AN ORDINANCE AMENDING CHAPTER 26, ARTICLE IV, DIVISION 16 OF THE MUNICIPAL CODE OF THE CITY OF CRESTWOOD, MISSOURI, RELATING TO SELF-STORAGE FACILITIES AND PERMITTED USES IN THE “M-1”, LIGHT INDUSTRIAL AND “PD-M”, PLANNED DEVELOPMENT-INDUSTRIAL ZONING DISTRICTS
WHEREAS, Section 89.030, RSMo. provides that municipalities may designate zoning districts and may regulate and restrict the erection, construction, reconstruction, alteration or use of buildings, structures, or land within those districts; and
WHEREAS, the City of Crestwood (the “City”) has divided the City into zoning districts, including the Light Industrial (“M-1”) and Planned Development – Industrial (“PD-M”) which is composed of those areas of the City whose principal use is and ought to be light manufacturing, warehousing, and other limited industrial uses; and
WHEREAS, City staff recommends that self-storage facilities, which typically require large amounts of land, generate small amounts of economic activity, and have the potential to harm property values, be permitted in the M-1 and PD-M Districts only upon the issuance of a conditional use permit pursuant to the criteria in Section 26-302 of the Municipal Code of the City of Crestwood (the “Code”); and
WHEREAS, City staff submitted the proposed amendment to Chapter 26 of the City’s Code to the Planning, Zoning, and Architectural Review Commission (the “Commission”), and a majority of the Commission recommended that the Board of Aldermen approve the proposed amendment; and
WHEREAS, the Board of Aldermen held a public hearing on , 2017, with notice to the public as required by Section 26-343 of the Code; and
WHEREAS, the Board of Aldermen finds that the proposed amendment to Section 26-401 of the Code would be in the best interest of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CRESTWOOD, MISSOURI, AS FOLLOWS:
SECTION 1:Chapter 26, Article IV, Division 16, Section 26-401 of the Municipal Code of the City of Crestwood, relating to permitted and conditional uses, is hereby amended by the addition of language in red, to read as follows:
