Proceedings of Public Hearing held on 11.11.2008 at 11:00 AM in the office of Deputy Commissioner (West), Old Middle School Complex Lawrence Road Industrial Area, Rampura, Delhi – 35, for the construction of proposed Pipe line Terminal at Tikrikalan including branch pipeline from Mathura Jalandhar Pipeline by M/s Indian Oil Corporation Limited

M/s Indian Oil Corporation Limited Mumbai has proposed to construct Pipe line Terminal at Tikrikalan including branch pipeline from Mathura Jalandhar Pipeline The Proposed project is listed in the list of projects or activities requiring prior Environmental Clearance at S.No.- 6(B) of the Schedule of EIA notification dated 14.09.2006. The Proposed Project requires to obtain the Environmental Clearance from Ministry of Environment and Forest, Govt. of India as per Environment Impact Assessment Notification dated 14.09.2006. As per new EIA notification dated 14.09.2006, Public Hearing / public consultation is required for such type of projects. Accordingly, Public Hearing was conducted on 11.11.2008 at 11:00 AM in the office of Deputy Commissioner (West),Old Middle School Complex Lawrence Road Industrial Area, Rampura, Delhi – 35, after publishing the public notice giving 30 days time to file objections / views / suggestions by the interested persons. Public notice giving details about date, time and venue of the Public Hearing as well as details of the offices where hard & soft copy of EIA report, Executive Summary of proposed project can be inspected / accessed by the interested persons was published in the following two leading Newspapers:

(1)Times of India(English) dated 11.10.2008

(2)Dainik Jagran (Hindi) dated 12.10.2008

The attendance sheet of (1) Panel Members (2) Project Proponents and (3) Public and other interested persons who have attended the Public Hearing are enclosed at Annexure ‘I’, ‘II, and ‘III’ respectively.

At the outset, Dy. Commissioner (West) welcomed all those present during the Public Hearing and asked representatives from M/sIndian Oil Corporation Limited. to explain the details of the Project. The representative of M/sIndian Oil Corporation Limited, gave presentation of the Project on various environmental, social and other related aspects of the Project. Subsequently, DC (West), the Chairman of the Panel requested the public to give their comments / objections / suggestions on various aspects of the proposed project.

It is pertinent to mention that various Public, their representative and other interested persons attended the meeting for comments / objections on the Project in response to the Notice issued in English & Hindi Newspapers and placing copies of EIA reports, Executive Summary of EIA reports and copies of public notices in English & Hindi at the designated offices and also on the website of DPCC. This is to mention that no written comments were received in response to public notice issued.

After this the Deputy Commissioner (West) sought comments of those available. The comments raised and response given by IOCL during public hearing is enclosed as Annexure IV.

Shri Pankaj Kapil, Panel Member from DPCC asked the audience to raise any other issue or query pertaining to the proposed project. No person has raised any other issue or question.

With the permission of Deputy Commissioner, Shri. Satish Mathur, the public hearing stands concluded with vote of thanks to the Chair.

Annexure IV

The proceedings of the hearing are as below:-

Mr. Ishwar singh S/o Sh. Buffe singh Tikrikalan village, commented on the project and related aspects and the project proponents replied to the queries/comments as mentioned below:-

1. / When the survey of the project was taken up, the land use was agriculturein nature. Subsequently the land use at Tikrikalan has been declared as industrial by DDA and therefore lots of development has taken place like demarcation of land, laying of roads etc. In view of subsequent developments, is it possible to change the route of the proposed pipeline to avoid the alignment through the demarcated land. In case of change of alignment a 40 feet wide road provided among the demarcated land can be used for the new pipeline alignment / IOC clarified that when the survey is carried out, it is always done through a shortest possible route and the khasra numbers through which the pipeline is passing,the affected persons were informed at the time of notification u/s 3(1).
IOCL clarified that on account of changed land use pattern thereafter, the pipeline route cannot be changed.
2. / Can any road be built on the pipeline route / No road can be built over the product pipeline Right of Way.
3. / How much area is to be left for undertaking development near the pipeline route / 55 feet width has to be left around the pipeline where land pattern usage cannot be changed.
4. / In the proposed project their will be a mixed handling of gas and oil. Will it not be risky. / All the facilities are designed as per the latest rules framed by Chief Controller of Explosives, Nagpur & Oil Industry Safety Directorate. As such the project will not be risky.
5. / What will be the date of commencement and completion the project. / The project activities are scheduled to commence in March 2009 and is scheduled to be completed by March 2010 (Commissioning anticipated by September 2010).

