Procedures for the Preparation and Distribution of Aeronautical Information

Issued pursuant to Section 54,

Paragraph three of the

Law On Aviation

I. General Provisions

1.These Regulations prescribe the procedures by which aeronautical information necessary to the performance of air craft flights in the airspace of the Republic of Latvia shall be prepared and distributed.

2.All aeronautical information shall be prepared and distributed in conformity with the requirements of the legislation of the European Union, Annex 15 to the Convention on International Civil Aviation of 7 December 1944 (hereinafter – Convention) and these Regulations.

3.Aeronautical information shall be prepared and distributed by the Aeronautical Information Service of the State Joint-stock company “Latvijas gaisa satiksme” [Latvian Air Traffic] (hereinafter – Aeronautical Information Service).

4. The Aeronautical Information Service shall acquire, compile, edit, format and publish aeronautical information.

5.The State agency “Civilās aviācijas aģentūra” [Civil Aviation Agency] (hereinafter – Civil Aviation Agency) shall carry out the State supervision and control of the preparation and distribution of aeronautical information.

6.Aeronautical information shall be distributed as a compilation of aeronautical information or separate parts of the referred to compilation. The aeronautical information compilation shall consist of the following parts:

6.1.an aeronautical information publication, including amendments and additions thereof;

6.2.a notification that has been sent using means of electronic communication and that contains information regarding any aeronautical equipment, service and implementation of provisions, changes or information regarding hazards (hereinafter – NOTAM notification), and pre-flight information newsletters;

6.3. aeronautical information circulars; and

6.4. lists of NOTAM notifications.

7.A quality management system, conforming with the standards of the International Organisation for Standardisation LVS EN ISO 9001 Quality Management Systems – Requirements, shall be introduced and maintained in the Aeronautical Information Service in order to ensure the preparation and distribution of aeronautical information in conformity with international requirements.

II. Acquisition of Aeronautical Data

8.The Aeronautical Information Service shall acquire aeronautical information from institutions and merchants that are either directly or subordinately related to the safety of aircraft flights (hereinafter – aeronautical information providers).

9.The Aeronautical Information Service may request aeronautical information from foreign aeronautical information services.

10.The Civil Aviation Agency, in accordance with Paragraph 8 of these Regulations, shall prepare a list of aeronautical information providers, shall co-ordinate it with the Aeronautical Information Service and shall approve it.

11.The following information shall be indicated in the list of aeronautical information providers referred to in Paragraph 10 of these Regulations:

11.1. the name of the aeronautical information provider;

11.2. the identification number that has been assigned to the aeronautical information provider by the Civil Aviation Agency;

11.3. the legal address and actual location of the aeronautical information provider;

11.4.the given name, surname, position, telephone and fax number, e-mail address of the contact person; and

11.5. content of the information to be provided.

12. Within three working days, the Civil Aviation Agency shall update the approved list of aeronautical information providers in the following cases:

12.1. a new institution or merchant is created that is either directly or subordinately related to the safety of aircraft flights;

12.2. the institution or merchant included in the list has been liquidated; or

12.3. information regarding the institution or merchant referred to in the approved list has been changed.

13. The aeronautical information providers referred to in Paragraph 8 of these Regulations shall provide aeronautical information:

13.1.in conformity with Annex 1 to these Regulations, if the aeronautical information is intended for publication in the informative publication “Aeronautical Information Publication”; or

13.2.in conformity with Annex 2 to these Regulations, if the aeronautical information is intended for the issue of a NOTAM notification.

14. The Aeronautical Information Service shall ensure a possibility for aeronautical information providers to submit the aeronautical information referred to in Sub-paragraph 13.2 of these Regulations twenty-four hours a day without interruption.

15. The Aeronautical Information Service shall conclude a contract with the aeronautical information providers referred to in Paragraph 8 of these Regulations, except for the State Joint-stock company Latvian Air Traffic and the Civil Aviation Agency, regarding the acquisition of aeronautical information and conditions for the acquisition thereof.

16. Prior to conclusion of the contract referred to in Paragraph 15 of these Regulations, the Aeronautical Information Service shall co-ordinate it with the Civil Aviation Agency.

17. In the last quarter of each year, the Aeronautical Information Service shall send to the aeronautical information providers referred to in Paragraph 8 of these Regulations the information circular regarding the kind of information and the ‘until date’ it is to be provided in order to publish it in the informative publication “Aeronautical Information Publication” in the forthcoming year.

18.The State Joint-stock company Latvian Air Traffic shall provide the following to the Aeronautical Information Service of the relevant structural unit:

18.1. aeronautical information regarding rescue and search measures;

18.2. aeronautical information regarding short-term changes in air traffic control and in the aerodrome area flight procedures;

18.3. aeronautical information regarding flight planning;

18.4. aeronautical information regarding ground communication, navigation and observation communication equipment; and

18.5. other information which it considers to be essential for the safety of aircraft flights.

