PHOTOGRAPHY CONTRACT

For your photo shoot, we typically shoot in natural light, which means preferably outdoors or well-lit spaces. I prefer to shoot near sunrise or sunset as this provides the best light, but will certainly work around the time of day that suits you.

What To Wear. If you are doing a shoot as a couple or with a group, try not to dress exactly alike. Dress comfortably and coordinate your outfits with similar colors that don’t clash. If you are changing outfits, consider wearing one casual outfit and perhaps one dressy look as well. Stay away from wearing all black or all white and refrain from wearing patterns or blocks. Photo shoots are always nice with bright, vivid colors. Bring out your personality with your outfits as well. Layer, layer, layer!When putting together an outfit, layers are what make the outfit look polished and complete.Add a vest, jacket, cardigan, bowtie, hat, scarf, suspenders, belt, jewelry, etc. This also gives the shoot much more depth!

Makeup.Ladies, if you are able, get your makeup done professionally. Some makeup counters will do your makeup for free or if you purchase at least one product. You will be much more pleased with the final result. You may also want to bring bobby pins or a comb/brush to create a different look with your hair as well. Men and women, be sure to bring something to dab your face and brow with, as well as something to touch up makeup, if needed.

Props.If you want to make your shoot more meaningful and have props that tell a story (signs, instruments, chairs, family heirlooms)…bring those along as well!

Investment

Payment is accepted in the forms of PayPal, CashApp, Square, cash or bank deposit.

Terms and Conditions

Charges.The session fee is based on the standard price list and includes the time and artistic view of the photographer. Payment is accepted in the forms of PayPal, CashApp, Square, cash or bank deposit. A 50% deposit is due before any photography work commences and the remaining balance must be paid by the day before the session.Deposits are non-refundable. All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and the images to be viewed.Additional editing is available at additional expense to be determined by photographer.

File Delivery. Fully edited high resolution digital files selected by the photographer will be delivered via Dropbox. Client will have 7 business days to download the delivered files after which the Dropbox link will expire.

Location Costs & Fees.If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location.

Re-shoots.Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer.

Copyright and Reproductions.The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website or social networks.

Failure to Perform/Cancellations.If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.If an illness or situation on the Client’s behalf prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hournotice, or decide to completely cancel the shoot, the session fees/deposit will not be refunded.

Inherent Qualities.Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes as well as DVD or CD media which may deteriorate due to delamination and oxidation, and client releases photographer from any liability for any claims whatsoever based upon the deterioration due to such inherent qualities.

Indemnification. The Photographer shall be held harmless for any and all injury to client during the course of the photography session and the immediately surrounding events.

This agreement incorporates the entire understanding of the parties. Any modifications of this agreement must be in writing and signed by both parties. Any waiver of a breech or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this agreement.

The parties have read this agreement, agree to all its terms, and acknowledge having read the agreement. Upon payment of deposit for the scheduled session this agreement is considered valid.
