Payment
Fees are paid monthly in advance via bank transfer, by the 1st working day of each month. We accept childcare vouchers from all registered voucher providers, see Clause 3.3 for details. Invoices and statements are emailed to be environmentally friendly. Paper copies can be posted for a fee of £2.50 per month.

Inclusive Fees
Fees are inclusive of all food and drinks (including formula milk for children in the Explorers Room), nappies, barrier cream, wipes and sun cream (in the summer months). We often run additionalactivities during the week such as Spanish singing, which are included in your fees. The above fees are valid at 1stSeptember 2016. Fees are typically reviewed every September.

Opening Hours
The Nursery is open 07.30hrs to 18.00hrs Monday to Friday excluding bank holidays. Our Early Starts can be booked on an ad-hoc or regular bases. The Nursery will be closed for the working days between Christmas Day and New Year's Day and all public Bank Holidays.

Government Grants
Some 2 year old children and children aged 3 years and over may benefit from Free Entitlement. It applies to all children from their first full term at Green Roots after their 3rd birthday until they begin primary education. We will administer the grant fully on your behalf. The amount of the grant will depend upon the number of sessions attended per week.

Minimum Booking
We do not enforce a minimum number of sessions per week, however we recommend your child attends Green Roots at least twice a week to ensure their visit to Green Roots becomes a regular routine of their week. In our experience children who only attend once a week can sometimes find it difficult to settle. However, we will be guided by parents as you know your children best!

Registration Fee & Deposit

To apply for a place, a non-refundable fee of £40 is required.An additional refundable deposit is also required of £150 per family. The deposit of £150 will be refunded. (see clause 6.8)

On receipt Green Roots will either offer you the requested sessions or after dialogue with you, offer suitable alternative sessions.

A confirmation email will be sent. If we are unable to offer you the requested sessions or provide a suitable alternative and you do not wish to go on our waiting list, we will return the registration fee and deposit in full.

If you choose to go on the waiting list, we retain your registration and deposit. However you can request to come off the waiting list at any time and have your registration fee and deposit refunded in full.

TermsConditions

BelowarethestandardTermsandConditionsof Green Roots Limited (nursery) detailingthebasisofthe contract(contract)betweenthenurseryandyou,theparentorguardian(parent/guardian)ofthechild detailed(child)in respectoftheprovision ofthenurseryservicesasdetailed(contractedservices).

1. ConfirmationofBooking

1.1 Completionofthisformdoesnot constituteconfirmationofaplace.

Onreceiptofthiscompletedform,registrationfeeand deposit thenurserywill check availability in line with its admissions policy. You will receive an email, subject to availability of sessions, within 7 days of receipt,confirmingacceptanceoftherequestedsessionsoragreedalternatives. Uponthesaidemailbeingsenttoyou(typicallywithacopyofyourtermsand conditions)thiscontractwillcomeintoeffectandthecontractedserviceswillbe confirmed.

2. Calculations of charges

2.1 Full timenurseryfeesarecalculated to reflect the closure of the nursery during publicholidays,theworking daysbetweenChristmasandNewYear,whenthenurseryisclosed,on'insetdays'(seeclause15) and allows the child to be absent for 2 holiday weeks per year.No deductions shall be made to full time nursery fees.

2.2 Nodeductionsshallbemadetoanyfeestotakeaccountofperiodsofabsence,forwhateverreason (includingbutnotlimitedtoillness, holidaysortemporaryexclusionforwhateverreason),byachildfrom thenursery.

2.3 Thenurserymayfromtimetotimeincreaseanyfeesorotherchargesongivingnotlessthan4weeks written noticeofsuchincreases.

2.4 Nodeductionshallbemade fordayswhen thenurseryisunabletoprovidethecontractedservicesorwe cancel suchservices.

Thenurseryacceptsnoliabilityforanycostsorexpensessufferedbya parent/guardianasaresultofany suchunavailabilityorcancellationandyourattentionisdrawntoclauses 6.7and12in thisregard.

2.5 ThenurserywillbeclosedontheworkingdaysbetweenChristmas DayandNewYear'sDayandall PublicBankHolidays.If yourbookingpatternfallsonthesedays,nodeductionsshallbemadetoanyfees orchargespayableunderthiscontracttotakeaccountofthefacttheservicesshallnotbeprovidedon thesedays.You areallowedto"swap"yourcontractedsessionsthatfallonthesedaysforothersessions atno costsubjecttoavailability.Thesesessions mustbeused within12 months and not within your notice period.Ifyouattendfulltime, yourfeeshavealreadybeendiscountedtotaketheseclosuresintoaccount.

