AN ORDINANCE ESTABLISHING FEES FOR ISSUING BUILDING PERMITS FOR ELECTRICAL, BUILDING, PLUMBING, MECHANICAL, AND SWIMMING POOL CONSTRUCTION, RE-CONSTRUCTION, OR REPAIR TO A STRUCTURE WITHIN THE TOWN OF INDIAN LAKE; REINSPECTION FEES; MOVING BUILDINGS OR MOBILE HOMES IN OR OUT OR THE TOWN OF INDIAN LAKE; REQUIRING ALL MOVERS TO USE THE INDIAN LAKE POLICE AS ESCORT; PROVIDING A SAVING CLAUSE; VIOLATIONS AND PENALTIES; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE

WHEREAS, the Board of Alderpersons of the Town of Indian lake has determined that it is in the best interest of the citizens of the Town to develop a permit and inspection program to better insure the quality of work performed by the trades in the field of building and repair of structures within the Town; and

WHEREAS, the Board of Alderpersons of the Town of Indian Lake has determined that it is necessary to establish permit fees to cover inspections and administrative costs;

NOW, THEREFORE, BE IT ORDAINED by the Board of Alderpersons of the Town of Indian Lake, Texas;

SECTION I: BUILDING PERMIT APPLICATIONS

(a) A plot plan must be submitted at the time of permit application. The plot plan must show the existing house or mobile home and all additional structures; and must show the size of buildings and distances of set-backs from property lines for existing structures and proposed additions.

(b) No permit shall be issued until a permit application has been filled out completely. The permit application must include a drawing showing the size of the structure to be built and the type of construction materials that will be used. The estimated value of material and labor of said construction must be established before the permit is issued.

(c) No permit shall be issued until the fees prescribed in this section have been paid; nor shall an amendment, change order, or other revision to the original permit be approved until any additional required fees have been paid.

(d) Permits shall be valid for a period of 1 year (12 months) from date of issuance.

BUILDING PERMIT FEES:

1. Building Permit Fee

Cost of a building permit is $35.00 for the first two thousand dollars ($2,000.00) valuation, plus $7.00 for each thousand dollars ($1,000.00) or fraction thereof, of additional valuation. Amendments, change orders, or other revisions to the original permit shall be at $10.00 for each thousand dollars ($1,000.00) or fraction thereof.

2. Reinspection Fee

Permit Fees cover scheduled inspections. In the event of failed inspections, a re-inspection fee of $50.00 will be charged for each re-inspection.

3. Moving Permit Fee

(a)Moving in a mobile home, HUD Code Manufactured Home or building requires one electrical permit and one plumbing permit.

(b)Moving out a mobile home, HUD Code Manufactured Home or building requires one electrical permit and one plumbing permit.

(c) Movers are required to furnish proof of insurance and must coordinate move-ins and move-outs with the Indian Lake Police Chief who will provide a police escort to and from the city limits.

(d) Demolishing of a mobile home, HUD Code Manufactured Home or building requires one electrical permit and one plumbing permit.

4. Plumbing Permit Fee

Cost of issuing a plumbing permit is $25.00, plus $7.00 for each thousand dollars ($1000.00) or fraction thereof, of the plumbing valuation. Amendments, change orders, or other revisions to the original permit shall be at $10.00 for each thousand dollars ($1,000.00) or fraction thereof.

5. Electrical Permit Fees

Cost of issuing an electrical permit is $25.00, plus $7.00 for each thousand dollars ($1,000.00) or fraction thereof, of electrical valuation. Amendments, change orders, or other revisions to the original permit shall be at $10.00 for each thousand dollars ($1,000.00) or fraction thereof.

6. Mechanical Permit Fees

(a) Cost of issuing a mechanical permit is $25.00, plus $7.00 for each thousand dollars or fraction thereof, of mechanical valuation. Amendments, change orders, or other revisions to the original permit shall be at $10.00 for each thousand dollars ($1,000.00) or fraction thereof.

(b) Temporary operation inspection fee shall be twenty-five dollars ($25.00).

(c) Window air conditioners are considered portable units not requiring a mechanical permit.

(d) Electronic air filters, purifiers, ozone systems, dehumidifiers and humidifiers shall be considered part of the heating or air conditioning systems if affixed thereto or therein. Separate units of this type shall be considered portable units not requiring a mechanical permit.

7. Swimming Pool Fees

Cost of issuing a swimming pool permit is $25.00, plus 7.00 for each thousand dollars ($1,000.00) or fraction thereof, of swimming pool valuation.

NOTE: An electrical permit must be part of this application whether or not there is lighting involved in the installation.

SECTION II : VIOLATIONS, PENALTIES, SAVINGS CLAUSE

If any section, paragraph, subdivision, clause, phrase, or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part of provisions thereof, other than the part of provision thereof, other than the part so decided to be invalid or unconstitutional.

Violations and Penalties

A violation of any provision of this Ordinance shall be punishable by a fine not to exceed $250.00 or by a Civil Penalty not to exceed $500.00 per day of violation, following actual notice of the violations and provisions of the ordinance.

SECTION III: REPEAL OF ORDINANCES

Ordinances, 0073, 0073A, 0073B, 0085, 0085A, 0085B, and all other conflicting ordinances or parts of Ordinances are hereby repealed.

SECTION IV: EFFECTIVE DATE

This Ordinance shall be in full force and effect after the passage, approval, adoption and publication of its descriptive caption.
