Waiver, Assumption of Risk and Agreement to Hold Harmless and Indemnify
I, the undersigned client, understand that attendance at a dog training class or Doggie Daycare is not without risk to myself, my dog, members of my family or guests who may attend because some dogs to which I (we) may be exposed may be difficult to control and may be the cause of injury or property damage even when handled with the greatest amount of care. In addition, I also understand that while under the care of Progressive School for Dogs, LLC (“PSFD”) and its manager(s), employees, contractors and other agents, my dog(s) will co-mingle with animals of different ownership, and will be housed in appropriately-sized kennels at necessary times.
I hereby agree to release Liz Blasio, PSFD, and PSFD’s managers, members, employees, contractors, advisors, other agents, and the client-owners of other dogs from any and all liability of any nature for personal injury or property damage which I or my dog(s), my family members or guests may suffer including, but not limited to, any claim resulting from the action of any dog, myself, other students or dogs, instructors, the facilities, both real and personal, including claims arising from sidewalks and any parking lots, bathrooms or steps. Included in this is the right of PSD and its managers, members, employees, contractors and other agents to determine without liability if veterinary care is required in cases of illness, injury, or death. I understand that PSFD is required by the Colorado Department of Agriculture to have on file the name and contact information for a veterinarian that will hold my pet at their facility until my return in case of death.
I hereby agree to indemnify, hold harmless and defend Liz Blasio (the owner of the facility), PSFD, and PSFD’s managers, member(s), employees, contractors from any and all claims by any member of my family or any person accompanying me or any third party whatsoever while at training or at any function of Liz Blasio or PSFD while on the grounds or the surrounding areas and any and all claims for bodily injury and property damage brought as a result of any action of myself or any dog while under my control or direction. This indemnity, hold harmless and defend agreement applies even to acts of negligence of Liz Blasio and PSFD and is intended to cover claims brought against Liz Blasio, PSFD and PSFD’s managers, members, employees, contractors and other agents or any action of my dog while in training or elsewhere including but not limited to claims of failure to train said dogs.
This Waiver is a release of any and all claims, demands, damages, actions, causes of action, or suits at law or in equity of whatsoever kind of nature for or because of any manner or thing done, omitted, or suffered to be done by Liz Blasio, PSD and PSD’s managers, members, employees, contractors and other agents prior to and during the period of time I am utilizing any of the property, facilities or services of Liz Blasio or PSFD.
In addition to the above described Waiver, I herewith and hereby covenant not to cause any litigation to be filed against Liz Blasio, PSD, or PSD’s managers, members, employees, contractors and other agents, and to hold them harmless and indemnify them for any litigation which is filed against them, or claims made against them which litigation or claims are based on my conduct or the conduct of members of my family, my guests, and/or my dog(s).
