NOVEMBER 7, 2016 VILLAGE BOARD MEETING

Upon a motion by Trustee Mann, seconded by Trustee Porter the Board approved the minutes from the October 3, 2016 Continued Public Hearing to receive public input on the subject of placing merchandise on the sidewalks in the HCBD, and the October 3, 2016 Village Board Meeting by a vote of 5-0.

McKenzie Houseman came to the Board for permission to hang a sign on the Lakeland fence for her Winter Market which takes place twice a month. Upon a motion by Mayor Wheeler and seconded by Trustee Mann, the Board approved the sign request pending a letter from the Chamber of Commerce stating they have a relationship with the Winter Market by a vote of 5-0.

Trustee Dave Porter introduced Greg Royer from SmartWatt Energy, Inc. SmartWatt approached the Village about 1 ½ years ago to do an energy savings project to change the street lights to LED lights. Mr. Royer gave a presentation. (see attached)

Upon a motion by Mayor Wheeler and seconded by Trustee Porter, the Board passed the following resolution by a vote of 5-0:

RESOLUTION # 19 - BE IT RESOLVED that the Village of Cazenovia through its governing body the Board of Trustees, hereby authorizes the Mayor to sign the letter of intent for the investment grade audit for the SmartWatt energy efficiency program subject to the approval of the Village Attorney and the Public Works Administrator.

The next item on the agenda was to review the NYS SHPO letter as requested by the Planning Board. Attorney for the Village, Jim Stokes stated earlier this year an annexation petition was filed for the proposed Cazenovia Market Site. The Village Board, acting as lead agency did a review of SEQR. A number of reports and studies were done which led to a detailed resolution which was passed at the June 20th Village Board meeting.

A short discussion followed.

Upon a motion by Mayor Wheeler and seconded by Trustee Mann, the Board passed the following resolution by a vote of 5-0:

RESOLUTION NO. 20

OF THE VILLAGE BOARD OF TRUSTEES

OF THE VILLAGE OF CAZENOVIA

A RESOLUTION MAKING FINDINGS IN REGARD TO PLANNING BOARD REQUEST TO REVIEW SEQR DETERMINATION FOR CAZENOVIA MARKET PROJECT

WHEREAS, by resolution duly adopted on June 20, 2016, this Board of Trustees, acting as lead agency, made extensive findings in regard to the proposed mixed use commercial and residential project now referred to as the “Cazenovia Market” project (“Project”), and concluded that the annexation and development of the Project as proposed would not result in any significant adverse environmental impacts, thereby issuing a negative declaration under the New York State Environmental Quality Review Act (“SEQRA”), and

WHEREAS, by subsequent resolution and order duly adopted on June 20, 2016, this Board of Trustees approved the annexation to the Village of the 10.741 acres of Project lands, and

WHEREAS, local law number 5 of the year 2016 of the Village of Cazenovia approving the annexation of the Project lands was filed with the New York State Secretary of State on July 13, 2016, and

WHEREAS, by letter dated August 10, 2016 from the New York State Department of Parks, Recreation and Historic Preservation (“SHPO”) to Mr. David Muraco (a copy of which, with attachments, is annexed hereto and made a part hereof as Exhibit “A”) (the “SHPO Letter”), the SHPO rendered its opinion that the cabin complexes upon the Project lands meet the criteria for eligibility for listing on the State and National Registers of Historic Places, and

WHEREAS, at a meeting held on October 24, 2016, the Village Planning Board resolved to request that this Board of Trustees determine whether, in light of the SHPO letter, this Board has the legal authority to reopen the prior negative declaration issued on June 20, 2016, and if so, does the SHPO Letter warrant the rescission of the prior negative declaration; and

WHEREAS, section 617.7(f) of the SEQR regulations addresses the rescission of a negative declaration, and

WHEREAS, this Board of Trustees has reviewed the SHPO letter and has consulted with legal counsel and reviewed section 617.7(f) of the SEQR regulations and relevant case law, as well as this Board’s prior SEQR resolution of June 20, 2016.

NOW THEREFORE, it is hereby resolved and determined by the Village of Cazenovia Board of Trustees, based upon the decision of the New York State Supreme Court, Appellate Division, Fourth Department in Matter of Pittsford Canalside Properties, LLC v. Village of Pittsford, 137 A.D. 3d 1566, and the decision of the New York State Supreme Court, Appellate Division, Second Department in United Water New Rochelle, Inc. v. Planning Board of the Town of Eastchester, 2 A.D.3d 627, that this Board of Trustees does not now have the authority to rescind the prior negative declaration because this Board has, by its June 20, 2016 resolution approving the annexation and its Local Law 2016-5 filed with the Secretary of State on July 13, 2016, previously made a decision of approval in regard to this action, namely the approval of the request for annexation.

