1)Employeesare prohibitedfromthe use,sale, dispensing,distribution,possession, ormanufactureof illegal drugsandnarcoticsoralcoholic beveragesonTransoceanic Projects Development Co., Inc.premisesorworksites. Employeesarealso prohibitedfromthe possession,useorsale of illegal drugswhensuchactivities adverselyaffect job performance,jobsafety,orthe Transoceanic Projects Development Co., Inc.'sreputationin thecommunity. Inaddition,employeesare prohibitedfromthe off-premises useof alcoholwhensuchactivities adverselyaffect job performanceand/orjobsafety.

2)Transoceanic Projects Development Co., Inc.will nothire,unlessstate orlocal lawprovidesotherwise,alcoholics ordrugabusers whosecurrentuseofsuchsubstancespreventsthemfromperformingtheir jobsorwhowouldconstitute a direct threat to thepropertyorsafetyofothers.Wheneverapplicants foremploymentare tobe tested forthe presenceof suchsubstances,theyare tobeinformedofthetest inadvanceandinwriting.

3)Employeeswill besubjecttodisciplinaryaction, uptoandincludingtermination,forviolationsof thispolicy.Suchviolationsinclude,butare notlimited to,possessingillegal ornon-prescribeddrugsand narcoticsoralcoholic beveragesat work;beingunderthe influenceofsuchsubstanceswhile working; usingthem whileworking;ordispensing,distributing,orillegally manufacturingorselling them on Transoceanic Projects Development Co., Inc.premisesandworksites. Employees,their possessions,andTransoceanic Projects Development Co., Inc.-issuedequipmentand containersunder their controlare subjecttosearchandsurveillance at all times whileon Transoceanic Projects Development Co., Inc.premises orwhileconductingTransoceanic Projects Development Co., Inc.business.

4)Employeesmayberequiredtotake a test at anytime todeterminethe presenceofdrugs,narcotics, oralcohol,unlesslawprohibitssuchtests. Testingpositiveforillegal drugsoralcoholis a violationofthe policy.

5)EmployeessubjecttotheDrug-FreeWorkplaceActwhoare convictedofanycriminal drug violationmustreportsuchconvictiontotheExecutive Directorwithinfivedays,andthe Executive Directoris thentotake appropriateactionasrequiredbylaw.

6)Supervisorsshouldreportimmediately tothe Executive Directoranyaction byanemployeewho demonstrates anunusualbehaviorpattern.TheExecutive Directorwill determine whetherthe employee shouldbeexamined bya physicianorclinic and/ortested fordrugsandalcohol.Employeesbelieved tobe underthe influenceofdrugs,narcotics,oralcoholwill berequiredtoleave the premises.TheTransoceanic Projects Development Co., Inc. shouldmakearrangementsforsafetransport.

7)Employeeswhoare experiencingwork-relatedorpersonalproblemsresulting fromdrug,narcotic, oralcoholabuseordependencymayrequest,or berequiredtoseekcounselinghelpat the employee's expense. Requiredcounselingshouldbekeptconfidential andshouldnothaveanyinfluenceonperformanceevaluations.Job performancealone,notthe fact thatan employeeseekscounselingis tobe the basisofall performanceappraisals.

8)Anyemployeewhois abusingdrugsoralcoholmaybegranteda leave ofabsencetoundertake rehabilitation treatment.Theemployeewill notbepermitted toreturntowork until certification is presentedtothe Executive Directorthatthe employeeis capable of performinghisjob.Failuretocooperatewithanagreed-upon treatmentplanmayresultindiscipline, upto andincludingtermination.Participation ina treatment programdoesnotinsulate anemployeefromthe impositionofdisciplineforviolationsofthisorotherTransoceanic Projects Development Co., Inc. policies.

9)TheTransoceanic Projects Development Co., Inc.will, tothe extent feasible, providecontinuingawarenessprogramsforthe workforce abouttheharmfuleffects ofdrugandalcoholabuse.

10)Thepossessionoffirearmsorillegal weaponsonthe personofanemployeeduringworking hours,oronTransoceanic Projects Development Co., Inc.property,orinvehicles ownedorleased bythe Transoceanic Projects Development Co., Inc.,orinvehicles utilized byanemployeeinthe scopeoftheir employmentduringworkinghourswill beconsideredcausefor immediate dismissal.
