COUNCIL MEETING MINUTES

May 9, 1972

Orem City Council met in regular session Tuesday, May 9, 1972 at 7:00 P.M. in the Council Chambers. Present were Councilmen Dixon Larson, Mayor Protem, Chairman; Councilmen Eldon Bailey, LeRoy Walker, Glen Zimmerman and Harley Gillman. Mayor Crawford, absent, excused. Also present were Assistant City manager Ned Briner, Planner Newton Andrus, Treasurer Lamont Royer, Engineer Russell Brown and Recorder Anne Cooper.

Meeting opened with prayer by Ned Briner.

Motion to approve minutes of May 2, 1972, as read and corrected, was made by Glen Zimmerman, seconded by LeRoy Walker, and passed unanimously.

Mayor protem Larson reported that he has received complaints concerning the noise caused by the pump on Well No. 4. The Council referred the problem to the City Engineer to see if he could arrive at a solution. Also, referred the complaint of Bob Peper that his sewer and water lines are too close together, for recommendation.

Miscellaneous letters were read which required no Council action.

Councilman Walker recommended that the City proceed as far as it can to correct the approach to State Street from the East on 400 south before the signal lights are installed.

Motion was made by Glen Zimmerman and seconded by Eldon Bailey to accept right of way and easement on the Novad properties, and passed unanimously.

Motion was made by Glen Zimmerman and seconded by LeRoy Walker to authorize payment of $9,180, to Rollins, Brown and Gunnell for Engineering on the storm sewer, and passed unanimously.

Motion was made by Glen Zimmerman and seconded by LeRoy Walker to pay the Utah County Auditor $1,243.54 for sanitary land fill, and passed unanimously.

Motion was made by Eldon Bailey and seconded by LeRoy Walker to authorize payment for repair of white garbage truck in amount of $5,485.96, and authorize transfer of funds from contingency to cover the cost, and passed unanimously.

Motion was made by LeRoy Walker, and seconded by Eldon Bailey, to pay General American $24,176.25 for contract work on the water tank. Motion passed unanimously.

Motion was made by Glen Zimmerman and seconded by LeRoy Walker to pay Red E Mix $574.19 tomorrow to take advantage of discount, and passed unanimously.

Motion was made by Glen Zimmerman and seconded by LeRoy Walker to set a special meeting Tuesday May 16, at 6:00 P.M. to review budget (luncheon) City Manager to notify Council of location, and passed unanimously. .

The following letter from the planning Commission was read:

May 4, 1972

Dear Mayor Crawford:

The Orem City Planning Commission meeting in regular session May 3, 1972, took the following action on items to be referred to the City Council:

1.  Approve a revision of Section VII of Ordinance 158.

2.  Approved revision of Section V of Ordinance 158.

3.  Approved a revision of Sections 29-3-1-2-B and 29-4-1 of the Orem City Zoning Ordinance.

Motion was also passed at the April 19, 1972, meeting held in special session that the City Council separate Home Occupation Licensing from the Business License procedure and that the City Business License procedure and that the City Business License Ordinance be revised.

4.  Suggested that the City Council set up a committee to review irrigation ditch piping in the City.

The Planning Commission also took action on the City Council's request that a revision to the off-street parking provisions of the Zoning Ordinance be made. In this regard, it was felt that more than just the residential parking provisions needed revision. The action taken was to request staff to prepare a recommendation for the Planning Commission action. This staff paper will be presented at the June 7, 1972, meeting of the Planning Commission.

The First three items recommended to the City Council all require a public hearing prior to adoption. The subject matter of each makes it imperative that action be taken as soon as possible.

After consideration, motion was made by LeRoy Walker and seconded by Eldon Bailey to hold a public hearing May 30, 1972, to consider revision of section VII-7-1 of Ordinance No. 158, sewer connections, and revision of Step 6 of Section V or Ordinance No. 158, and consider revising Home Occupation regulations, as recommended by the Planning Commission. Motion passed unanimously.

Motion was made by LeRoy Walker and seconded by Glen Zimmerman to accept the recommendation of the Planning Commission to revise the Business License Ordinance and authorize the City Manager to have the ordinance prepared, and passed unanimously.

Motion was made by LeRoy Walker, and seconded by Eldon Bailey to accept the recommendation of the Planning Commission to set up a committee and appoint Harley Gillman to act as Chairman or a Committee to work on standards for irrigation ditches in subdivision, with the City Engineer and the Planner to be part of the Committee. Motion passed unanimously.

Newton Andrus reported that sometime ago Orem City's share of the PATS program was established at $1,200 for 1972-1973, but since then the amended program calls for much more than the $1,200. Mr. Andurs recommended that this agreement be corrected on the share that Orem pays, and that the use of a part time student be provided.

City Planner, Newton Andrus, proposed purchasing the Paul Pack property to provide additional acreage for the Sports Complex on 400 West 800 West 400 South areas. Mr. Andrus stated that this park is for ball fields, also, that a decision should be reached as soon, as the deadline for filing application for BOR funds is June 1st.

After discussion motion was made by LeRoy Walker and seconded by Eldon Bailey to authorize the City Planner to apply for the BOR funds for purchase of the Pack property. Motion passed unanimously.

Paul Pack stated he would like to retain two parcels of land. Also Mr. Wellman wants an easement through his property.

The Council advised that this will be discussed again next Tuesday.

The City Manager was directed by the Council to have the Pack property, and others appraised before Tuesday June 16th.

Motion was made by Eldon Bailey and seconded by Glen Zimmerman to accept the recommendation of the Planning Commission, and accept the following Subdivision plats, require appropriate bond, and authorize signing:

Belva Vista Estates, Plat A

Hancock

North view, Plats B, C & D

Meadow Crest, Plats B & C

Cascade Acres, Plat D

Park Subdivision, Plat A

Motion passed unanimously.

City Engineer Brown reported that the 1300 South Storm sewer is in process of planning, but is doubtful the City will get Federal Funds. It will take five weeks to advertise for construction bids. The City has budgeted for one half the costs which will be enough money to proceed, that he is sure the funds will be available in 1972-1973.

Motion was made by LeRoy Walker and seconded by Glen Zimmerman to authorize the City Engineer to advertise for bids for construction of the storm sewer on 1300 South, and passed unanimously.

Motion was made by Glen Zimmerman and seconded by LeRoy Walker to give better information about Special Improvement District No. N to the people in the area involved in layman's language, so they will understand, and passed unanimously.

City Engineer Brown recommended that the City Install fencing to protect valve boxes, etc., also, to install fencing around the water tank. That he has a quote for fencing around the water tank at $712.00 and on the Detomasi property, by the Wellman Subdivision, at $1,524.00.

Motion was made b Glen Zimmerman and seconded by LeRoy Walker to authorize construction of fence by the Wellman Subdivision and at the water tank, and payment thereof, as recommended by the City Engineer, a passed unanimously.

The location for Palisades Drive was discussed briefly.