The Cazenovia High School Government students presented the Village Board with different ideas of things they would like to see happen in the Village. The first group of students are also part of the Madison County Internship Program. They are Olivia Weiler, Whitney Denison & Taylor Ketcham. They would like to see the phone booth in front of Kinney Drugs removed as it no longer works and is an eyesore. Some of their suggestions of things to go in its place are: a piece of art work from Stone Quarry Art Park, adding a light post or planters, adding a “Blue Light” phone with a direct line to 911 in case of an emergency, and adding a map of Cazenovia to show local attractions. The group had spoken to Police Chief Hayes regarding a blue light system that could be implemented. This could also be installed in the parks. A short discussion followed. It was suggested we work with Cazenovia College regarding a blue light system. David Bergh from Cazenovia College said he would help getting any information he could. Trustee Fritz Koennecke will work with the group as it is a Public Safety issue. This group also had an idea of planting a community garden on the Green near the Parade Plaque.

The second group of students included Joanna Seeley, Liddy Rankin, Maddie Filkorn and Lucy Connor (not present due to basketball practice. This group would like to place recycling bins on the village trash cans throughout the Village especially at Lakeland Park and along Albany St. They had spoken with Mr. Carr and he seemed optimistic. This group has also contacted Madison County Solid Waste and are waiting to hear back from them hoping they might donate the bins or give them a price of what the bins would cost.

The third group included Briar Becker, Summer Steinhorst, Stevie West and Hannah Scanlon. This group is hoping to get some of the signs in the Village repaired or put back the way they should be. There are some signs that have graffiti on them. This would help with community beautification as well as public safety. The second component is to improve the signage in the Village especially with the new businesses such as Empire Brewery and the Hampton Inn.

Trustee Amy Mann reported she had been invited to participate in a meeting at the college on the topic of a potential community YMCA. (see Trustee Mann’s monthly report)

Trustee Mann introduced David Bergh, Vice President for Planning & Institutional Effectiveness from Cazenovia College who gave an update on this project. A market analysis needs to be done. The group has gotten a quote from a firm the YMCA uses. A meeting is scheduled with the expanded stakeholder group to review the quote. Discussions at this point are very exploratory.

Ted Bartlett reported the Village has recently received two NYS Historic Preservation Grants for the National Register-listed Lakeland Park to date: one for work on Carpenter's Barn and one for the Lakeland Park Master Plan. With receipt of the State funds any future work at Carpenter's Barn or in Lakeland Park is required to be reviewed by SHPO for appropriateness. Every project review has an archaeological component. As part of the State Historic Preservation Office review for the Lakeland Park project and based upon preliminary information submitted it has been determined that a Phase I-A (Literature and Documentation Search) is needed (no shovel tests at this point). In discussion with SHPO we agreed that the Phase 1-A assessment should address the entire park, and then we will know what areas of the park are sensitive and may require additional investigation with ensuing projects. We will add the Phase 1-A final report to the Lakeland Park Master Plan.

In areas that are identified as archaeologically sensitive, such as where the house was located or other built features, when projects are proposed that impact these areas additional investigations, such as shovel tests will be required. If significant sub-surface features are discovered, the designs of the project(s) in those areas need to adjust to have as little impact as possible on the sub-surface resources.

Upon a motion by Mayor Wheeler, seconded by Trustee Mann the Board authorized the Mayor to sign the Service Agreement with Hartgen Archeological Associates, Inc. to prepare the Phase 1-A assessment and to pay $2,500 for the study from the Mayor Contractual Line by a vote of 5-0.

Mayor Wheeler thanked Ted for all his work on making arrangements to restore the Lincklaen House sign.

  • Lakeland Park planning project funded by NYS Parks - will submit final payment request and close out grant
  • Records management project funded by NYS Archives - final report submitted
  • Kayak/canoe launch at Lakeland Park funded by NYS Canal Corp and a NYS SAM grant - design underway.
  • Development of Creekside Park funded by CNY Community Foundation - initial work on grading and drainage has begun; design will continue this fall and installation next spring
  • Grant application submitted to L.L.Bean’s Charitable Giving Foundation for matching funds for kayak/canoe launch at Lakeland Park - $25,000 - pending
  • Development of documents for the Municipal Restructuring grant program is ongoing

Town of Cazenovia –

  • Implementation of recommendations made under the Farmland Protection Plan funded by NYS Ag & Markets - work is ongoing
  • Community Development Block Grant for Empire Brewery - project close out was completed
  • Records management project funded by NYS Archives - final report submitted
  • Additional turbine and interpretive features for the New Woodstock micro-hydro site funded by a Common Grounds Challenge grant and a grant from the CNY Community Foundation - under development and will be installed in the spring
  • Assisting with funding options for Mount Pleasant Water District
  • Development of documents for the Municipal Restructuring grant program is ongoing

CACDA Initiatives

  • Main Street committee is exploring strategies to recruit new businesses to the historic district
  • RecDesk was launched with facilitation from Project CAFÉ and Common Grounds
  • Friday night movies - next movie is Saturday November 19 - Finding Dory
  • Planning is ongoing for the trolley initiative; seeking NYS grant funding
  • Grant applications were submitted to CNY Arts on behalf of the Chamber of Commerce for the summer concert series and the Cazenovia Arts and Heritage Alliance for an installation at the Art Park

The Board approved the request from CACDA to hang a sign on the Lakeland fence from November 12th – November 19th to publicize their upcoming movie scheduled for November 19th at the Catherine Cummings Theatre.

