PROCEEDINGS OF THE PIERCE COUNTY, NORTH DAKOTA, BOARD OF COUNTY COMMISSIONERS

December 3, 2013

The Pierce County Board of County Commissioners met in regular session on December 3, 2013. Auditor-Treasurer, Fursather called the meeting to order at 8:00 A.M., with members Johnston, Bohl, Migler, Larson and Christenson present. Also present was Tim Chapman, Pierce County Tribune.

Auditor-Treasurer Fursather led the Pledge of Allegiance.

Upon call for nominations for Chairman, for ensuing year, Christenson nominated Johnston for Chairman. Following no further nominations, a motion was made by Migler that nominations cease and a unanimous ballot be cast for Duane Johnston for chairman. Motion carried.

Upon call for nominations for Vice-Chairman, for ensuing year, Bohl nominated Christenson. Following no further nominations, a motion was made by Johnston, that nominations cease and unanimous ballot be cast for Mike Christenson for Vice-Chairman.

Fursather turned meeting over to Chairman Johnston.

A motion was made by Bohl and seconded by Christenson, to accept the November minutes as mailed. Motion carried.

A motion was made by Migler and seconded by Larson, to accept the financial report for the month of November. Motion carried.

Board reviewed Officer fee reports and hourly workers time sheets.

A motion was made by Bohl and seconded by Christenson, to approve Treasurer’s checks -#5143-#5159 in the amount of $4,902.04 for the month of November. Motion carried

A motion was made by Migler and seconded by Christenson, that payment be made from the 2013 Disaster Fund to the following townships: Hagel Township $6,434.34 and Antelope Lake Township $42,908.70. Motion carried.

Board reviewed abatement application filed from Mary M Schmaltz, on Lot 8, Sub Div #11 for the years 2011 & 2012. A motion was made by Christenson and seconded by Bohl, to approve the abatement application from Mary M Schmaltz for the years 2011 & 2012, in accordance with homestead credit filed. Motion carried.

Yvonne Hagen, Community Service Coordinator, met and gave the board an update on the community service program.

A motion was made by Christenson and seconded by Migler, to re-appoint Curtis Roerick and Victor Scherr on the Planning and Zoning Board and to appoint Michael Voeller, to fill the unexpired term of Dennis Voeller on the Planning and Zoning Board. Motion carried.

A motion was made by Bohl and seconded by Larson, that payment be made from the 2011 Disaster Fund to the following township for road repair: Ness Township $308.19. Motion carried.

A motion was made by Migler and seconded by Bohl, that proper deed be issued to the following described county property as Lot 2, Block 3, located in the Village of Orrin, to Elling Township. Motion carried.

A motion was made by Bohl and seconded by Christenson, that proper deed be issued to the following described county property as Lots 1,2,3,4,5,6,7, 8, Block 4, and Lots 5,6,7,8, Block 3, located in the Village of Orrin to Benjamin J. Mack. Motion carried.

A motion was made by Migler and seconded by Larson, that proper deed be issued to the following described county property as Lots 1 and 2, Block 1, in the Village of Silva, to Richard M & Diane C Jundt. Motion carried.

A motion was made by Christenson and seconded by Bohl, that proper deed be issued to the following described county property as Lots 3 and 4, Block 8, located in the Village of Balta, to Jacob & Kerry Schaan. Motion carried.

A motion was made by Larson and seconded by Bohl, that proper deed be issued to the following described county property as E 15” of N 50’ of Lot 14 and all Lot 15, Block 1, Sikes 2nd Addition, located in the City of Rugby, to Palmer and Carol Bjoraa. Motion carried.

A motion was made by Migler and seconded by Christenson, to approve the application for Beer & Liquor License from Joe Goldade ( Larry’ Bar), Selz, and Rugby Golf Club, and that refund be made in accordance with ordinance. Motion carried.

A letter of resignation was submitted by Michael Erb, Deputy Sheriff. A motion was made by Migler and seconded by Bohl, to accept the resignation submitted by Michael Erb. Motion carried.

A motion was made by Migler and seconded by Christenson, to re-appoint Duane Hawk, as a member of the Pierce County Water Resource Board. Motion carried.

A motion was made by Christenson and seconded by Migler, to re-appoint Bohl, as a representative on the North Central Human Service Advisory Board. Motion carried.

A motion was made by Bohl and seconded by Larson, to approve those bills previously paid and those yet unpaid were ordered paid. Motion carried.

Mary Hermanson, Social Service Director, met with the board and asked when the cubicles would be arriving and if help would be available to move their files and furniture to their new temporary location. Also discussed was Project Joy.

