(to be known after subdivision as Block 6101, Lots 1.01, 4.01, 4.02, 4.03, and 5.01 thru 5.08)

fromPeter L. Winter and Elizabeth C. Winter,

andPaul Winter, Executor of the Estate of Louise M. Winter, to the Township of Bernards,

Relating to a Subdivision Approval Granted toBocina Homes Corp. (Winter Subdivision)

BE IT ORDAINED, by the Township Committee of the Township of Bernards, in the County of Somerset and State of New Jersey as follows:

  1. Pursuant to the Local Land and Buildings Law, N.J.S.A. 40A:12-1 et seq., Bernards Township hereby accepts from Peter L. Winter and Elizabeth C. Winter, married, residing at 509 South Maple Avenue, Basking Ridge, New Jersey, 07920, and Paul Winter, Executor of the estate of Louise M. Winter, residing at 1403 Califon-Cokesbury Road, Califon, New Jersey, 07830,the following:
  1. Wetlands and Tree Conservation Easement on block 6101,lots 4.02, 4.03, 5.01, 5.02, 5.03, 5.04, 5.05, 5.06, 5.07 and 5.08 (after subdivision).
  2. Stream Buffer Conservation Easement on block 6101,lots 1.01 and 5.08 (after subdivision).
  3. Detention Basin, Drainage & Access Easement on block 6101,lot 5.07 (after subdivision).
  4. Drainage Easement on block 6101, lots 1.01, 4.01, 4.02, 4.03, 5.01, 5.02, 5.03, 5.04, 5.05 and 5.06(after subdivision).
  5. Sight Triangle Easement on block 6101,lot 5.01 (after subdivision).
  1. The easements are on file with the office of the Township Clerk.
  1. This Ordinance shall take effect upon its final passage and publication according to law.

EXPLANATORY STATEMENT
These easements are provided in conjunction with a major subdivision which received final approval from the Planning Board on October 20, 2009. The purpose of these easements is to regulate the use of the property in accordance with the Planning Board’s approval. The grantors maintain an escrow account with the Planning Board to reimburse the Township for costs incurred in the processing of these easements.

Ordinance #2304 was introduced and passed on first reading by the Township Committee of the Township of Bernards in the County of Somerset on 01/27/15 and then ordered to be published according to law. It will be further considered for final passage and adoption at a public hearing held at a meeting of the Township Committee at the Municipal Building, 1 Collyer Lane, Basking Ridge, NJ in said township on 02/10/15, at 8 P.M., when and where, or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance.
