Offenses Carrying Mandatory License Suspensions:

No Loss of License:

·  1st offense DUI under 3802(a)(1) is no loss of license when no accident or refusal is involved under 3804(e)(2)(iii)

·  DUI-ARD acceptance for BAC under .10%, no bodily injury or property damage, and Defendant is not a minor

15 day suspensions:

·  3361 – Driving Vehicle at Safe Speed (active work zone)

·  3362 – Maximum Speed Limits (11mph or more over posted speed limit in an active work zone)

30 day suspensions:

·  DUI-ARD acceptance where BAC .10% or greater but less than .16% where no bodily injury or property damage occurred

60 day suspensions:

·  DUI-ARD acceptance where BAC .16% or greater, BAC unknown (dropped at prelim), drugs, refusal, or bodily injury or property damage to another

3 month suspensions:

·  1371 – Operation Following Suspension of Registration

·  3718 – Minor Prohibited from Operating a MV with any Alcohol in System

·  3714(c) – Careless Driving: Serious Bodily Injury

·  DUI: Minor ARD acceptance

·  3362 – Maximum Speed Limits (26mph or more over posted speed limit while under 18yoa – 1st offense)

·  6308 – Purchase, Consumption, Possession or Transportation of Liquor (1st offense)

·  6307 – Misrepresentation of Age to Secure Liquor or Malt/Brewed Beverages (1st offense)

·  6310.3 – Carrying a False Identification Card (1st offense)

4 month suspensions:

·  3362 – Maximum Speed Limits (26mph or more over posted speed limit while under 18yoa – 2nd offense)

6 month suspensions:

·  3367 – Racing on Highways

·  3714(b) – Careless Driving: Resulting in Death

·  3734 – Driving Without Lights to Avoid Identification or Arrest

·  3736 – Reckless Driving

·  3743 – Accidents Involving Damage to Attended Vehicle or Property

·  1501(a) – Drivers Required to be Licensed (sub. offense w/in 5 years)

·  2706(a) – Terroristic Threats: School Property (1st offense – 21yoa or younger)

·  780-113(a)(16) – Possession of a Controlled Substance (1st offense)

·  780-113(a)(30) – Manufacture/PWID/Delivery of a Controlled Substance (1st offense)

1 year suspensions:

·  Any felony offense involving a vehicle within the commission of the crime; ie. Burglary

·  3733 – Flee/Elude Police or Other Law Enforcement

·  3735.1 – Aggravated Assault by Vehicle While DUI

·  3742 – Accidents Involving Death or Personal Injury

·  3742.1 – Accidents Involving Death or Personal Injury Not Properly Licensed

·  7111 – Dealing in Titles and Plates for Stolen Vehicles

·  7121 – False Application for Certificate of Title or Registration

·  7122 – Altered/Forged/Counterfeit Documents & Plates

·  1543(a) – Driving While Operating Privilege Suspended/Recalled/Cancelled

·  6308 – Purchase, Consumption, Possession or Transportation of Liquor (2nd offense)

·  6307 – Misrepresentation of Age to Secure Liquor or Malt/Brewed Beverages (2nd offense)

·  6310.3 – Carrying a False Identification Card (2nd offense)

·  2706(a) – Terroristic Threats: School Property (2nd offense – 21yoa or younger)

·  780-113(a)(16) – Possession of a Controlled Substance (2nd offense)

·  780-113(a)(30) – Manufacture/PWID/Delivery of a Controlled Substance (2nd offense)

·  Refusal of chemical testing upon receipt of DL-26 by PennDOT

·  First and 2nd offense DUI’s under General Impairment and High [3802(a)(2) or 3802(b)]

·  First offense DUI under Highest Rate [3802(c)]

·  2nd and subsequent offense DUI’s under General Impairment [3802(a)(1) or 3802(a)(2)]

18 month suspension:

·  Refusal of chemical testing upon receipt of DL-26 by PennDOT if the defendant had previously been suspended for a refusal under 3802 or former 3731

·  2nd and subsequent offense DUI’s under Highest Rate

·  3rd and subsequent offense DUI’s under High Rate

2 year suspensions:

·  1543(a) – Driving While Operating Privilege Revoked

·  6308 – Purchase, Consumption, Possession or Transportation of Liquor (3rd offense)

·  6307 – Misrepresentation of Age to Secure Liquor or Malt/Brewed Beverages (3rd offense)

·  6310.3 – Carrying a False Identification Card (3rd offense)

·  2706(a) – Terroristic Threats: School Property (3rd offense – 21yoa or younger)

·  780-113(a)(16) – Possession of a Controlled Substance (3rd offense)

·  780-113(a)(30) – Manufacture/PWID/Delivery of a Controlled Substance (3rd offense)

3 year suspensions:

·  3732 – Homicide by Vehicle
