Procedures for Lodging Claims in respect of

Overseas Associated Costs

1.Applicants who have received payment in respect of eligible overseas product should now submit claim form PRS7.E (attached) in respect of costs incurred on overseas storage, transport, demurrage, destruction, non-refundable import duties and product testing costs. Only costs incurred in respect of eligible overseas product may be claimed.

2.In respect of all such costs claimants are required to produce documentary evidence that the amount claimed was charged to the applicant (invoice) and confirming the volume of product involved, as well as any dates relevant to the claim (e.g. period of storage, transportation dates etc.). A list of the associated PRS3s or equivalent verifications of destruction of the product in question should be associated with each invoice. In the case of invoices covering both eligible product under the Scheme and other ineligible product, the element of the invoice paid in respect of eligible product should be clearly distinguishable since only this portion can be considered for re-imbursement.

3.Claimants will be required to produce documentary evidence that the amount charged has actually been paid to the service provider (bank statement). In cases where this is not available to be submitted in advance with the claim the evidence of onward payment by the applicant for the service must be produced within 60 days of the receipt of Scheme payment, failing which the Department reserves the right to deem the payment invalid and recoup the monies concerned.

4.Translations must be provided for any foreign-language documentation that issued from an overseas competent authority abroad and which is presented in support of payment (e.g. certificate of destruction, or payment of import duties). The authenticity of the document in question and any official stamps applied should be confirmed via the relevant Irish Embassy or Bord Bia representative.

5.As already advised, compensation in respect of the cost of destruction/disposal abroad will be paid at the lower of the local rate or €178 per tonne (the locally applicable amount of VAT accruing on the payable rate will also be paid).

6.All applications must be received by this Department at its offices in Johnstown Castle Estate, Co. Wexford no later than Friday 13th November 2009.

Provision of false or misleading information

7.By signing the required forms the applicant confirms that all information is true and accurate to the best of his or her knowledge. Where, for the purposes of obtaining payment under this Scheme, the applicant or a person acting on his/her behalf knowingly makes a false or misleading statement or declaration, or includes ineligible material or withholds essential information, the claim in question shall be rendered ineligible for payment and the applicant may be precluded from making any further claims. A deliberate attempt to obtain monies by fraudulent means may render the applicant and any others involved liable to prosecution.

Appeal/review

8.An applicant, who is not satisfied with the determination of the Minister regarding an application under this Scheme, may lodge an appeal to the Minister seeking a review of the decision. The review will be a full and new examination of the matter carried out by a more senior member of staff of this Department. The appeal must be made, in writing, within one month of the date of the decision. The appeal must include the facts and contentions upon which the applicant intends to rely together with such documentary evidence that the applicant wishes to submit in support of his/her appeal.
