Procedure for Additions to the Record of Protected Structures at any time other than in the course of making a Development Plan:

This procedure also applies to deletions from the record

(1)A planning authority which proposes, at any time other than in the course of making its development plan to make an addition to the record shall:-

(a) serve notice on each person who is the owner or occupier of the proposed protected structure

(b) send particulars of the proposed addition to the Minister for the Environment, Heritage and Local Government, and to the following prescribed bodies:
the Heritage Council
an Taisce – the National Trust for Ireland
the Arts Council ( if the structure is post 1900 )

(c) cause notice of the proposed addition to be published in at least one newspaper circulating in its functional area.

(2) A notice served under paragraph (a) or (c) shall state the following: -

(a)Particulars of the proposed addition may be inspected at the offices of the local authority during a period of 6 weeks;

(b)During such period, any person may make written submissions or observations, with respect to the proposed addition, to the planning authority, and that such submissions or observations will be taken into consideration before the making of the addition;

(c)Whether or not the proposed addition was recommended by the Minister for the Environment, Heritage and Local Government

(d)That if the proposed addition was recommended by the Minister for the Environment, Heritage and Local Government, the planning authority shall forward to that Minister for his or her observation a copy of any submission or observation made under paragraph (b)

(3) Before making the proposed addition the planning authority shall:-

(a)consider any written submissions or observations received;

(b)have regard to any observations received from the Minister for the Environment, Heritage and Local Government, concerning the submissions or observations, within 4 weeks after receipt by that Minister of a copy of the submissions or observations.

(4) Within 12 weeks after the end of the period allowed under subsection 2a for inspection, the planning authority shall decide whether or not the proposed addition or deletion should be made.

(5)Within 2 weeks after making an addition to the record, a planning authority shall serve on the owner and on the occupier of the structure concerned a notice of the addition, including the particulars.

(6)The making of an addition to the record of protected structures is a reserved function of the elected members of the Local Authority.
