CHANGES MADE TO SURVEY STANDARDS & GUIDELINES

Following is a summary of the changes that were made to the State Regulation Set for Nurse Registries, effective June 1, 2011.

G 101 / Licensure of sites / Clarified guidelines, providing an example.
G 102 / Unlicensed Activity / Added 400.506(5), F.S., to the standard that has the penalty of $500 per day. It replaces 400.812(4), F.S. ($1,000 per day) for nurse registries. Statutory references in guidelines were corrected.
G 108 / Change of ownership / Removed old definition from guidelines and placed current definition from law in standard. Removed 59A-18.004(8) on the application documents since the Home Care Unit, rather than surveyors, handle the licensure application forms.
G 109 / Financial Instability / Removed the definition of financial instability from the guidelines and put the newer definition from 59A-35 (the Health Care Licensing Procedure Act, 408 Part II, F.S. rules) in the standard. Replaced 59A-18.004(7) with 59A-35.062(7).
G 125 / Affidavit of Compliance with Screening Requirements / Deleted this standard since the requirement was removed from state law (400.512, F.S.) and the annual affidavit is no longer required.
G 126 / Background Screening / Deleted contents since level 1 background screening is no longer done per state law changes.
G 127 / Background Screening –Records / Replaced state law in standard with newer laws from 408.809 and 435, F.S. Updated surveyor guidelines as well.
G 128 / Background Screening / Updated the standards with the revised 2010 statutes on level 2 screening. Revised guidelines due to law changes.
G 129 / Background Screening - Exclusion from working / Updated the standards with the revised 2010 statutes. Revised guidelines due to law changes.
G 271 / Home Health Aide Qualifications / Revised standard so it is only about home health aides and the training an aide must have had in order to be placed by the nurse registry. Removed C.N.A. from this standard.
