PARIPOOL 500 REBATES AND DISCOUNTS ON WAGERS

PariPool 500.01 Definitions.

(a)Rebate means a credit given to a bettor in the form of a voucher, based on the amount the bettor wagers, which can be redeemed for additional wagers only. Rebates do not include promotional items, such as hats, programs, or meals, that are distributed in the course of the licensee’s normal marketing activities.

(b)Discount means that less than the face amount of a wager is accepted when that wager is placed.

PariPool 500.02 Confidentiality.

Documents submitted to the Pari-Mutuel Commission in satisfaction of this rule shall be considered confidential commercial records pursuant to RSA 91-A:5, IV.

PariPool 500.03 Conditions for Rebating.

No licensee of the Pari-Mutuel Commission shall offer or grant a rebate on any wager placed on live or simulcast racing unless all of the following conditions are satisfied:

(a)The licensee receives written authorization of its rebating program from the commission prior to instituting the program. The written program shall include the licensee’s provisions for resolving complaints about the program that may arise.

(b)The licensee’s simulcast contract with the race track that conducts the live race upon which the wager to be rebated is to be placed (the host) does not contain a prohibition against rebating. Such a prohibition will preclude the bettor from receiving any rebate credit on wagers placed on that host’s track, regardless of whether the bettor intends to use the credit to place wagers on other tracks.

(c)The licensee has provided notice to the commission of agreements with host race tracks. The detailed agreements between the licensee and the host tracks shall be made available on demand for review by commission personnel.

(d)All rebates on wagers shall be granted only by vouchers issued for pari-mutuel wagering on races conducted or simulcast by the licensee.

(e)The amount of the rebate does not exceed the maximum set by the commission. Said maximum shall apply to each individual bettor, not to the rebating or discounting program taken as a whole.

(f)The licensee shall comply with all applicable federal, state, and local laws and regulations.

PariPool 500.04 Discounts Prohibited.

No licensee shall accept less than the face value for any wager. Wagers are to be paid for in full with cash, totalizator vouchers paid for with cash, proceeds from winning tickets, or vouchers received in compliance with PariPool 500.03.

PariPool 500.05 Monitoring.

(a)The commission may monitor the rebating programs of its licensees. Any violation of the commission’s rules regarding rebating will subject the licensee to any penalty the commission may lawfully prescribe, including fines, suspension of the rebating program, or revocation of license.

(b)Each licensee shall file a quarterly report with the commission specifying the simulcast agreements that were in effect during the quarter and whether rebates were offered on each signal.
