Please be aware that you have the opportunity and are encouraged to seek independent legal advice prior to signing this Release, Waiver, Assumption of Risk and Indemnification.

RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNIFICATION

I, ______hereby acknowledge and agree by participating in the University of Toronto MBA Orientation 2005, organized by the University of Toronto MBA Orientation Committee (herein called ‘the Committee’):

1. I may be exposed to situations and environmental conditions which could cause risks and hazards to me;

2. that, as a result of the aforesaid risks and hazards, I, as a participant, may suffer serious personal injury, as well as property loss;

3. that some of the aforesaid risks and hazards are foreseeable but others are not. While the Committee has taken precautions to provide proper supervision, instructions and equipment for activities, circumstances may arise which are beyond the control of the Committee;

4. that I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my participation in the University of Toronto MBA Orientation 2005 shall be entirely at my own risks;

5. I understand that I am, responsible for my own safety and I agree to comply with the instructions and directions of the Committee. Furthermore, I will conduct myself, at all times, with due regard for the safety of myself and others and comply with all instructions and directions of the Committee and its members, agents, employees, volunteers, independent contractors, servants, officers and directors;

6. that, except to the extent that I have previously advised the Committee in writing, I do not have any physical or psychological issues which would impair my ability to participate in or would create any undue risks or harm to myself or others during the University of Toronto MBA Orientation 2005;

7. I understand that neither the University of Toronto MBA Program, the Committee, nor any of its members, officers, directors, employees, sponsors, independent contractors or agents will assume any responsibility whatsoever for my safety during the course of my participation in the University of Toronto MBA Orientation 2005;

8. I agree to fully indemnify the University of Toronto MBA Program, the Committee, their members, officers, directors, employees, sponsors, independent contractors and agents for any loss, injury, or damage caused by me or within my control, during my participation in the University of Toronto MBA Orientation 2005;

9. I understand by signing this RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNIFICATION, I do hereby release the University of Toronto MBA program, the Committee, their members, officers, directors, employees, sponsors, independent contractors and agents from all liability and do hereby waive as against the University of Toronto MBA program, the Committee, their members, officers, directors, employees, sponsors, independent contractors and agents from all recourses, proceedings, claims, and causes of action of any kind whatsoever that may be brought by or on behalf of me, in respect of all personal injuries or property losses which I may suffer arising out of or connected with my participation in the University of Toronto MBA Orientation 2005;

10. that this RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNIFICATION is binding on myself, my heirs, my executors, administrators, personal representatives and assigns;

11. that I have been given the opportunity and have been encouraged to seek independent legal advice prior to signing this RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNIFICATION;

12. I have carefully read and understood this RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNIFICATION, and that I am freely and voluntarily executing same without any duress placed upon me. By signing below, I also confirm that I am executing this document with knowledge that the terms of this document govern and limit my rights and remedies.
