Thecourthasdeterminedthatthedebtorsareentitledtoadischargepursuantto11U.S.C.§1328(b)withoutcompletingalloftherequirementsunderthechapter13plan.Adischargepursuantto§1328(b)isreferredtoasa“hardshipdischarge.”

Thisorderdoesnotcloseordismissthecase.

Creditorscannotcollectdischargeddebts

Thisordermeansthatnoonemaymakeanyattempttocollectadischargeddebtfromthedebtorspersonally.Forexample,creditorscannotsue,garnishwages,assertadeficiency,orotherwisetrytocollectfromthedebtorspersonallyondischargeddebts.Creditorscannotcontactthedebtorsbymail,phone,orotherwiseinanyattempttocollectthedebtpersonally.Creditorswhoviolatethisordercanberequiredtopaydebtorsdamagesandattorney’sfees.

However,acreditorwithalienmayenforceaclaimagainstthedebtors’propertysubjecttothatlienunlessthelienwasavoidedoreliminated.Forexample,acreditormayhavetherighttoforecloseahomemortgageorrepossessanautomobile.

Thisorderdoesnotpreventdebtorsfrompayinganydebtvoluntarily.11U.S.C.§524(f).

Mostdebtsaredischarged

Mostdebtsarecoveredbythedischarge,butnot all.Generally,adischargeremovesthedebtors’personalliabilityfordebtsprovidedforbythechapter13plan.

Inacaseinvolvingcommunityproperty:Specialrulesprotectcertaincommunitypropertyownedbythedebtor’sspouse,evenifthatspousedidnotfileabankruptcycase.

Somedebtsarenotdischarged

Examplesofdebtsthatarenotdischargedare:debtsthataredomesticsupportobligations;debtsformoststudentloans;debtsformosttaxes;

debtsthatthebankruptcycourthasdecidedorwilldecidearenotdischargedinthisbankruptcycase;

debtsformostfines,penalties,forfeitures,orcriminalrestitutionobligations;

somedebtswhichthedebtorsdidnotproperlylist;

debtsforcertaintypesofloansowedtopension,profitsharing,stockbonus,orretirementplans;

debtsprovidedforunder11U.S.C.§1322(b)(5)andonwhichthelastpaymentorothertransferisdueafterthedateonwhichthefinalpaymentundertheplanwasdue;

debtsforcertainconsumerpurchasesmadeafterthebankruptcycasewasfiledifobtainingthetrustee’spriorapprovalofincurringthedebtwaspracticablebutwasnotobtained;and

debtsfordeathorpersonalinjurycausedbyoperatingavehiclewhileintoxicated.

Inaddition,thisdischargedoesnotstopcreditorsfromcollectingfromanyoneelsewhoisalsoliableonthedebt,suchasaninsurancecompanyorapersonwhocosignedorguaranteedaloan.
