RESOLUTION

WHEREAS,in 1988, as the result of litigation instituted against West Windsor Township (“Township”), the Township entered into a consent order which established the Delaware & Raritan Canal/Duck Pond Run Interceptor Sewer District (“Interceptor Sewer”) and obligated the Township to enact West Windsor Code Section 200-89 under which the Township is responsible for the collection and disbursement of the “fair share” contributions made toward construction costs of the aforementioned Interceptor Sewer System in accordance with a formula set forth in said Ordinance; and

WHEREAS,the Township Engineer has made all the necessary calculations based on the formula contained in West Windsor Code Section 200-89 to ascertain the amounts due and owing from the properties located within the Interceptor Sewer District; and

WHEREAS,the owners of the properties located in the Interceptor Sewer District have paid into the Township their “fair share” of the construction costs of the Interceptor Sewer System in an amount totaling $146,225.00; and

WHEREAS,the Township Engineer has calculated those amounts due and owing to the downstream properties who paid more than their “fair share” of the construction costs of the Interceptor Sewer System, those properties being Princeton Greens/Princeton Overlook Partnership, Canal Pointe Associates/Princeton Carnegie Associates III, NLA Associates, West Windsor/Route 1 Associates, and Princeton BMW; and

WHEREAS,the reimbursement amounts due to each of the aforementioned properties as calculated by the Township Engineer according to the formula set forth in West Windsor Code Section 200-89 is as follows:

Princeton Greens/Princeton Overlook Partnership$ 26,519.67

Canal Pointe Associates/Princeton Carnegie Associates III$ 45,951.40

NLA Associates$ 56,051.14

West Windsor/Route 1 Associates$ 4,381.79

Princeton BMW$ 13,321.00

WHEREAS,the Township is obligated under West Windsor Code Section 200-89 to disburse said monies to these property owners.

NOW, THEREFORE, BE IT RESOLVEDby the Township Council of the Township of West Windsor, as follows:

  1. The Chief Financial Officer of the Township of West Windsor is hereby authorized and directed to disburse the monies collected pursuant to West Windsor Code Section 200-89 to the following entities in the following amounts:

Princeton Greens/Princeton Overlook Partnership$ 26,519.67

Canal Pointe Associates/Princeton Carnegie Associates III$ 45,951.40

NLA Associates$ 56,051.14

West Windsor/Route 1 Associates$ 4,381.79

Princeton BMW$ 13,321.00

  1. A certified true copy of this resolution shall be furnished by the Township Clerk to the Chief Financial Officer and Township Engineer.
