Sealed Tenders are invited from producers for production of T.V. programme for duration of 25-30 minutes approximately for Delhi Police. The concept of the programme is to create awareness in general public regarding Police working, creating bond of trust between Delhi Police and public, projecting various programmes, policies, achievements, benefits of proactive policing, difficulties faced by the Police in discharging their duties in maintaining law & order, traffic management etc. It is proposed to telecast programme on Doordarshan on weekly basis. The interested firms can either download tender form from Delhi Police website & Govt. of NCT of Delhi website or collect from PRO Branch, 7th Floor, PHQ, MSO Building, I.P. Estate, New Delhi-110002 in person from 24.3.2008 to 1.5.2008 at any working day from 10.00 AM to 6.00 PM. A pre-bid meeting for query/clarification, suggestion will be held on 21.4.2008 at 3.00 P.M. at PHQ. The last date for submission of the tender is 2.5.08 by 11.00 AM. The tender will be opened on 2.5.2008 at 11.30 AM at Conference Hall, 3rd Floor, PHQ, MSO Building, I.P. Estate, New Delhi-110002.

TENDER TERMS & CONDITIONS FOR AWARD OF CONTRACT

FOR THE PRODUCTION OF T.V. PROGRAMME FOR DELHI POLICE

Sealed tenders in two bid system are invited by the Delhi Police from the producers for production of T.V. programme for Delhi Police for a period of one year from the date of signing the agreement, through registered post or these can be put personally in the sealed tender box kept in the Library Hall, 7th floor, PHQ, MSO Building, I.P. Estate, New Delhi-110002 on the following terms and conditions:-

  1. Scope of work:-

1.1 Main object of the programme is to create awareness in general public regarding police working creating bond of trust between Delhi Police and public projecting various programmes, policies, achievements, benefits of proactive policing, difficulties faced by the police in discharging their duties in maintaining law & order, traffic management etc.

1.2The duration of the programme will be approximately 25-30 minutes and telecast will be generally on weekly basis for one year from the date of signing of the contract. Total episodes in a year will be approximately 52 in numbers. The telecast fee will be borne by the Delhi Police as per actuals.

1.3The firm will be responsible to get the allotment of time slot on Doordarshan for telecasting the programme.

1.4 The firm will be responsible to take prior approval of Delhi Police before submission of programme for telecast.

1.5The work of videography of events/incidents, script writing, re-construction, interviews etc. will be sole responsibility of the firm. However, Public Relation Officer of Delhi Police will coordinate with the firm.

1.6In addition to this programme the firm can be asked to make any other special programme on the approved rates.

2.Eligibility Criteria:-

2.1 Only producers who have adequate qualifications, experience and capabilities to produce both audio and video productions/programmes will be eligible to apply for the same.

2.2The firm should submit bio-data of the key persons of its creative team. The firm will also submit documentary proof of ownership/retainership of production facilities and infrastructure of the firm.

3. TERMS & CONDITIONS

3.1Separate envelope should be used for TECHNICAL BID as well as for PRICE BID. The word " TECHNICAL BID/PRICE BID FOR THE AWARD OF WORK FOR PRODUCTION OF T.V. PROGRAMME FOR DELHI POLICE DUE TO OPEN ON 2.5.2008 at 11.30 A.M. should be prominently marked on the face of envelope containing tender in the name of PRO, Delhi Police.

3.2A pre-bid meeting with PRO Delhi Police will be held on 21.4.2008 at 3.00 PM in at PHQ, MSO Building, I.P. Estate, New Delhi with the interested firms for making any query/clarification or giving suggestion on the subject.

3.3The tender should reach this office by 11.00 AM on 2.5.2008.

3.4 No tender will be accepted by hand and tenders received late will not be entertained.

3.5 The TECHNICAL BID will be opened first on 2.5.2008 at 11.30 AM in Conference Hall, 3rd floor, PHQ, MSO Building, I.P. Estate, New Delhi.

3.6 The tendering firm will have to submit application fee @ Rs.200/- (non refundable) in the shape of Demand Draft in favour of Deputy Commissioner of Police, Hdqrs., Delhi attached with the technical bid. In case the firm fails to attach the draft of application fee, the tender shall be rejected.

3.7 The tendering firm will have to submit earnest money of Rs. 2,60,000/- (Rupees two lack, sixty thousand only) in the shape of A/C payee Demand Draft, FDR, Bank Guarantee, Bankers Cheque from a Commercial Bank in acceptable form, in favour of Deputy Commissioner of Police, Hdqrs., Delhi payable at Delhi safeguarding purchasers interest in all respects. The Earnest Money shall be valid for a period of 45 days beyond the final bid validity period. In the absence of Earnest Money, the tender shall be rejected. Earnest money shall be refunded to the unsuccessful tenders after finalization of tender and award of work to the successful tenderer (s). EMD deposited shall bear no interest.

3.8The firms registered with DGS&D/NSIC for this purpose are exempted from EMD deposits. A copy of registration certificate valid for this purpose shall have to be submitted with the technical bid.