Jessica Tagestad, Wold Engineering, met with the board and had the contracts for the three allotted road projects. A motion was made by Bohl and seconded by Migler, to accept the contract for the preliminary and construction engineering agreement with Wold Engineering for the following projects:

1.  CNOA 3526 (053) a reshaping and graveling project from ND 3 east 3 miles.

2.  CNOA 3529 (054) a hot bituminous Pavement overlay from ND 17 north 3 miles to Pierce County line.

3.  CNOA 3505 (054)a reshaping and graveling project located 8 miles West and 5 miles South of Rugby. Motion carried.

A motion was made by Bohl and seconded by Christenson, to approve the following polling places:

Precinct # 1 Wolford Fire Hall; Precinct #2 St. Anthony’s Hall, Selz; Precinct 3, Precinct 4, Precinct 5,

Precinct 6, Precinct 7 and Precinct 8, Rugby Armory and that the hours for polling places be set from 8:00 A.M. to 7:00 P.M. Motion carried.

A public hearing was held at 10:30 A.M. in the commission room of the Pierce County Courthouse on the proposed plan to re-designate the office of the Pierce County Clerk of District Court from an elective office to an appointive position. No written comments were received prior to the public hearing. One resident, Tami Mayer, shared her views on the position of being elected versus appointed. There being no further comments, the hearing was adjourned at 11:00 A.M.

Dennis Romfo, resident of Reno Valley Township, stopped in and shared his concerns with the road in his township.

Galen J. Mack, States Attorney, joined the meeting. Discussion was held concerning signage on Farm to Market Roads, Community Service Program and Project Joy.

A motion was made by Christenson and seconded by Larson, to approve the application for Beer & Liquor License from Rugby Eagles Aerie #3834, and that refund be made in accordance with ordinance. Motion carried.

A motion was made by Bohl and seconded by Larson, to approve the final resolution for the Pierce County Clerk of District Court from an elective office to an appointive position. Upon roll call vote- Bohl “Aye”; Migler “Aye”, Larson “Aye”, Christenson “Nay” and Johnston “Aye”. Resolution adopted.

There being no further business, Johnston moved to adjourn at 11:55 A.M.

The Pierce County Board of County Commissioners met in regular session on December 17, 2013.

Chairman Johnston called the meeting to order at 9:15 A.M., with members Christenson, Bohl, Migler and Larson present. Also present was Tim Chapman, Pierce County Tribune.

Chairman Johnston led the Pledge of Allegiance.

Roger Tank met with the board concerning road issues.

A motion was made by Bohl and seconded by Migler, to approve those bills previously paid and those yet unpaid were ordered paid. Motion carried.

Board reviewed abatement application on parcel #05199-000 in Township 153-74 to reduce the taxable value on this parcel, as it was taxed for a residential structure, and no structure is on this parcel. A motion was made by Christenson and seconded by Migler, to approve the abatement application, due to clerical error. Motion carried.

A motion was made by Bohl and seconded by Migler, that payment be made from the 2013 Disaster Fund to the following township for road repair: Rush Lake Township $36,109.70. Motion carried.

A motion was made by Migler and seconded by Christenson, that payment be from the 2011 Disaster Fund to the following township for road repair: White Township $658.00. Motion carried.

A motion was made by Larson and seconded by Bohl, to transfer $25,000.00 to Law Enforcement Fund from Wireless Fund. Motion carried.

A motion was made by Christenson and seconded by Migler, to transfer $15,000.00 from Wireless Fund to E-9-1-1 Fund. Motion carried.

A motion was made by Bohl and seconded by Migler, to transfer $100,000.00 from Highway Distribution Fund to Road & Bridge Fund. Motion carried.

A motion was made by Larson and seconded by Bohl, to transfer $7,000.00 from the General Fund to Library Elevator Project. Motion carried.

A motion was made by Bohl and seconded by Migler, to transfer $15,000.00 from the General Fund to the Health Insurance Fund. Motion carried.

Nickie Livedalen, Social Worker, met with the board for an exit interview. Board thanked her for her years of service and wished her the best in her new job.

A motion was made by Larson and seconded by Migler, to make an additional payment of $6,000.00 to the USDA Rural Development for the Library Elevator Project. Motion carried.

A motion was made by Christenson and seconded by Larson, to transfer $15,000.00 from the General Fund into the Law Enforcement Center Fund. Motion carried.

Johnston left the meeting.

Vice-Chairman Christenson presided.

Board talked with Gloria Larsgaard, Architect, with EAPC, asking what the projected estimated cost would be to renovate the old jail facility verses putting up a new building. Gloria informed the board she would get some figures and report back to the board before their January meeting.

There being no further business, Christenson moved to adjourn at 10:35 A.M.
