Parliamentary Salaries and Superannuation (Vehicle Plan) Regulations 1996

1.Objective

The objective of these regulations is to repeal the Parliamentary Salaries and Superannuation (Vehicle) Regulations 1996 and to allow for the provision of vehicles to members of Parliament.

2.Authorising provision

These Regulations are made under section 8 of the Parliamentary Salaries and Superannuation Act1968.

3.Revocation

The Parliamentary Salaries and Superannuation (Vehicle) Regulations 1996[1] are revoked.

4.Provision of Vehicles

(1)A member of Parliament who—

(a)contributes at the rate of $508 per annum by way of deductions from his or her salary will be provided with the use of a four cylinder vehicle of a type listed in the Schedule; or

(b)contributes at the rate of $711 per annum by way of deductions from his or her salary will be provided with the use of a six cylinder vehicle of a type listed in the Schedule.

(2)A vehicle will be provided pursuant to sub-regulation (1) until the member's death, resignation, expiration of term or until the member ceases to make contributions, whichever occurs first.

5.Associated costs

The cost of annual registration, maintenance, running and fuel costs of a vehicle provided pursuant to regulation 4 and the cost of any insurance entered into by the Crown in relation to that vehicle will be met by the Crown.

6.Authorised drivers

A vehicle provided pursuant to regulation 4 may only be driven anywhere in Australia by—

(a)the member of Parliament; or

(b)a person who holds a current driver's licence and is nominated, in writing, by the member of Parliament.

7.Responsibilities

A member of Parliament who is provided with a vehicle pursuant to regulation 4 must—

(a)ensure that the vehicle is serviced and maintained in accordance with the recommendations of the manufacturer as contained in the manufacturer's service manual provided with the vehicle;

(b)ensure that the vehicle is kept in a protected and secure location when not in use.

(c)promptly report any damage to the vehicle to persons designated for that purpose;

(d)comply with the requirements of any insurance policy or policies entered into by the Crown in relation to that vehicle.

1.General Information

The Parliamentary Salaries and Superannuation (Vehicle Plan) Regulations 1996, S.R.No.82/1996 were made on 20 August 1996 by the Governor in Council under section 8 of the Parliamentary Salaries and Superannuation Act 1968, No.7723/1968 and came into operation on 20August 1996.

The Parliamentary Salaries and Superannuation (Vehicle Plan) Regulations 1996 will sunset 10 years after the day of making on 20 August 2006 (see section 5 of the Subordinate Legislation Act 1994).