2.6 Extracharges,asperthecurrentpricelistwillbemadeforcollectionordropoffofachildbyaparent/ guardianforeach15minuteperiod(or partthereof)outsideof thecontractedserviceshours.

2.7 Early drop off of a child before commencement of the contracted services may be made by prior arrangementwiththenursery.Anextrachargeasperthecurrentpricelistforeachhalfhourorpart thereofshallbemadeforpre-arrangedearlydropoffsupervision.Earlydropoffswhichhavenotbeen agreedinadvancewiththenurseryshallincur theextrachargesassetoutinclause2.6.

3. PaymentofFees

3.1 Feesarepayablemonthlyin advanceby thefirstworkingdayofeachcalendarmonthby bank transferonly.

3.2 Otherfeesorchargespayableinadditiontothemonthlyfeeschargeableshallbepaidbybank transferby thefirstdayof themonth followingthemonthinwhichsuch additionalfeesorchargesarose.

3.3 Partialorfullpaymentoffees paidbychildcarevouchers must be received and cleared by the 1st of each month. Anychildcare vouchersreceivedafterthistimewillnottakeeffecttoreducethe amount payableforthatmonth.

4. Non/LatePaymentofFees

4.1 Thenurseryregardsnon-orlatepaymentoffeesorotherchargesasamaterialbreachofthiscontract.A fixedadministrationchargeof£10ispayableinrespectofany contact made to the parents/guardian inrespectoffeesorotherchargespayableunderthiscontractwhichisnotreceivedbythenurseryasrequiredbyclause3.1. Intheeventofnon-paymentorlatepaymentoffeesinbreachofthiscontractthenurseryshallserve written notice of such non- or late payment requiring payment to be made within 7 days of the date of the noticeontheparent/guardian.Thenurseryreservestherighttomakean administrativechargeof£40for eachsuchnoticeserved.

4.2 Intheeventthatanyfeesorotherchargesarenotpaidwithin7daysofthedateofthenoticeofnon­paymentserved underclause4.1,thenurseryreservestherighttoterminatethecontractwithoutnotice thereafter.

4.3 Notwithstanding clause 4.2,any service of notice to terminate shall constitute formal demand of all outstandingfeesandcharges.

4.4 Uponterminationofthecontract,thenurseryshallhavenofurtherobligationtoprovidethecontracted servicesinaccordancewithclause5.4.

4.5 Thenursery reservestherighttochargeinterestonadailybasisonanyoutstandingfeesoranyother sumsduehereunderfromtheirduedateuntilthedateofpayment.Interestshallbechargedattherateof 3%perannumabovethebaserateoftheYorkshireBankplcfromtimetotime.

4.6 Inadditiontoanysumspayableunderclause4.5orotherwiseunderthiscontract,theparent/guardian agreesandundertakestoindemnifythenurseryforandagainstany andallcosts,fees,charges and expensesthenurserymayincurasaresultoforarisingfromlateornon-paymentofchargespayable underthiscontract,including,butnotlimitedto,fortheavoidanceofdoubt, anyandalllegalandother professionalfeesandexpensesitmayincurasaresultofinstitutinglegalorotherproceedingsagainsta parent/guardianfornonorlatepaymentofchargespropertydueandowingtoitunderthiscontract.

5. TerminationofContract

5.1 Thiscontractcanbe terminatedbyeitherpartygivingtheotherpartynotlessthan4week'swrittennotice oftermination.Save for children in receipt of Government funding, a minimum notice period not less than 4 weeks and must fulfil all funded sessions during the current funded term. Tobevalid,anynoticeof terminationservedbyaparent/guardianmustbeaddressedtotheCentreManager.

5.2 Intheeventofterminationofthecontractwithouttherequisitenoticebyaparent/guardianassetoutin clause 5.1above,theparent/guardianshallimmediatelypaytothenurseryaterminationfeeequalto:afullmonth'sfeesplusanyotherfeesorcharges arisinginrespectofthemonthinwhichthecontractisterminated.

5.3 The nursery will not tolerate any abuse,whether verbal or physical, of itsteam members by parents/guardians.Intheeventofsuchabusethenurseryreservestherighttoterminatethiscontractimmediately withoutnoticeandtoexcludethatparent/guardian'schildinaccordancewithclause7.1(b)

5.4 Uponterminationofthecontractforwhateverreason,whetherbynoticeorotherwise,thenurseryshall havenofurtherobligationtoprovide the contractedservices.

5.5 Once a contract is terminated, a new contract for the same child cannot commence sooner than 10 weeks from the previous contract termination date.

6. VariationsorAmendments

6.1 Variationsoramendmentsmayonlybemadeinrespectofthecontractedservicesbyaparent/guardianif writtennoticeofsuchvariationoramendmentisgiventotheCentreManagerin accordancewithclauses 6.2 to6.5below.

