CONDITIONS OF PURCHASE

  1. Terms of payment are as indicated on the face of the quotation and a service charge of up to 1 ½ % invoice price per month may be added if payment is not made in accordance with such terms.
  1. Performance by PT&G is contingent upon strikes, accidents, government regulations and requirements, and other delays unavoidable or beyond our control.
  1. Prices are based on the quality,quantity and type of material or equipment specified. Changes in specifications or deliveries will be subject to change in price.
  1. Orders accepted by PT&G cannot be cancelled unless written approval is obtained by PT&G which shall include terms that will indemnify us against all loss.
  1. Customer supplied material. 5A) The customer is responsible for all additional incurred expenses that result from said material that is received at our plant with dimensions or specifications other than those agreed to at the time of original quotations. 5B) the customer is responsible for any delay and/or penalties resulting from delays in regard to the delivery of material.
  1. All items shipped by us must be inspected upon receipt and any claims must be made within 20 days. The failure to notify PT&G in writing within 20 days of receipt of any claim regarding items shall constitute full acceptance thereof. Receipt shall be deemed to occur upon delivery to or pick-up by, customer. No goods may be returned except upon written approval by PT&G. Unless written approval is given, PT&G assumes no responsibility for work done by others or for expenses incurred by others in connection with repair or replacement of work described in this quotation.
  1. PT&G is well known for high quality workmanship and extra care is always taken. However, we are subject to human errors, and unforeseen events. Therefore, we cannot be liable to pay for material replacement or previous machining, if, in the sole discretion of PT&G, a non repairable deviation should occur. No charge will be made on a part that we might scrap.
  1. PT&G builds to customer specifications and drawings. PT&G shall be entitled to rely solely upon such specifications and drawings. Therefore, PT&G shall have no responsibility or liability as to the suitability of the item quoted for its intended end use. The customer shall hold PT&G harmless and indemnify it against all claims of every kind and nature.

9.Set-Off – Lost production - PTG shall not be responsible for lost productionor other costs that may be incurred. PTG shall in no event be liable to buyer for consequential, special, or incidental damages. Further, there shall be no set-off or deduction from payments owed to PT&G for any reason whatsoever.
