Academic Appeal Application Form

Before completing this application form, please carefully read the following:

  • Part K (Sub-Section 2) of the General Academic Regulations and the Students Appeals Procedure contained in the Manual of Policies and Procedures (Part K/Section 3) available from the Academic Registry tab of the Virtual Learning Environment;
  • The Academic Appeals Policy as set out below.

Permissible Appeals

A student may appeal against:

(a)the result of any investigation or action taken under the regulations referred to above; or

(b)the unconfirmed result of a module or assessment element, published under the authority of the Dean of Academic Affairs; or

(c)the unconfirmed result on the completion of a designated stage in a programme, published under the authority of the Dean of Academic Affairs.

Grounds for Appeal

A student may only appeal where:

(a)there is reasonable ground supported by authoritative and objective evidence to believe that there has been administrative or procedural error of such a nature as to have affected the outcome of the investigation or result; or

(b)the decision in the case was manifestly unreasonable; or

(c)there is new evidence that for good reason, objectively and authoritatively documented, could not be submitted earlier.

Deadline

Completed forms must be received by the Office of Regulation and Compliance within 20 working daysof the publication of the examination/assessment results the student is appealing against. If you arelodging an Appeal outside of the deadline,you must attach a completed copy of the Late Submission Form.

A late Appeal will only be considered where you are able to prove that you were mentally or physically incapable of lodging an Appeal within the prescribed time limit. Late applications need to be accompanied by authoritative and objective evidence which confirms that you were incapable of submitting an application within the prescribed time limit. Please see Manual of Policies and Procedures/Part K/Section 3/Paragraph 8.

Threshold conditions for a valid Appeal

Before submission, you must ensure that theAppeal meets the threshold conditions for a valid appeal as set out in the Manual of Policies and Procedures/Part K/Section 1 (Policy on Academic Review) and Section 3 (Student Appeals Procedure).

Evidence

Appeals must be supported by objective and authoritative evidence. It is your responsibility to submit evidence along with this form. Examples of acceptable evidence is an original, signed medical certificate or letter from an appropriate third party (e.g. GP, hospital consultant, solicitor, police officer) giving details of the circumstance, its duration and its impact.Letters from family members or fellow students are not normally acceptable. If the document submitted as evidence is not in English, an independent translation must also be provided. If appropriate, you should obtain a supporting statement from a member of staff.

You may be permitted an extension of time to provide additional evidence, but having submitted further information does not guarantee a successful outcome.

Stay on Action

From the date of lodging an appeal, a stay of execution shall be placed on any action or decision being appealed. Boards of Examiners or any other body, except for the Academic Council, shall not implement any decision that is currently lodged for consideration as an Appeal.

Pending the outcome of an Appeal, and where you have the right, you may undertake classes, attend the University and must prepare for and retake any assessments or examinations that have been scheduled.

Ground (a): there is reasonable ground supported by authoritative and objective evidence to believe that there has been administrative or procedural error of such a nature as to have affected the outcome of the investigation or result.

If you are appealing under Ground (a) then your personal statement will need to include details and supporting evidence of how a procedural or administrative error occurred. If appropriate, you should obtain a supporting statement from a member of staff to support the claim.

Ground (b): the decision in the case was manifestly unreasonable.

If you are appealing under Ground (b) then your personal statement will need to demonstrate how the decision in this case was manifestly unreasonable. You will need to be able to demonstrate that the decision made was irrational, perverse or logically flawed.

Ground (c): there is new evidence that for good reason, objectively and authoritatively documented, could not be submitted earlier.

If you are appealing under Ground (c), then your personal statement should include details of the new evidence that has become available and demonstrate why you could not submit this evidence earlier (for example, with a Mitigating Circumstances application or a Deferral application). Evidence confirming that the documentation was not available earlier will need to accompany the application.