3.9 Successful tenderer (s) shall have to deposit security money @ 5% of value of contract in the form of A/C payee Demand Draft, FDR or Bank Guarantee, in favour of Deputy Commissioner of Police, Hdqrs., Delhi. The security deposits shall be submitted within 15 days from the date of receipt of offer letter to the successful bidder, failing which the Earnest Money Deposit will be forfeited. Security Deposits shall also bear no interest. The Security deposits shall be released only after the expiry of the contract. The security deposits should be valid for 60 days beyond the completion of all contractual obligations by the contractor.

3.10 The firm should be registered with Service Tax Department and shall attach a copy of service tax registration bearing Service Tax No. Latest Service Tax clearance certificate may also be attached.

3.11A copy of tender documents terms & conditions duly signed & stamped (each page) by the bidder(s) along with tender format be attached with the technical bid.

3.12 All the firms participating in the Tender must submit a list of their owners/partners etc. alongwith their contact telephone Nos. and a certificate to the effect that the firm is not blacklisted by any Govt. Department nor any criminal case is registered against the firm or its owner or partners anywhere in India. Any firm blacklisted by any Govt. Deptt. shall not be considered for this tender.

3.13No Enquiry shall be made by the tenderer(s) during the course of examination of the tender, after the opening till final decision conveyed to the successful bidder(s).

3.14 Incomplete or conditional tenders will not be accepted.

3.15Bidders shall not be permitted to alter or modify their bid after expiry of the deadline for receipt of bids.

3.16 The tenderers themselves or their authorized representatives can remain present at the time of opening of tender.

3.17The participating firms can be asked to give presentation as per requirement.

3.18 The firm can be asked to get its studio/infrastructure inspected.

3.19 The PRICE BID will be opened only after scrutiny of Technical Bid. The Price Bids of those firms will be opened who qualify in the Technical Bid, assessment of suitability/capability. The Delhi Police reserves the right to accept or reject the tender on the basis performance/quality and eligibility criteria.

3.20Tenderer(s) must quote the net price both in words as well as in figures only in Indian currency per episode/progamme. Any over writing/ cutting etc. will render the tender invalid.

3.21 Percentage (%) of taxes, if any, to be claimed shall be indicated in the quotation, otherwise it will be presumed that rates are inclusive of all taxes and no plea would be accepted in this regard after opening of tender.

3.22In case the quoted rates are higher to the DAVP rates, the firm should specify in the price bid as to whether the firm would agree to work on DAVP rates.

3.23The first episode of the programme should be ready and telecast within one month from the date of signing contract.

3.24The programme/work will be put on testing for the first three months and the contract can be terminated if not found upto the desired standards.

3.25The copy rights of the programme will be with the Delhi Police.

3.26The firm will be responsible to get each episode approved from the competent authority before telecasting the programme. If any unwanted clipping/object/language is telecast, which is objectionable under the rule of law, the firm will be liable to face all the administrative/legal/judicial charges. The firm will be liable to indemnify the loss if any occurred on this account.

3.27In case of violation of any clause of the Terms and Conditions, the explanation of the firm can be called by issuing Show Cause Notice.

3.28Non compliance of any clause of the tender will render the tender to be rejected.

3.29 The contract will be awarded for one year. However, contract can be extended for more time with the consent of both parties with the approval of competent authority.

3.30The Department will have rights to terminate the contract at any stage without assigning any reason.

3.31 No advance payment shall be made, on any ground. The payment will be made only after receipt of bills in accordance with the approved rates fulfilling all the terms & conditions of the contract.

3.32 In case the successful tenderer (s) found in-breach of any condition(s) at any stage during the contract, legal action as per rules/laws shall be initiated against the agency concerned. In that case Security deposits can be forfeited and outstanding payments can be held-up, besides debarring/Black listing the agency concerned for at least 5 years, for further dealing in this Department.

3.33 In case of any difference, the firm can be called for negotiation to patch up the differences amicably on table before approaching Court.

3.34 All disputes in this connection shall be settled in N.C.T. of Delhi jurisdiction only.

3.35 Delhi Police reserves the right to keep a panel of qualified tenderer (s).

3.36Force Majeur clause, as per standard of DGS&D shall be applicable.

3.37 Delhi Police also reserves the right to relax any of the above-mentioned condition(s) and reject on its discretion any or all-tenders altogether without assigning any reason.

3.38 All procedure laid down in GFR and DFPR shall be adhered-to strictly by the undersigned and the subordinates and tenderers are bound to respect the same.

3.39 Successful bidder (s), if shows inability/incapability to complete the contract after acceptance of the tender, besides legal action, as enumerated above, difference of higher cost, if the contract is awarded to other tenderer (s)/any agency, would be recovered from the earnest money/security deposits/out standing dues of the contractual firm (s).

4.Terms of production: The prices quoted are inclusive of all charges excluding telecast fees.

5.We agree to work on DAVP rates also, if so desired by Delhi Police (if quoted rates are higher to DAVP rates)

6.We enclose herewith the complete Commercial Bid as required by you.

7.We agree to abide by our rate offer till contract period is completed in all respects and that we shall remain bound by a communication of acceptance within that time.
