Procedure for Managing PotentialConflicts of Interests

GeneralProvision

FulldisclosureandconsultationregardingpotentialconflictsofinterestisinthebestinterestofGadsdenStateCommunityCollegeanditsemployees.However,GadsdenStateCommunityCollegerespectstheprivacyofitsemployeesanddoesnotwishthemtodisclosefinancialorpersonalinformationthatdoesnotrelatetoapotentialconflictofinterest.Anyemployeewhoreceivessuchfinancialorpersonalinformationintheprocessofdisclosureisresponsible to takereasonable steps to maintain the confidentialityof such information.

Evaluating Disclosures

Thoseevaluatingdisclosuresateachlevelofreviewneedaframeworkfordeterminingthe permissibilityofactivitiesand for assessingthe degree to which disclosed activitiesmayposerisktoGadsdenStateCommunityCollege.Belowisalistofsuggestedquestionsfortheinitialdetermination. Otherquestions related to specialcircumstances should beaddedasappropriate.

a.Istheemployeeinvolvedinasituationand/orcircumstancethatarenotincompliancewiththepoliciesoftheBoard of Trustees,the Alabama Community College System, the College,and Stateand Federal laws?

b.Is the employee involved in a situation that might raise questions of bias,inappropriate use ofCollege assets or otherimpropriety?

c.Isthereanyindicationthattheemployees’obligationstotheCollegearenotbeingmet?

d.Doestheemployeeappeartobesubjecttoincentivesthatmightleadtoconflictsorbias?

e.Has the employee inappropriatelyrepresented theCollege to outside entities?

f.Isthereanyindicationthattheemployeehasimproperlyfavoredanyoutsideentityor appears to haveincentive to do so?

g.Could the employee’s circumstances represent any possible federal or stateviolation(s)?

h.Could the proposed activitywithstand public scrutiny?

i.Has all relevant information concerningtheemployee’sactivitiesbeen acquired?Hasthere been full disclosureof information?

Management of Conflict

a.Permittedasis,becausethedisclosedinformationdoesnotrepresentaconflictofinterest or otherpossiblesource of unreasonable bias orinappropriate activity, or

b.Unacceptable,andthusprohibitedbecausethedisclosedinformationrepresentsaconflictofinterestand/orisapossiblesourceofunreasonablebiasorinappropriateactivity.Theemployee’sconflictofinterestmustbeimmediatelyresolvedandreportedonthedisclosureform.IftheemployeeobjectstotheevaluationordecisionmadebytheSupervisorand/orCabinetmember,the employee shall completethe appealform for evaluationbythe President.
