1 INTRODUCTION

1.1  General Information

1.2 This is Section 2 of a two part Pre-Qualification Questionnaire (PQQ) Process. This section is mandatory for all applicants but it should only be completed once Lot(s) are applied for in Section 1.

1.3 General information about this PQQ and how it will be scored is provided in the Section 1 document(s) and this section will be subject to any overriding principles or rules set out therein.

1.4 Peabody is now, where at all possible, embracing the approach being adopted by local authorities whereby self-declarations of compliance are accepted as part of the procurement process. Submission of any certificates or documentary evidence will only be required retrospectively on request. This approach is intended to reduce costs and time for suppliers and encourage Small and Medium Enterprises (SMEs) and wider competition. It is consistent with the UK government’s aim to reduce the burden of pre-qualification questionnaires (PQQ).

2.1.1 Bidders are required to meet the above listed requirements in full in order for their submission to be considered. Pass/Fail questions reflect the minimum standards and/or thresholds Peabody has set. Questions marked ‘For information’ are not awarded marks and are classified ‘for information only’.

3.1 APPENDIX-A

3.1.1 SUMMARY OF INELIGIBILITY CONDITIONS PROVIDED BY REGULATION 23 OF THE PUBLIC CONTRACTS REGULATIONS 2006 (SI 2006 No: 5) AS AMENDED BY THE PUBLIC CONTRACTS (AMENDMENT) REGULATIONS 2009 AND THE PUBLIC PROCUREMENT (MISCELLANEOUS AMENDMENTS) REGULATIONS 2011

3.1.2 Regulation 23 sets out the grounds on which a supplier may be deemed ineligible to tender for, or be awarded a public contract. Rejection is permissible when a supplier, its directors or any other person who has powers of representation, decision or control of the supplier:

1.  has been convicted of any of the following offences:

i  conspiracy;

ii  corruption;

iii  fraud;

iv  money laundering; or

v  any other offence within the meaning of Article 45(1) of the Public Sector Directive as defined by the national law of any relevant State.

2.  is in a state of bankruptcy insolvency compulsory winding up, administration, receivership, composition with creditors or any analogous state, or subject to relevant proceedings;

3.  has been convicted of a criminal offence related to business or professional conduct;

4.  has committed an act of grave misconduct in the course of business;

5.  has not fulfilled obligations relating to payment of social security contributions;

6.  has not fulfilled obligations relating to payment of taxes;

7.  is guilty of serious misrepresentation in supplying information required by the Authorities under the Regulations;

8.  is not in possession of a licence or not a member of the appropriate organisation where the law of that State requires it;

or

9.  subject to paragraphs (7) and (8) of Regulation 23, is not registered on the professional or trade register of the relevant country in which established

3.2 APPENDIX B

3.2.1 Peabody Consultants’ Framework 2014 - Professional Indemnity Insurance Requirements

3.2.2 Some disciplines pose a greater risk to Peabody than others. We therefore require certain consultants invited to join our Framework Agreement to carry at least the minimum level of Professional Indemnity Insurance as set out in the following table:

3.2.3 Please note that Professional Indemnity Insurance will be required on an ‘each and every claim’ basis rather than in ‘aggregate’.

3.2.4 This policy is also set out in the Framework Agreement to which your organisation will be a party if successful.
