POOLE HIGH STREET METHODIST CHURCH, HIGH STREET - DEED OF VARIATION MADE PURSUANT TO S106 AND S106A OF THE TOWN AND COUNTRY PLANNING ACT 1990 OF AN AGREEMENT DATED 19th OCTOBER 2010

PURPOSE

To report to the Planning Committee the written request from the Applicant,Mr Smith on behalf of Poole Methodist Church to amend the wording of the Agreement so the Head office Trustees for Methodist Church sign and enter into the Agreement.

DECISION REQUIRED

To resolveto support the recommendation of the Head of Planning & Regeneration Services to agree the variation of the Section 106 agreement on the basis of the changes set out in this report.

BACKGROUND/INFORMATION

Planning permission was granted inNovember 2010 to erect a two storey multi-functional extension and refurbishment of existing Methodist Church, and change of use within existing Church building from place of worship to Cafe at ground floor with a church above. The approval was subject to a Section 106 agreement.

The agreement secured financial contributions to mitigate the effects of the development namely, £10,603 towards car parking provision and £9,431 towards improvements to transportation infrastructure. The wording of the Section 106 Agreement required payment of the financial contributions upon commencement of the development.

The Agreement was signed by the Trustees of the ‘local branch’ of the Methodist Church.

The Applicant has requested that Agreement be modified so the Head Office of the Trustees of the Methodist Church sign and enter into the undertaking.

No amendments to the contributions or the trigger date will be changed.

FINANCIAL IMPLICATIONS

The Applicant will be responsible for all reasonable costs of producing a Deed of Variation.

CONCLUSIONS

To resolve that the Agreement is amended so that the Head Office of the Trustees of Methodist Church sign the Agreement.
