1.  This permit is for hookah/e cig/e hookah/lounge area in the I-1 Zone. The occupant’s name is ECO Green Works LLC trading as Vaping Apes. The applicant must submit a signed letter describing in detail how this use proposes to operate. Will this be a smoking lounge? Will tobacco products be sold? Is food and drink proposed to be served? Please note that the Health Department prohibits smoking in a food and drink establishment. If this operates as a smoking lounge with the sale of tobacco products only, the use is a specialty store/sale of tobacco products which is a prohibited use in the I-1 Zone. In addition a floor plan must also be submitted. Once this information is received additional review on the permit. 10/21/13 – Permit application has been revised to warehouse with incidental retail. Warehouse Unit: A "Building" used for the storage of goods and materials in connection with the day-to-day operation of a wholesale or distribution business, or a business that is not located in the same "Building" or on the same property as the "Warehouse Unit.

2.  A floor plan of the area occupied by this use must be submitted showing how the use will operate. The floor plan submitted must demonstrate the dimensions of each section (retail area, upper level storage, lower level storage, etc. in order for me to determine if the retail meets the “PB” incidental requirements. The approved site plan indicates unit 7814 is a total of 1,386 square feet. 11/18/13 – Ok per updated floor plan.

Property is located within the JB Andrews Accident Potential Zone. Once the proposed use has been determined it must be determined if the proposed use is permitted in the Prince George’s County Table of Uses and the JB Andrews Accident Potential Zone Table of Uses. 10/21/13 – warehouse with incidental retail is a permitted use in the JB Andrews Accident Potential Zone.

(21.1) Auditorium: A room or building used for the gathering of people seated as an audience; open to the general public, with or without an admission charge, and used primarily for public speaking, theatrical production; excluding any form of patron dancing or adult entertainment. An auditorium is a permitted use in the I-1 Zone.

(192) Recreational or Entertainment Establishment of a Commercial Nature: An establishment which provides entertainment, recreation, or amusement for profit. This term shall not include an "Amusement Arcade," "Reducing/Exercise Salon or Health Club," or a "Massage Establishment" but shall include any form of a “Rental Hall” or “Dance Hall” or “Banquet Hall” not sanctioned by another special exception or private club. A recreational establishment of a commercial nature is not listed therefore prohibited in the I-1 Zone.

As per your submitted document poetry reading and comedy can be considered an auditorium per the above definition. Electronic games, music and patron dancing appear to be a recreational establishment of a commercial nature and is prohibited in the I-1 Zone. Gatherings for various sororities and fraternities as long as they are operating in conformance with the auditorium definition above this would be permitted also as an auditorium.

Gatherings for various, charity meetings, sororities and fraternities for public speaking.

10/16/13 – Upon further review per the documents submitted, the proposed use is an auditorium. The property is located within the JB Andrews Accident Potential Zone. Although the proposed auditorium is permitted in the Prince George’s County Table of Uses it is a prohibited use in the JB Andrews Accident Potential Zone Table of Uses. Permits shall not be issued for an auditorium at this location.
