
(2)Theinmate’s sentenceon the controllingoffenseis enhanced fora priorfelonyconvictionunderPenal Codesections 1170.12 or 667(b)-(i);
(3)Theinmate’s sentenceon the controllingoffenseis enhancedas a one-strike sexoffenseunderPenal Codesection 667.61;
(4)Theinmatecommittedanycrime orenhancementafter reachingage 18forwhich thesentencingcourt sentenced the inmateto his or her longest term ofimprisonment;
(5)Theinmatecommittedanyoffense after reachingage18 that includes “maliceaforethought” as a necessarystatutoryelement of the offense; or
(6)Theinmatecommittedanyoffense afterreachingage18 forwhich the inmate wassentencedto a lifeterm of anylength.

§ 2441. Youth OffenderQualificationProcess.
(a)CorrectionalCase RecordsServicesof thedepartmentdetermines whether aninmatequalifiesas ayouthoffender undersection 2440 oftheseregulations.
(b)Youth offenderdeterminations bythe departmentaresubjectto the appealprocessfoundinTitle15, California Code ofRegulations,section 3084-3084.9. Inmates contestingayouthoffenderdisqualificationbythe departmentmust submit aCDCR Form 602Inmate Appeal toCorrectional CaseRecords Services of thedepartmentunderthatappealprocess.

§ 2442. Youth Parole Eligibility Dates.
(a)A Youth ParoleEligibilityDate (YPED) is setaccordingto thefollowingcriteria:
(1)If the controllingoffense is a determinate termof anylength, theYPEDisthe first dayafterthe inmatewill complete 14 actualyears of incarcerationwhile servingthe sentence that includesthe controllingoffenseand anyothercrimes orenhancements,committed as a juvenile, arisingfrom thesamecasenumber oranyrelatedcasenumbers;
(2)If the controllingoffense is alifeterm of less than 25years to life,theYPED is the firstdayafter theinmatewill complete 19 actualyears ofincarceration while servingthe sentence thatincludes the controllinglifeoffense andanyother crimes orenhancements, committed as ajuvenile, arisingfrom thesamecasenumberoranyrelated casenumbers; or
(3)If the controllingoffenseis a lifeterm of 25years to life,the YPED is the firstdayafter theinmatewill complete24 actualyears ofincarceration while servingthe sentence that includes thecontrollinglifeoffenseand anyother crimes orenhancements,committed as a juvenile, arisingfrom thesamecasenumber oranyrelatedcasenumbers.
(b)(1)CorrectionalCaseRecordsServices of thedepartmentcalculates theYPED forallinmatesqualifiedasyouthoffenders.
(2)YPED calculations bythe departmentaresubject to the appealprocess foundin Title15,California Code ofRegulations,sections3084-3084.9. Inmates contestingaYPED calculationbythe department must submit aCDCR Form 602Inmate Appeal toCorrectionalCase RecordsServices of thedepartmentunderthatappealprocess.
(c)For purposes ofthis section,“incarceration”means detention in anycityor countyjail, localjuvenile facility, statemental healthfacility,Division of Juvenile Justice facility, ordepartmentfacility.

§ 2443. Consultations.
Regardless of whethertheyouth offender wassentenced to a determinate term oralifeterm, theboardshallmeet with eachyouth offenderduringthe sixthyearprior tohisor her minimumeligible parole date(MEPD)orYPED, whicheveroccurs first, for thepurposes ofreviewinganddocumentingtheyouthoffender’sactivities and conduct pertinent toboth parole eligibilityandto the awardingorwithholdingof post-convictioncredit. Duringthisconsultation, the boardshall provide theyouthoffenderinformation aboutthe parolehearingprocess, legalfactorsrelevant to his or hersuitabilityor unsuitabilityfor parole,andindividualizedrecommendationsfortheyouthoffenderregardinghis orher work assignments,rehabilitative programs, andinstitutionalbehavior.Within 30 daysfollowingthe consultation, theboard shall issueitspositive andnegative findings and recommendations to theyouthoffenderin writing.