19. The Civil Aviation Agency shall provide the following to the Aeronautical Information Service:

19.1. aeronautical information regarding the formation of a new airspace structure element and long-term changes of the existing airspace structure elements;

19.2. aeronautical information regarding the disposition of new objects, if they constitute a threat to aircraft flights, as well as regarding elimination of the existing dangerous objects or changes carried out in them, if they constitute a threat to aircraft flights; and

19.3. other information considered by the Civil Aviation Agency to be essential for the safety of aircraft flights.

20. Aeronautical information providers shall provide the information referred to in Paragraphs 18 and 19 of these Regulations to the Aeronautical Information Service as soon as such information is at the disposal thereof.

III. Processing of Aeronautical Information

21. The Aeronautical Information Service shall introduce a register for the received aeronautical information. The following shall be indicated in the referred to register:

21.1. the date and time for the receipt of aeronautical information;

21.2. the name of the aeronautical information provider, given name and surname of the contact person;

21.3. the part of the aeronautical information compilation, to which the submitted aeronautical information pertains to; and

21.4. each activity that is carried out with the aeronautical information after the receipt thereof, as well as shall record the changes carried out in the process of preparing aeronautical information.

22. The Aeronautical Information Service shall immediately register aeronautical information after the receipt thereof.

23. The request referred to in Paragraph 22 of these Regulations shall not be applied to aeronautical information that pertains to aerodromes certified according to the procedures specified in regulatory enactments. In such case, prior to the registration of aeronautical information, the Aeronautical Information Service shall check whether it is co-ordinated with the Civil Aviation Agency in conformity with the regulatory enactments regulating procedures for the exploitation of civil aviation aerodrome.

24.If the aeronautical information referred to in Paragraph 23 of these Regulations is not co-ordinated with the Civil Aviation Agency, the Aeronautical Information Section shall not register the received aeronautical information and shall inform the aeronautical information provider thereof.

25.The Aeronautical Information Service shall examine the received aeronautical information, update it, if necessary, and co-ordinate repeatedly with the aeronautical information provider.

26.After the examining of aeronautical information, the Aeronautical Information Service shall put it in the European Aeronautical Information Database.

27. The Aeronautical Information Service, taking into account the type of distribution of the information referred to in Paragraph 6 of these Regulations, shall format aeronautical information in conformity with the requirements for the distribution of aeronautical information of Annex 15 to the Convention.

28.The Aeronautical Information Service shall keep aeronautical information submitted by aeronautical information submitters as long as the distributed aeronautical information is current.

IV. Co-ordination and Distribution of Aeronautical Information

29.The Aeronautical Information Service shall distribute aeronautical information, which is to be distributed immediately as a NOTAM notification with a temporary and short-term character, without the approval of the Civil Aviation Agency.

30.The Aeronautical Information Service shall submit the prepared aeronautical information for approval to the Civil Aviation Agency. This condition shall not apply to the aeronautical information referred to in Paragraph 29 of these Regulations.

31. The Civil Aviation Agency, not later than on the next working day after the receipt of the aeronautical information referred to in Paragraph 30 of these Regulations, shall send aeronautical information, which is to be distributed as an aeronautical information publication and pertains to the general part of the aeronautical information publication, for co-ordination to the Ministry of Transport. Within three working days, the Ministry of Transport shall co-ordinate the received aeronautical information and shall inform in writing the Civil Aviation Agency thereof.

32. If aeronautical information referred to in Paragraph 30 of these Regulations:

32.1. does not have to be co-ordinated with the Ministry of Transport, the Civil Aviation Agency shall examine the referred to information and shall approve it within three working days after the receipt thereof; or

32.2. has to be co-ordinated with the Ministry of Transport, the Civil Aviation Agency shall examine the referred to information and approve it within a time period of three working days after the receipt of the co-ordination of the Ministry of Transport.

33.The Civil Aviation Agency shall inform in writing the Aeronautical Information Service regarding the approval of aeronautical information to be distributed. The duty of the Aeronautical Information Service is to ensure the distribution of this information.

34. The Aeronautical Information Service, using postal services or an electronic information medium, shall send free of charge one copy of the aeronautical information compilation to the aeronautical information services of the states parties to the Convention.

35.If more than one copy of the aeronautical information compilation is necessary for the aeronautical information services referred to in Paragraph 34 of these Regulations, as well as if another aeronautical information user wishes to receive the aeronautical information compilation, the Aeronautical Information Service shall conclude a mutual agreement with the relevant aeronautical information service or with the relevant aeronautical information user regarding the receipt of the aeronautical information compilation.

36.The Aeronautical Information Service shall send free of charge one copy of the aeronautical information compilation to the Ministry of Transport, to the Ministry of the Interior and to the Ministry of Defence.
