1. Fraud or Falsification

  1. Any knowing and willful act to falsify, conceal or alter a material fact, or any false, fraudulent or fictitious

statement or representation in connection with performance of work under this order may be punishable in accordance

with applicable Federal Statutes.

  1. The Seller agrees that all employees engaged in the performance of this purchase order shall be, if they have not been

previously, informed in writing prior to their commencing performance of work under this order that there is a risk of

Federal criminal penalties associated with any falsification, concealment or misrepresentation in connection with the

performance of work under this order.

Such Statement may read as follows:

“This company/division/department/ branch performs work under contracts which are within the jurisdiction of department

or agencies of the United States Government. Some of the work performed under these contracts affect the national

security of the United States and the requirements of these contracts are designed to insure that essential attributes

of the work are carefully checked or inspected and that records accuratelyreflect the results of all work. Any falsification,

concealment or alteration of any material fact, or any false, fraudulent or fictitious statement or representation in

connection with the work under any contract within the jurisdiction of the Government is not only prohibited by

company policy, but may be punishable under Federal Law.”

“NOTE: The recording of false, fictitious or fraudulent statements or entries on this document may be punished as a

felony underthe FederalStatues including Federal Law, Title 18, Chapter 47.”

  1. The Seller agrees to include this Article, including this paragraph c in every subcontract or lower-tier purchase

order issued hereunder.

2. Government Inspection

During the performance of the order your quality control or inspection system and manufacturing processes are

subject to review, verification and analysis by authorized Government representatives. Government inspection or

release of product prior to shipment is not required unless you are otherwise notified.

3. Government Rights

“…Notwithstanding this or any other provisions of this Purchase Order, upon prior written notice to Buyer and to the

extent such use will not interfere with Seller’s performance of purchase orders with Buyer in effect at the time. Seller

with the U.S. Government’s authorization, may use on other contracts all buyer furnished designs, drawings, special

tooling, equipment, material, engineering data or other technical or proprietary information, etc., which the U.S.

Government owns or has the right to authorize the use thereof.”
