THIS AGREEMENT is entered into by and between Jackson Cake Company (hereinafter referred to as “JCC”), and ______(hereinafter referred as “Client”).

WITNESSETH

Client desires to retain the services of JCC, a Specialty Baker, to coordinate and plan Client’s Special Event, to be held on (date) ______.

NOW THEREFORE, for valuable consideration, it is agreed as follows:

Fee Schedule:

1.1.Deposit: There is a $250.00 deposit paid to reserve clients date for all cakes. In the event of cancellation, clients deposit is NON-REFUNDABLE.

1.2.FINAL PAYMENT: Total contract price is due 2 weeks prior to clients wedding/event date. The cake will not be made if final payment has not been received.

DELIVERY & SETUP:

2.1.We charge $50 (Jackson); $75 (Moran/Victor/Driggs/Alpine); $150 (Dubois/Pinedale) delivery and setup for all wedding/large specialty cakes.

2.2.If clients event is during peak times of the year (Holidays, June 1-October 1), JCC will only deliver for 75 plus people. Smaller cakes will need to be picked up. JCC will coordinate the time with client and/or schedule to meet client or clients designee.

2.3.JCC is not responsible for any damage to the cake after setup is complete. Client is responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 75 degrees or below.

2.4.If client or clients representative elects to pick up and set up the cake, client assumes all liability and responsibility for the condition of the cake once it leaves JCC’s possession.

CAKE SET/STAND:

CAKE STAND RENTAL

3.1.If client desires a cake stand/display JCC will rent the stand/display to client at an additional charge of $25-$125 (depending on particular stand and dessert item).

3.2.The $250.00 paid to reserve clients date also serves as clients set/stand deposit for the cake stand/display. All pieces of the cake set/stand must be returned to Jackson Cake Company by the Wednesday following clients’ event to 262 East Kelly St, Jackson, WY 83001. Late return or damaged pieces will result in the forfeit of clients deposit and/or full replacement cost of the stand (whichever is greater).

3.3.If client would like to arrange for the cake stand/display to be picked up by JCC he/she must notify JCC in writing (e-mail acceptable) prior to the delivery date. JCC will charge an additional $50 fee for this pickup service to be paid prior to/or during delivery.

CAKE CHANGES:

4.1.Changes to clients cakes size, description, flavors, etc. will be accepted until 2 weeks prior to the event date. After that lockout date we cannot accept any changes. Changes may affect the price of the cake.

CANCELLATION POLICY:

5.1.Cakes cancelled prior to 30 days before the delivery date will forfeit 50% of the total cost of the cake. Cake cancelled within the 30 days period aforementioned will forfeit the total cost of the cake. In the event that something occurs to affect clients scheduled wedding date/time please contact JCC to discuss options.

FLOWERS:

6.1.JCC prefers to make handmade floral décor for specialty cakes as many fresh flowers may contain pesticides, dirt, bugs, or be poisonous for consumption; In addition, Wyoming food safety laws prohibit commercial kitchens to use live plants that are not meant for consumption.

6.2.JCC is always more than willing to decorate with flowers around the base of the cake or on the cake table at delivery. If client has a specific lay out it is clients responsibility to give JCC a sketch of exact placement.

6.3.Flowers for the cake table (or anywhere else) need to be provided by clients florist. Client is responsible for providing examples of the specific colors and types of flowers he/she wants on the cake.

6.4.JCC is available to work directly with clients florist to ensure that everything coordinates.

ORNAMENTS/ TOPPERS:

7.1.Ornaments can be brought to the bakery between 14-30 days before clients event. Topping cake with ornaments that are too heavy or not secured properly may cause damage to your cake. If any party, other than a JCC employee, adds to a cake, JCC is not responsible for damage to the ornament or to the cake.

COMPANY POLICIES:

8.1.On occasion JCC will photograph cakes and reserves the right to use any photographs for display or promotion without compensation to client.

8.2.JCC products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. Client agrees to notify guests of this risk and hold JCC harmless for allergic reactions.

I (Client) have read and understand all that has been proposed. I have received a copy of this contract for my records.
