Minutes

March 7, 2016

The regular meeting of the Board of Road Commissioners for Presque Isle County was held at the Road Commission office at 657 South Bradley, Rogers City, Michigan. Chairman Charles Rhode called the meeting to order at 8:30 a.m.

Board Members Present: Charles Rhode, Ronald Bischer, Thomas Catalano

Minutes:

A motion was made by Bischer (Catalano) to accept minutes from March 7, 2016 meetings as presented.

Accounts Payable:

Motion by Catalano (Bischer) to approve the February 22, 2016 accounts payable in the amount of $41,509.15

Ayes: Rhode, Bischer, Catalano

Motion by Bischer (Catalano) to approve the March 7, 2016 accounts payable in the amount of $96,756.54

Ayes: Bischer, Rhode, Catalano

Supt./Mgr Report:

·  Snowfall year to date is: 91.5”

·  The MIOSHA consultation is planned for April 26, 2016. All three locations will be inspected.

·  Supt./Mgr will be meeting with Heardy Tulgestska and County Road Engineer Mark Straley to discuss economic development funding possibilities for the improvement of Tucker Road, as there will be new jobs eligible for Category A funding. Further information will be provided at a future meeting.

·  Spring weight restrictions went into effect on Saturday, March 6, 2016 at 8:00 a.m.

·  Board was advised that both property owners adjoining Trapp Road will be attending the next regular meeting.

·  MCRCSIP is seeking candidates for their Board for one at large position if any Commissioner is interested.

·  The County Road Association meeting is March 15-17, 2016 in Lansing.

·  A list of bonded as of March 4, 2016 was reviewed by the Board.

New Business:

Information was provided to the Board regarding a property damage two vehicle accident an Onaway driver was involved in on Thursday, March 3, 2016. A sketch of the accident site and photos were reviewed and discussed. The recommendation from MCRCSIP is to pay the other driver’s $1,000.00 deductible with a release and waiver being obtained prior to issuing the check. The Road Commission would be responsible for our $500.00 deductible.

A motion was made by Bischer (Catalano) to authorize payment up to $1,000.00 for the accident claim.

A motion was made by Catalano (Bischer) authorizing the Chairman to sign the 2015 Act 51 Certified Mileage Map Title sheet.

Commissioner Bischer provided copies of an article regarding Michigan’s Highway by User Act which was originally enacted by PA 283 of 1909 to provide uniformity to the creation of public roads. The article summarized the case The City of Kentwood vs. Sommerdyke which was decided by the Michigan Supreme Court. The court decision affirmed that the width of a road by user is 4 rods (66 feet) which is 2 rods (33 feet) either side of the center of the road when a road has been used for ten years or more. Roads located on section or quarter lines shall be the center of such roads.

Discussion was held regarding County Line Road and other roads by user within the County. Clerk Wirgau was asked to obtain the date of the Michigan Supreme Court ruling on the case for the next meeting.

The next meetings dates are March 21, 2016 at 8:30 a.m. and April 4, 2016 at 8:30 a.m.

There being no further business it was moved by Catalano (Bischer) to adjourn the meeting at 9:36 a.m.
