POLICY TITLE: STATUTORY ANDOTHER PAID HOLIDAYS

POLICY STATEMENT

The Home and Community Support Services of Grey-Bruce employees are entitled to receive time off with pay for specific holidays and will be paid 1.5 times their regular rate for hours worked during statutory holidays. Employees will only work during statutory holidays if they are prescheduled to deliver necessary front-line services which cannot be rescheduled to another day. Tasks such as program planning, scheduling and office administrative tasks will not be carried out on a statutory holiday without written permission from the employee's supervisor. A statutory holiday begins at 12 AM and ends at 12 PM regardless of what time someone’s shift begins or ends.

PURPOSE

The purposes of this policy are to identify entitlement to statutory holidays under the Ontario Employment Standards Act, and to establish entitlement to additional paid holidays.

ELIGIBILITY

  1. All HCSSGB employees are covered by this policy.
  2. Individuals working for HCSSGB employment contract basis and for a specified period of time should refer to the terms of their particular contract.

DEFINITION

The Home and Community Support Services of Grey-Bruce considers the following days "paid holidays" (* denotes a statutory holiday under the Employment Standards Act):

* New Year's Day;

* Family Day;

* Good Friday;

Easter Monday;

* Victoria Day;

* Canada Day;

Civic Holiday;

* Labour Day;

* Thanksgiving Day;

* Christmas Day;

* Boxing Day

ENTITLEMENT

Permanent Full-Time & Part-TimeEmployees

Permanent full-time and part-time salaried and hourly employees are entitled to all

paid holidays as defined by the eligibility criteria in the Employment Standard Act as well as those additional paid holidays listed in this policy. All employees must:

a) be employed on the date upon which the paid holiday occurs; and

b)works their scheduled work day/shift before and following the paid holiday, unless authorized to be absent.

c)have earned wages during the four workweeks before the holiday

d)Employees will not work on a paid holiday unless specifically authorized as per the policy statement above.

Compensation

  1. Eligible employees required to work on a statutory holiday are entitled to pay at one and one - half times the regular rate of pay for all hours workedduring the statutory holiday as well as their regular holiday pay for that holiday.
  2. Eligible employees required to work on paid holidays which are not statutory holidays, will be paid at their regular rate of pay for all hours worked on the paid holiday. They will also be entitled to holiday pay based upon the number of hours worked during the previous four weeks, or paid time off on an hour for hour basis for any hours worked during the paid holiday.
  3. Employees who are regularly scheduled to work 35 hours a week will be compensated for 7 hours for each designated holiday. Employees must adjust their work schedule within that pay period if 7 hours holiday pay increases their regularly scheduled overall hours (if a full-time staff is paid 7 hours of holiday pay on a day that they are scheduled to work 5 hours, they must adjust their schedule within the pay period to not exceed 70 hours).
  4. Employees who are not regularly scheduled 35 hours a week will have their holiday pay calculated according to The Employee Standards Act.

COMPENSATION WHILE ON APPROVED ABSENCE

  1. An employee on vacation either immediately before or immediately after the holiday is entitled to the day off with pay. The day should be recorded as a paid holiday, not a vacation day.
  2. An employee on a paid leave of absence either immediately before or immediately after the holiday is entitled to 100 per cent of regular pay for the paid holiday. The day should be recorded as a statutory holiday, not a leave of absence day.
  3. An employee on an incidental illness day either immediately before or immediately after the holiday is entitled to 100 per cent of regular pay for the paid holiday. The day should be recorded as a statutory holiday, not an incidental illness day.
  4. Short-term disability benefits are paid by the Agency's insurance carrier. The Agency does not provide additional pay for the holiday.
  5. Long-term disability benefits are paid by the Agency's insurance carrier. The Agency does not provide additional pay for the holiday.

REPORTING AND RECORDING

Supervisors, in conjunction with the Business Manager are responsible for ensuring that all paid holidays are recorded for payroll purposes, in accordance with the entitlements outlined in this policy.
