DECISION

On task assignment in addressing obstacles and recommendations of individuals, organizations and enterprises on administrative procedures

THE PRIME MINISTER

Pursuant to the Law on the organization of the Government dated December 12th 2001;

Pursuant to Resolution No. 38/CP dated May 04th 1994 of the Government on reforming administrative procedures in addressing requests of citizens and organizations;

Pursuant to Decree No. 18/2003/NĐ-CP dated February 20th 2003 of the Government stipulating functions, tasks and organizational structure of the Office of the Government;

On the basis of the implementation of Decision No. 23/2005/QĐ-TTg dated January 26th 2005 of the Government on setting up the interdisciplinary working group to address obstacles and recommendations of enterprises on administrative measures;

At the proposal of Minister, Chairman of the Office of the Government,

DECIDES:

Article 1. To assign the Office of the Government to assist the Prime Minister in receiving and addressing obstacles, recommendations of individuals, organizations and enterprises on administrative procedures.

Article 2. Tasks and authorities of the Office of the Government in receiving and addressing obstacles, recommendations of individuals, organizations and enterprises on administrative procedures are as follows:

1. To receive and address obstacles, recommendations of individuals, organizations and enterprises on administrative procedures that are under the mandate of consideration and treatment of the Government and the Prime Minister.

2. To request and and urge Ministries, Ministry-equivalent agencies, Government-affiliated agencies and People’s Committees of centrally-affiliated provinces, cities to treat recommendations and obstacles of individuals, organizations and enterprises on administrative procedures in a timely and clear-cut manner and in conformity with their mandate.

3. To identify and request competent state agencies to radically abolish administrative procedures that are arbitrarily issued by management agencies, cadres, civil servants at all levels and that cause difficulties for individuals, organizations and that hinder business operation and production of enterprises from all economic sectors.

4. To take the initiative to work with Ministries, Ministry-equivalent agencies, Government-affiliated agencies, People’s Committees at all levels; individuals, organizations, enterprises and associations of enterprises in considering and treating matters relevant to administrative procedures.

5. To arrange study and research into obstacles, recommendations of individuals, organizations and enterprises on administrative procedures in order to recommend to the Government, the Prime Minister, Ministry-equivalent agencies, Government-affiliated agencies, People’s Committees of centrally-affiliated provinces, cities to, in accordance with their mandate, consider, revise and abolish administrative procedures that are no longer applicable and hinder business operation and production of enterprises and the people.

6. To synthesize and report on a monthly basis to the Prime Minsister the status and results of treating obstacles, recommendations of individuals, organizations and enterprises on administrative procedures of the Office of the Government, Ministries, Ministry-equivalent agencies, Government-affiliated agencies, People’s Committees of centrally-affiliated provinces, cities.

Article 3. Responsibilities of Ministers, Heads of Ministry-equivalent agencies, Government-affiliated agencies, Chairmen of People’s Committees of centrally-affiliated provinces, cities in receiving, treating obstacles, recommendations of individuals, organizations and enterprises on administrative procedures:

1. To directly guide the receipt and radical treatment of obstacles, recommendations of individuals, organizations and enterprises on administrative procedures in accordance with their mandate and assigned field of responsibility.

2. To opportunely and radically treat obstacles, recommendations of individuals, organizations and enterprises on administrative procedures.

3. To strictly punish cadres, civil servants under their management who cause harassment, difficulties and delay for individuals, organizations and enterprises in getting through administrative procedures.

4. To arrange the study and research into obstacles, recommendations of individuals, organizations and enterprises on administrative procedures in order to consider, revise and abolish administrative procedures in accordance with their mandate or recommend to the Government, the Prime Minister to consider, revise and abolish administrative procedures that are no longer applicable and hinder business operation and production of enterprises and the people.

5. To periodically report to the Prime Minister the status and results of treating obstacles, recommendations of individuals, organizations and enterprises on administrative procedures before the twentieth of the last month of every quarter.

Article 4. This decision takes effects 15 days after its publication on the Gazette.

Ministers, Heads of Ministry-equivalent agencies, Government-affiliated agencies, Chairmen of People’s Committees of centrally-affiliated provinces, cities undertake the responsibility to implement this Decision.

The Office of the Government is to assist the Prime Minister in urging and checking the implementation of this Decision./.
