ORDINANCE NO. __9969__ (New Series)

AN ORDINANCE ADDING SECTION 362.3.5TO THE ADMINISTRATIVE CODE, AND AMENDING SECTIONS 71.204.1, 71.407 AND 71.608 OF THE COUNTYCODE, RELATING TO FEES AND DEPOSITS FOR THE DEPARTMENTS OF PLANNING AND LAND USE, AND PUBLIC WORKS

The Board of Supervisors of the County of San Diego ordains as follows:

Section 1.The Board of Supervisors finds and determines that current County fees, deposits and charges related to private land development activities need to be adjusted to reimburse the County for the full cost of the services provided. This ordinance adds Section 362.3.5 to the Administrative Code and amends Sections 71.204.1, 71.407 and 71.608of the CountyCode to adjust the fees and deposits of the Departments of Planning and Land Use and Public Works in order to achieve these objectives.

Section 2.Section 362.3.5 is hereby added to the Administrative Code to read as follows:

SEC. 362.3.5 MISCELLANEOUS FEES AND DEPOSITS FOR THE DEPARTMENTS OF PLANNING AND LAND USE AND PUBLIC WORKS

Notwithstanding any other provision of the Administrative Code, the following fees and deposits shall be paid:

Section 3.Section 71.204.1 of the CountyCode is hereby amended to read as follows:

SEC. 71.204.1. MOVING PERMIT FEE.

Every person applying for a permit required by this chapter shall at the time of making application for the permit pay an issuance fee. The amount of said fee shall be prescribed by the Board of Supervisors.

Section 4.Section 71.407 of the CountyCode is hereby amended to read as follows:

SEC. 71.407. CONSTRUCTION AND EXCAVATION PERMIT FEE.

Section 5.Section 71.608 of the CountyCode is hereby amended to read as follows:

SEC. 71.608. ENCROACHMENT PERMIT FEE.

Section 6.This Ordinance shall take effect and be in force sixty (60) days after the date of its passage, and before the expiration of fifteen (15) days after its passage, a summary shall be published once with the names of the members voting for and against the same in San Diego Commerce, a newspaper of general circulation published in the County of San Diego.
