REPORT OF THE HEAD OF PLANNING DESIGN AND CONTROL SERVICES
OUTLINE PLANNING APPLICATION, LAND AT WOODLANDS AVENUE
1. Purpose of Report
1.1 To consider the planning application for the demolition of 111 Woodlands Avenue and the redevelopment of this and adjoining land by the erection of 14 dwellings (application no. 04/29819/001/P).
2. Recommendation
2.1 That application 04/29819/001/P be granted subject to a ‘section 106’ agreement securing:
(i) A contribution of £29,380.00 (plus administration fee) towards off-site recreation facilities in accordance with Policy L17 of the Poole Local Plan First Alteration (adopted March 2004);
(ii) A contribution of £13,000.00 (plus administration fee) towards local schemes for promoting modes of transport other than the private car in accordance with Policy T13 of the Poole Local Plan First Alteration (adopted March 2004);
(iii) A contribution of £2,000.00 (plus administration fee) towards introducing parking restrictions in Woodlands Avenue in accordance with Policy T13 of the Poole Local Plan First Alteration (adopted March 2004).
Note: If the Section 106 Legal Agreement is not completed speedily, then the application may be refused without further reference to Committee.
And subject to the same conditions as attached to the report considered by this Committee on 18th November 2004 (attached as Appendix 1) plus the additional conditions set out in paragraph 5.2 of this report.
3. Background
3.1 This application was originally reported to this Committee at its meeting on 18th November 2004 when consideration of the application was deferred to allow the members of the Committee to visit the application site and its surroundings.
3.2 The report considered by the Committee on 18th November 2004 is attached as Appendix 1.
3.3 The application was again considered by the Planning Committee at its meeting on 16th December 2004 after the Committee had visited the site. The application was again deferred to seek amendments to the scheme both in respect of its relationship to neighbouring residential properties and to enable the retention of the trees in the southern corner of the site.
4. Amended Plans
4.1 The proposals have been revised to incorporate a chalet bungalow with an integral garage on plot 6 in place of the bungalow with separate garage previously proposed.
4.2 The chalet bungalow on plot 6 has been repositioned 3 metres away from the common boundary with the neighbouring bungalow at no.10 Woodlands Crescent. There will be a kitchen window facing the common boundary however the boundary will be screened from the occupiers of no. 10 Woodlands Crescent by a 1.8 metre high close boarded fence to be secured by condition.
4.3 The 2 storey house on plot 7 has in addition been omitted and a chalet bungalow substituted. The proposed chalet bungalow has a reduced mass, bulk and height relative to the previously proposed house and will not have an overbearing or dominant relationship to neighbouring properties.
4.4 The chalet bungalow on plot 7 has been repositioned 6 metres from a hazel tree and an ash tree in the southern corner of the site, in order to allow their retention. None of this group of trees are covered by a Tree Preservation Order. The revised siting of the buildings on plots 6 & 7 have been agreed by the Arboricultural officer
5. Conclusion
5.1 The amended proposals has satisfactorily addressed the concerns raised by the Planning Committee at its meeting on 16th December 2004 and it is therefore recommended that Planning Permission be granted upon the completion of a Section 106 Agreement as set out above.
5.2 2 additional conditions are recommended to attached to any consent given requiring that: -
(1) Both in the first instance and upon all subsequent occasions, the velux windows on the rear elevation of house type F (plots 3, 4 & 5 on the approved site plan) will be glazed with obscure glass in a form sufficient to prevent external views and shall either be a fixed light or hung in such a way as to prevent the effect of obscure glazing being negated by reason of opening.
Reason –
To protect the amenity and privacy of the adjoining properties and in accordance with Policy H12 of the Poole Local Plan First Alteration (Adopted 2004).
(2) Prior to the commencement of development on this site, protective fencing (in the form at least 2 metre high harass fencing with scaffolding supporting structures) will be erected in alignment of the furthest extent of the canopy of the trees edged green on the approved site plan. No development or construction activity shall be undertaken within the fenced enclosure and the fence shall remain in situ until the development hereby approved is completed, or until such after time as might first be agreed in writing with the Local Planning Authority.
Reason –
To prevent trees on site from being damaged during building works and in accordance with Policies NE27 and NE28 of the Poole Local Plan First Alteration (Adopted 2004).