2. Mr. Jeet raj , Resident of Tikrikalan, commented on the project and related aspects and the project proponents replied to the queries/comments as mentioned below:-

1. / The route of the pipeline has not been defined. / The route of the pipeline has been clearly defined by means of stone markers and the khasra numbers through which the pipeline will pass have also been mentioned in the Gazette Notifications / newspapers.
2. / Whether the compensation for the acquired land will be given or not if yes at what rates. / Yes, the compensation as per the rates approved by the Government will be given to the affected persons.
3. / How much deep will be the pipeline / The pipeline will be atleast 1 m deep below the natural ground level.
4. / Whether any harm to the agriculture / No harm to the agriculture will be there except during construction phase, which is reversible and will be compensated for.
5. / How the leakages from the pipeline will be taken care of. / The pipeline is designed as per latest OISD guidelines and is protected by external coating as well as cathodic protection system. In order to assess the exact location of the leakages, if any, leak detection system will be installed.

3. Mr. Ajeet Singh, Resident of Tikrikalan, commented on the project and related aspects and the project proponents replied to the queries/comments as mentioned below:-

1. / Whether any change in alignment of pipeline is possible to avoid certain plots. An objection in writing was also handed over stating that area has been earmarked in zonal plan L of DDA as industrial and plots have been setup in the area. Requested to take the pipeline through NEELWAL-GHEWRA main road. If not feasible they are ready to provide 36’ to 40’wide road in order to avoid the pipeline passing through the plots. / IOCL clarified that when the survey was carried out and on subsequent 3(1) notification and the objections received from the affected persons were received. Accordingly 6(1) notifications have been published in Gazette. Hence at this stage it is not possible to change the route of the pipeline.

4. Mr. Arjun, Resident of Tikrikalan, commented on the project and related aspects and the project proponents replied to the queries/comments as mentioned below:-

1. / Whether the activity of the project will have any impact on the human health / No processing of the petroleum products will take place in the proposed project. Ambient air quality and other parameters are well within the prescribed limits and no adverse impact on the human health will be there. Vapour recovery system is proposed and the project is more safe than Shakurbasti.
  1. Mr. Anshul Singhal, Resident of Tikrikalan, commented on the project and related aspects and the project proponents replied to the queries/comments as mentioned below:-

1. / How many trees will be felled during the project activity / IOCL replied that 335 trees will be felled for the construction of terminal and 10 times more trees will be planted as compensatory plantation. The work order for the same has been issued.
2. / Khasra wise details of the trees cutting be provided / Khasra wise details of trees to be felled have already been given to the forest department and these are available there.
3. / My land has more than 300 trees in the area. How many trees due to the pipeline will be cut. / During pipeline laying, efforts will be made to avoid the felling of trees and only those trees which will directly hinder laying of the pipeline shall be felled. The exact details regarding number of trees required to be felled will be firmed up during panchnama preparation and the owners will be compensated as per Government guidelines.
4. / Once pipeline will laid plantation of trees will not be allow over it. How the project will compensate on this account. / As per the notification issued by Forest department, compensatory plantation @ 10 trees per tree felled will be planted.
5. / How much traffic is likely to increase due to up coming terminal / Approximately 200 tank trucks are likely to be filled per day at the terminal.
