ITAR[1] Export Compliance Questionnaire

For some equipment used in research at Texas Tech, such as “night vision goggles” or high powered lasers, TTU may need to provide special storage or limit access. These types of items are found on the U.S. Munitions list and may be considered a “defense article.” The following information explains why:

PLEASE READ CAREFULLY

The purpose of this Questionnaire is to identify any lab instruments, software, materials or technical data being used or stored in your department’s laboratory/work space that meet the following definition of a “defense article” under the ITAR regulations (federal regulations that regulate export of military items/data). In this document they will be called “ITAR items.” Please note:

(1)ITAR items may have been procured from a vendor or received from a sponsor or research collaborator to conduct a particular research project; and

(2)ITAR items may or may not have been identified as ITAR upon purchase or receipt; hence it is critical to read the following definition in order to ascertain whether TTU possesses such items:

(3)“Defense articles” are broadly defined to include any item or equipment, related technology, or data that is built, compiled, designed, or modifiedto military specifications. This includes, for example, military-grade electronics, components and instrumentsused during the course of fundamental research. The fact that the item is commercially available does not necessarily mean the item is not a “defense article.”