6.2 Parents/guardianswhosechildrenhavecommencedtheirchildcareatthenurseryshallgivenotlessthan 4week'swrittennoticeofanyrequired reductioninthecontractedservices.Wherelessthan4weeks’ noticeisgiven,thenurseryreservestherighttocontinuetochargeinfullforthecontractedservicesup to thedateonwhichthe4weeks’noticewouldhaveexpiredifithadbeengiven.

6.3 Parents/guardianswhosechildrenhave notyetcommencedtheirchildcareatthenurseryshallgivenot lessthan 8week'swrittennoticeofanyrequiredreductioninthecontractedservices.Wherelessthan8 week'snoticeisgiven,the nurseryreservestherighttochargeaone offfeeequaltothedailyrateofthe reducedsessions.

6.4 Ifaparent/guardianwishestodelaythestartdateofthecontractedservices,notlessthan8week'swritten noticeofsuchdelaymustbeservedonthe Centre Manager.Onedelaytothestartdateisallowed,howeverif subsequentdelaysarerequested,in ordertoretaintheacceptedplacetheparent/guardiancaneitherpay 50%ofthecontractedrateforthecontractedservicesfromthecontractedstartdateuptothedatethe childactuallystartsorplacethechildbackonthenurserywaitinglistinwhichcasenofurthercharges shallbepayable.

6.5 Ifaparent/guardianwishestoincreasethecontractedservices,writtennoticeofsuchrequestmustbe servedontheCentreManager.Whilstthenurserywilltrytoaccommodateanysuchrequest,thenursery givesno guaranteethat itshallbeabletodoso,eitherimmediatelyoratall.

6.6 Theparent/guardianshallgivewrittennoticetothenurseryofanydaysonwhichthechildwillnotattend nurseryduetoaplannedholiday.SuchnoticeshouldbegiventotheCentreManagerassoonas practicableandinanyeventnotlessthan2weekspriortothestartoftheholiday.

6.7 Thenurserymay, initsabsolutediscretion,takethedecisiontoclosewithoutpriornotice,duetoadverse weather,orothercircumstancesoutsidethenursery'scontrol.If thenurseryshouldcloseinsuch circumstances,thenurseryshallbeundernoobligationtoprovidethecontractedservicesortoprovide alternativecarefacilitiesforthechildand theparent/guardianwillnot beentitledtoanyrefundoffees.

6.8 Arefundofyour £150 deposit willbereturnedaslongasyouhave notreducedyourpattern eitherpriortostarting orafterstarting without the minimum of 4 weeks’ notice, being given in writing to the Centre Manager.

6.9 Thenurserymayinitsabsolutediscretionchangeanyofitstermsand conditionsupongivingparents/ guardiansnotlessthan4week'swrittennoticeofsame.

7. Exclusion/ WithdrawalofChild

7.1Thenurseryreservesabsolutelytherighttorefuseadmissiontoachildorexcludeachildfromthenursery on apermanentor temporarybasisforthefollowingreasons:

a) wherecareofaparticularorspecialisttypeiseitherrequiredbythechildorrequested bytheparent/ guardianandthenurseryisunabletoprovidesameortheparent/guardianrefusesconsent tothe provisionofsamebythenursery;or

b) thebehaviorofthechildorparent/guardianissuchthatthenursery,initsabsolutediscretion,considers thattheirpresenceatthenurseryortheiractionsaredetrimentaltothehealth,safetyorwell-beingofthechilditself,anyotherchildat thenurseryoranyteammembers.

Sofarasitisreasonablyabletodosointhecircumstances,thenurseryshallcommunicateits reasons for theexclusioninwritingtotheparent/guardianpriortoanysuchexclusionbeingaffected.

7.2 Permanentexclusionofa childunderclause 7.1shallimmediatelyterminate thecontractwhereupon clause5.4shallapply.

8. MedicalConditions

8.1 Eachparent/guardian undertakestoadvisethenurseryimmediatelyin writinguponthembecomingaware thatanyoftheinformationcontainedinthe Child Information Formisincorrectorrequires amendment.Anysuchnoticeshouldbeaddressedtothe'CentreManager'.

8.2The nursery reserves the right to refuse to admit or provide childcare to any child in accordance with the nursery’s policy on medical conditions as notified to parents/guardians from time to time.

8.3 Ifyouhaveticked“Yes"totheSevereMedicalConditionquestion,thenurserywillrequireameetingprior toconfirmingaplacetocompleteariskassessmentandtrainingplantoverifythatweareabletooffer suitablechildcareforyourchild.