Trustee Fritz Koennecke gave his monthly report:

Lake Association- met on October 17th

  • CLA discussing fundraising plans for renovate treatment next year.
  • The town is putting together a committee to examine lakefront development and zoning- several recent lakefront projects have been approved that appear to exceed what zoning allows

Lake Watershed Council- met on September 27th

  • Planning the next lake summit for 3 December 8:30-12:00 upstairs at the Village Hall
  • Great list of speakers
  • Treatment plans for next summer will be the hot topic

Police:

  • Marine Report: (Supplied by Chief Hayes)
  1. We had 110 man hours from Memorial Day through Labor Day in addition to July 4th fireworks and the Triathlon. I also conducted 2 early morning shifts at which there was no charge to the village or lake association.
  1. I have secured two spots for the second half of the Marine Patrol School. These will be in April or May of 2017 and will complete the two main patrol officers training. This will enable us to conduct boater safety course as needed.
  1. The new patrol boat was in full operation and very well received. We are on the list to receive a personal watercraft (wave runner) as well for next season.
  1. A night of training as conducted with the Cazenovia Fire Department Rescue Squad. Several members were shown the capabilities of the new patrol boat. We have training a couple of members on the operation of the boat and look to train a few more in the spring. Also some training dates for next year for the Cazenovia Fire Department dive team are being scheduled. I, along with the Captain of the Rescue Squad are also looking to set a training date with all fire department dive teams and the Madison County Sheriff’s and NYS Parks Police Marine Units for a large training day.
  1. We will be obtaining more safety cards from the State for distribution. I was requested to forward a copy for your publication but was out of them and was not able to get any more at that time

As always I am available any time for anyone who has questions or concerns and I again want to thank the Lake Association, the Town and Village of Cazenovia boards for making this opportunity happen. I have an end of year NYS Parks and Recreation report to complete by the end of the year and as soon as I complete that I will forward a copy of that.

  • Police Report

The following report reflects statistics from 07/01/2016 through 10/31/2016

1.MAJOR INCIDENTS: Any case that is a felony or is information that is needed to ensure to public safety.

NONE AT THIS TIME

2. ONGOING INVESTIGATIONS: Currently we have seven open cases that are actively being investigated along with 2 active warrants.

3. CALL REPORT: For the above dates we had a total of 275 calls for service, 3 felony arrests, 7 misdemeanor arrests, 6 violation offense, and 5 warrant arrests, 198 vehicle and traffic tickets written, 26 MVA’s investigated and 170 parking tickets issued and zero immobilizations.

4. TRAFFIC VIOLATIONS: 11 speeding, 23 uninspected, 10 license violations, 13 registration violations, 2 DWI, 7 AUO (operated with license suspended or revoked) and 132 other violations.

5. BUDGET REPORT: Nothing to report

6. MISC: We are again doing our “No Shave November” fundraiser for Caz Cares. Each participating officer pays $25.00 and the total is donated to the local food pantry.

Insurance:

  • We would like to implement a Health Reimbursement Arrangement (HRA) this year where the village assumes some of the plan risk in exchange for potentially large savings
  • We will switch to a Bronze plan with a $6450 deductible- the premiums are less than half of the premium that our current plan will have next year
  • The HRA will make up the difference to our employees by covering the first $1,250 of plan expenses with no copay or coinsurance. From $1,250 to $6,450, the village will cover 70% and employees will cover 30% of the expenses. These amounts are double for non-individual (eg: family) plans
  • Employees will get lower premiums and no copays other than the 30%. An employee on a family plan saves over $2,800 on premiums alone
  • The village will save about $90,000 on premiums
  • The total exposure for the village to cover the HRA expenses is around $93,000.
  • This is if every plan member used all of the HRA funds.
  • Generally, it is expected that we will actually see about 50% actually used.
  • The remaining funds are the savings the village can expect to realize - Around $45,000 annually.
  • Discussions with the PBA went well and they are reviewing the draft MOU that would authorize the plan change from the contractually directed one
  • We will stay with Excellus- we considered changing, but the provider networks did not overlap much and it would have seriously inconvenienced our employees.
  • Request board approval to authorize the Mayor to change the plan and the Police Commissioner to sign the MOU between the PBA and the Village
