PROVISIONAL PROPERTY TAX ASSESSMENTS

1.  Name and Address of Taxpayer – The owner and mailing address of the owner of record as of the date of this notice.

2.  Date of Notice – The date the provisional notice is sent to property owner.

3.  Property Number (State/Local) – State mandated property number followed by locally assigned property number.

4.  Taxing District – The number assigned by the Department of Local Government Finance to the taxing district in which this property is located.

SUMMARY OF YOUR PROVISIONAL TAXES

1. Gross assessed value of property for 2009 – The gross assessed value of your property on record for taxes payable in 2009.

2. Total property tax due for 2009 – The tax liability calculated by the Treasurer’s office for 2009.

Adjustment for 2010 (if applicable) – This line reflects any adjustments made to the base 2009 tax bill. It will reflect any percentage reduction in the 2009 amount, and may include credit for additional deductions In some circumstances, the Department of Local Government Finance may also require an additional percentage or factor be applied to the prior year’s tax bill in order to make a more accurate projection of your tax liability for the current year.

3. Adjustment for property tax cap – If the provisional property tax liability exceeds your prior year’s gross assessed value multiplied by the

appropriate cap amount (1%, 2%, or 3%), your provisional bill will be reduced proportionately to reflect the credit.

Adjustment for 65 years & over cap (if applicable)– If you are eligible for the 65 years & over property tax cap and your 2009 bill was adjusted for any reason, your provisional bill will be reduced proportionately to reflect the credit.

Property taxes billed on the provisional tax bill are due and payable in the same manner as property taxes billed on a regular tax bill under Indiana Code section 6-1.1-22-8.1, and will be credited against a reconciling tax bill. All payments of property taxes shall be made to the county treasurer. IC 6-1.1-15, Procedures for Review and Appeal of Assessment and Correction of Errors, do not apply to a provisional tax bill; thus, no appeal (optional Form 130) or correction of error (Form 133) may be filed from a provisional tax bill. The interest and penalty provisions apply to a provisional tax bill. The penalty is equal to an amount determined as follows: if an installment of real property taxes is completely paid on or before thirty (30) days after the due date; and the taxpayer is not liable for delinquent property taxes from a previous installment for the same parcel, the amount of the penalty is equal to five percent (5%) of the amount of delinquent taxes. If the real property taxes are not completely paid on or before thirty (30) days after the due date, the amount of the penalty is equal to ten percent (10%) of the amount of delinquent taxes.

DEDUCTIONS APPLICABLE TO THIS PROPERTY

Type of Deduction – No credit, deduction or exemption is automatic. It must be applied for with the appropriate office by the due date of the application for the benefit of the year prior to the year taxes are payable. Various restrictions apply. Type of Benefits – Deductions, credits and exemptions are determined annually and are applied to applicable properties.

·  Abatement – Exemption for eligible properties where taxes have been lowered or eliminated, generally through the action of the City Council or County Council.

·  Blind/Disabled – Deduction for disabled. Must supply proof from a doctor or Social Security Awards letter.

·  Enterprise Zone – Exemption for eligible properties located within a designated enterprise zone.

·  Geothermal – Deduction for eligible properties using geothermal utilities.

·  Homestead/Standard Deduction – Deduction for owner-occupied primary residence.

·  Supplemental Standard Deduction – Additional deduction for homesteads after the application of the Homestead/Standard Deduction.

·  Mortgage – Deduction for property mortgage for eligible individuals.

·  Nonprofit – Exemption for eligible properties. See I.C. 6-1.1-10.

·  Over 65 – Deduction for individuals over 65 years of age; subject to income limits and property value caps.

·  Veterans – Deduction for individuals with service related disabilities or WWI veteran or spouse, must supply awards letter.