9. Illness

9.1 Ifthechildisunwell andcannotattendthenursery theparent/guardianmustinformthenurseryby 9.30 am onthedayonwhichthechildwasduetoattend.

9.2 Thenurseryreservestherightin line withitsillnessandInjuryPolicy(initsabsolutediscretion)torefuseto admitthechildifhe/sheappearstobeunwell.

9.3 Ifthechildbecomesunwellduringtheday,theparent/guardian mustarrangeforthechildtobecollected assoonaspossibleuponnotification fromthenursery.

10. Late collection

10.1 Parents/guardiansundertaketoprovidethenurserywithasmuchadvancenoticeasispossibleinthe circumstancesregardingany latecollectionofachild.Intheeventoflatecollectionthenurseryshall chargeafeeinaccordancewithclause2.6.

10.2 The Uncollected childPolicy(whichisavailable toviewonthe Green Rootswebsite)shallformpartofthis contract.

11. Non-solicitation of team and Babysitting

11.1 Theparent/guardianundertakesthattheyshallnot,duringthiscontractorforaperiodof6months followingterminationofthiscontract,employ,solicitorenticeawayorseektoenticeawayfromthe nursery'semploymentanypersonwhowasemployedbythenurseryatthedateofterminationofthis contractorinthe6monthperiodpriortotheterminationofthiscontract.

11.2 Theparent/guardianagreesthatintheeventthatclause11.1isbreachedbythemtheywillimmediately paythe nursery asumequalto2 month'ssalaryofthe relevantemployee soemployed, solicitedor enticedawaybythem,whichsumthenurseryestimatesitwillcosttoreplace thesaidemployee.

11.3 Thisclause11shallnotapplywheretheemploymentorsolicitationrelatesexclusivelytotheprovisionof babysittingservicesbyapersonemployedbythenurserytotheparent/guardian,wherethebabysitting takesplaceentirelyoutsidethenursery'snormalopeninghours.However,wherea parent/guardiandoes engageapersonemployedbythenurseryonsuchabasistheparent/guardianacknowledgesthatthey dosoentirelyattheirownriskandthatneitherthenurserynoritsinsurersshallhaveanyresponsibilityor liabilitywhatsoeverinthatregard.

12. Limitation of Liability

12.1 The nurseryshallhavenoliabilitywhatsoever toanyparent/guardian orchildinrelationtolossofor damagetothegoodsorproperty ofanyparent/guardianorthegoodsorpropertyofanychildadmittedto thenursery(evenifsuchloss iscausedbythenursery'snegligence).Anypropertybroughtbythechildor theparent/guardianto,orleftbythemat,thenurseryisdonesoentirelyattheirownrisk.Thisincludes useofthecarparkandyourcarandcontents.

12.2 Subjecttoanyotherprovisionsof thiscontract:

a) thenurseryshallnotbeliableforanyspecial,indirectorconsequentialloss(allthreeofwhichterms include,withoutlimitationpureeconomicloss,lossofprofits,lossofgoodwill,depletionofgoodwilland similarloss),costs,damages,chargesorexpensescauseddirectlyorindirectlybyanyfailuretoprovide thecontractedservices(evenifcausedbythenursery'snegligence);

b) thenurseryshallnotbeinbreachofthiscontractorotherwiseliabletotheparent/guardianorchildby reasonofanydelay orfailureofperformanceofthecontractedservicesdue toaneventoutsideits reasonablecontrolincluding(butnotlimitedto)“actsofGod'',adverseweather,fire,lightning,war,flood, actsofterrorism,strikesorotherindustrial action;and

c)theliabilityofthenurseryincontract,tort(includingnegligenceorbreachofstatutoryduty)orotherwise howsoever arising by reasonoforinconnection withthiscontract shall besubject toamaximumof £5,000,000.

12.3 Nothinginthiscontractshallexcludeorlimitthe nursery’sliabilityinrespectofdeathorpersonalinjuryor foranymatterinrespectofwhichitwouldbeunlawfulforthenurserytoexcludeortoattempttoexclude liability for.

13. DataProtectionRegistration

WeareregisteredundertheDataProtectionAct1998.

14. 'InsetDays'

Thenurseryiscommittedtoraisingthestandardsofnurserychildcareandsupportingitsemployeestodo thisby providingthetraininganddevelopmentopportunitiestheyneedtokeeptheirskillsandknowledge up-to-date.Onedayineachcalendaryearknownasan'insetday'shallbesetasidebythenurseryfor this purpose.Atleast3 months writtennoticeofeach'insetday'shallbegivenbythenursery. No deductions shall be made to any fees or charges payable under this contract to take account of the fact the services shall not be provided on such ‘inset days’.