§ 2444.Scheduling ofHearings.
(a)Youth offendersshallbe scheduledfortheirinitialparoleconsiderationhearingsno later thanoneyear priorto reachingtheirMEPD or oneyearafterreachingtheirYPED, whicheveroccursfirst.
(b)Subsequent parole considerationhearings shallbe set foryouth offendersin accordancewithPenal Code 3041.5(b)(3).
(c)Notwithstandingsubdivisions (a) or(b), whenayouthoffender’searliestparolerelease date(EPRD) is less than24 months afterthe YPED, the boardshall not schedulea hearing.

§ 2445.ComprehensiveRisk Assessments
When preparingarisk assessment underthis section for ayouth offender,pursuant to Penal Codesection 3051, the psychologist shall also takeintoconsideration theyouthfactors,definedas
(1)the diminished culpabilityof juveniles as compared to adults, (2)the hallmarkfeatures ofyouth, and(3)anysubsequent growthandincreased maturityof ayouthoffender, inaccordancewith Penal Code section4801(c).

§ 2446.Parole ConsiderationHearings.
(a)Regardless of whether the hearingisscheduledpursuant to aMEPD or YPED,panelsshallconductparole considerationhearingsforyouthoffenders in compliancewiththe requirementsforinitial and subsequentparoleconsiderationhearingsdescribed inthis chapter and Penal Codesections 3040, etseq.
(b)In weighingfactors todetermineayouthoffender’ssuitability,as described in sections 2281and2402, the hearingpanelshall givegreat weight toanyinformation relatingto the inmate’syouthfactors,definedas(1)the diminished culpabilityof juveniles as compared to adults, (2) thehallmarkfeatures ofyouth,and(3) anysubsequent growthandincreased maturityofayouthoffender, in accordancewith Penal Code section4801(c).
(c)Thefollowing additionalrequirementsshall applytoallparoleconsiderationhearings foryouth offenders:
(1)In assessingtheapplication oftheyouth factors to ayouth offender, the hearingpanelshallnot considerthe final riskratingsof arisk assessment, asdescribed in section 2240 oftheseregulations, unless the evaluator consideredinformation relatingto theinmate’syouthfactors inreaching clinical conclusions regardingthe inmate’s risk. All otherrelevant and reliableinformationfromanyrisk assessmentsmaybe considered.
(2)The panel shall reviewandconsider anysubmitted writtenstatementsthat provideinformationabout theyouthoffender beforethe controllingoffenseortheyouthoffender’sgrowthand maturitysincethe controllingoffensefrom ayouth offender’s familymembers,friends,school personnel, faithleaders,or representativesfromcommunity-based organizations.
(3)Hearingpanels shall notselect a base term orcalculateanadjusted base term foryouthoffenders.
(d)Nothingin this articleis intended to alterthe rights of victim at parole considerationhearings.

§ 2447.Post-HearingProcedures.
(a)Pursuant to subdivision (c) ofPenal Codesection 3046, afindingof suitabilityforayouthoffender is subject to theboard’s decision reviewprocessdescribed in sections 2041-2042 of
theseregulationsand theGovernor’s reviewprocess described in Penal Code sections 3041.1and3041.2,as applicable.
(b)Notwithstanding anyotherprovisionsofthis Chapter, ifadecision findingayouth offendersuitable for paroleis affirmed followingreviewbythe boardandGovernor,the boardshallnotifythe department that the inmate isimmediatelyeligible forrelease oncethe inmate haspassed his or herMEPDorYPED, whichever occurs first, subject to anyapplicablewrits,detainers, holds, or warrants.
(c)Ifayouthoffenderreaches his or her EPRDbefore the dateofhis or her next hearing and isreleased, the board shallcancel the hearing.
(d)Whendeterminingwhetherto advanceayouthoffender’snext hearing followingapetition toadvance hearingdate pursuant to subdivision (d) of Penal Code section 3041.5orfollowing anadministrative review pursuant toparagraph (4) of subdivision (b) ofPenal Code section 3041.5,commissioners anddeputycommissioners shall considertheyouthfactors as defined insubdivision (b) ofsection 2445 oftheseregulations.
