DISCUSSION

The petition was filed on May 28, 2002, and included a request for a stay. The State Water Resources Control Board (State Board) set the stay request for a hearing on July 30, 2002. On July 24, 2002, the State Board received a request from the Petitioner, which was joined by the Central Valley Regional Water Quality Control Board (Regional Board), that the hearing be continued to allow the parties to resolve the issue surrounding the stay through a settlement. On September 16, 2002, the State Board received notice that a settlement was reached, and the Petitioner and Regional Board had stipulated that the State Board issue an order staying certain aspects of the Regional Board’s orders, pending review of the petition on the merits. The attached draft order approves the stipulation.
