1. Parties to the Contract:

The private International Kindergarten which is managed by OÜ International Kindergarten (reg. No. 10878962), which is represented by a member of the Management Board, Eve Aus, on the one side and a Parent ...... , on the other side agreed the following:

2. Subject of the Contract

The Subject of the Contract comprises the rights and duties of the International Kindergarten and the Parent during the academic year, including the payment of tuition fees, which are based on the Pre-school Child Care Institutions Act and other legislation governing the operation of pre-school child care institutions, as well as the Statutes, Curriculum and Internal Rules of the International Kindergarten.

3. Entry into force, validity and the time and place of performance of the Contract

3.1. The Contract shall enter into force on the day of its signature and expire at the end of the academic year.

3.2. An academic year starts on September 1 of one year and ends on August 31 of the following year.

3.3. The Contract is extended with the agreement between the Parties at the beginning of the forthcoming academic year.

3.4. Educational activities shall be carried out in the premises of the International Kindergarten in Tallinn, Väike-Ameerika Street 39.

4. Right of the Parties

4.1. The Parent has the right to:

4.1.1. take the child to the Kindergarten and take him/her away at the time suitable for the parent, taking into account the daily routine of the Kindergarten;

4.1.3. get acquainted with the curriculum and the daily routine of the Kindergarten;

4.1.3. receive information about the child’s development and events taking place in the Kindergarten;

4.1.4. change, during the academic year and with the agreement of the Kindergarten, the schedule of the child’s stay in the Kindergarten which shall effect the amount of the tuition fee.

4.2. The Kindergarten has the right to:

4.2.1. require that the Parent follows the daily routine and the Internal Rules of the Kindergarten;

4.2.2. require that the Parent pays the tuition fee for the current month according to the agreed amount;

4.2.3. require from the Parent the maximum use of the child’s place in the Kindergarten or, in case of a planned absence of the child, the payment of 2/3 of the agreed tuition fee;

4.2.4. exclude the child from the list of the Kindergarten if the Parent does not perform the terms of the Contract.

5. Duties of the Parties:

5.1. The Parent undertakes to:

5.1.1. take his/her child to the Kindergarten starting from ...... ;

5.1.2. inform immediately the Kindergarten about any special needs the child may have;

5.1.3. follow the daily routine of the Kindergarten;

5.1.4. not to bring a sick child to the Kindergarten and inform the Kindergarten immediately about any continuous disease in order to prevent the spreading of the disease;

5.1.5. inform the teacher about the absence of the child and events related to the everyday life of the child which may substantially affect the behaviour and spirits of the child;

5.1.6. take the child personally to the Kindergarten and also pick him/her up personally from the Kindergarten; if some other person is taking the child to the Kindergarten or picking him/her up the Parent must inform the Kindergarten about this in advance;

5.1.7. pay the tuition fee at the latest by the 20th day of each month; if the payment of the tuition fee is delayed the Kindergarten has the right to claim a penalty fee of 0.2% of the unpaid amount per day;

5.1.8. pay, upon the acceptance of his/her child by the International Kindergarten, the tuition fee of the current month plus the deposit which amounts to the amount of the monthly tuition fee. The deposit shall cover the costs of the child’s last month of stay in the Kindergarten if the Parent informs the head of the Kindergarten about the child’s departure one month ahead. If the Parent does not inform the head of the Kindergarten one month in advance about the departure of the child from the Kindergarten the deposit shall remain with the Kindergarten.

5.2. The Kindergarten undertakes to:

5.2.1. create a healthy, child-friendly and secure environment for growing and learning taking into account the child’s age, sex and individual features;

5.2.2. take into account the child’s special needs;

5.2.3. inform the Parent if the child gets ill while being in the Kindergarten;

5.2.4. inform the Parent about any changes in the child’s spirit or behaviour;

5.2.5. provide the Parent once a year with an overview of the general development of the child.

6. The amount of the tuition fee and the payment procedures

6.1.The amount of the tuition fee depends on the agreement between the Parent and the Kindergarten and is related to the estimated number of days per week and the length of day the child is going to spend in the Kindergarten.

6.2. The amount of the tuition fee and the payment procedure shall be established for the current academic year and shall not be changed during the period of the academic year, unless the schedule of the child’s stay in the Kindergarten is changed on the basis of an agreement between the Parties.

6.3. No other expenses related to the child’s stay in the Kindergarten shall be added to the tuition fee;

6.4. The tuition fee shall not be charged for any one month during the academic year at the request of the Parent if the child does not stay in the Kindergarten and due notice is given;

6.5. The tuition fee shall be paid on the basis of invoices issued by the Kindergarten;

7. Termination of the Contract:

7.1. The Contract shall terminate at the expiry of the term of the Contract.

7.2. The Contract can be terminated on the basis of an agreement between the Parties.

7.3. The Contract can be terminated unilaterally if the other Party does not comply with the terms of the Contract. The other party shall be informed about such termination at least one month in advance.

7.4. The liability related to the Contract shall become invalid in the case of Force Major not dependent on the Parties.

7.5. Differences, disputes and claims proceeding from the implementation or interpretation of this Contract shall be resolved by amicable agreement between the Parties. If such agreement cannot be concluded the dispute shall be resolve in the court.

8. Final provision:

This Contract has been concluded in two equally valid copies of which each Party has one copy. The Contract shall be registered in the Contracts Registry of the International Kindergarten.
