1.0 Introduction
North Yorkshire Police makes charges for the delivery of selected non-core goods and services. This manual is relevant to the charges that are made to individuals and external organisations. The charges identified represent the standard charges that have been approved by the Police and Crime Commissioner for North Yorkshire at the time of publication. In addition to the standard charges, other charges may be made through specific agreements and will be individually submitted to the Commissioner’s Chief Finance Officer for consideration. All charging procedures must receive the approval of the Commissioner’s Chief Finance Officer prior to any commitment being made to deliver any service or provide any goods.
Due to the nature of the content of this document it requires periodic revision as additional charges are approved and existing charges are reviewed. Annually, there will be at least two revisions made. The first in preparation for the new financial year in April and the second to incorporate new salary scales at about September. It is probable that charges will be amended or additional charges identified throughout the year. It is advised that users of the document ensure that the version referred to is the current edition. The current edition will be posted on the Financial Services subsite of the intranet.
It is the objective of this document to identify those goods and services for which North Yorkshire Police will make a standard charge. It provides information about the level of charge, the objective of the charge and makes reference to the consideration made when setting the level of charge.
2.0 Governance
The charges made by North Yorkshire Police are governed by legislation, the Police and Crime Commissioner for North Yorkshire’s Finance Regulations, Contract Regulations and the North Yorkshire Police Devolved Resource Management Manual. Many of the charges are subject to National Police Chiefs’ Council guidance or memoranda of understanding or may be set nationally by some other process.
2.1 Legislation
The main provision of legislation relevant to the making of charges by police forces is made by the Police Act 1996 and the Police and Social Responsibility Act 2011. The Acts, together with other legislation, empower North Yorkshire Police to charge for the delivery of non-core goods and services. Services may be supplied to any individual or organisation but consideration should be given to the purpose, locality and nature of the services to be delivered and the charges to be made. North Yorkshire Police is not a commercial organisation and does not develop a capacity to deliver services for the principle objective of income generation. It may be appropriate to charge for the delivery of non-core services which the organisation should or could make available due to the nature of its core services. Existing examples include the delivery of special policing services, the release of information for some civil legal proceedings and other services that can be provided through a capacity that the organisation already maintains to meet its policing responsibilities. It is generally appropriate that the charge made is relevant to the recovery of the costs of providing the service.
2.2 Procedural compliance
Internal procedures are established to ensure that the income generation actions that are carried out by North Yorkshire Police remain compliant with the relevant legislation. The Police and Crime Commissioner for North Yorkshire’s Financial Regulations and the regional Contract Regulations are interpreted through the Devolved Resource Management Manual. All income generation activities must be carried out through approved procedures and must remain compliant with the North Yorkshire Police Devolved Resource Management Manual.
3.0 Procedure
All charges made by North Yorkshire Police must have been approved by the Commissioner’s Chief Finance Officer. Approval may be conferred on individual proposals to make a charge. Approval may also be granted for repeated charges when the level of charge and the method of charging is approved by the Commissioner’s Chief Finance Officer. In the latter case, the approval of the Commission’s Chief Finance Officer is not required for the individual charges made using the procedure.
The application of a standard approved charge should be made with reference to the approved method of charging and should only be made using the identified standard charge. Any deviation from the standard approved charge should be submitted for the consideration of the Commissioner’s Chief Finance Officer by forwarding a request to the Governance and VFM Manager.
To establish a standard approved charging procedure, the proposed procedure should be submitted for the consideration of the Commissioner’s Chief Finance Officer by forwarding the details of the procedure to the Governance and VFM Manager.
Individual actions to make a charge are also subject to the approval of the Commissioner’s Chief Finance Officer. A proposal to make an individual charge should be submitted for the consideration of the Commissioner’s Chief Finance Officer by forwarding the details of the proposed procedure to the Governance and VFM Manager. Every individual charge that is made will be subject to a written document of understanding agreed between North Yorkshire Police and the individual or organisation receiving the relevant goods or services. All such documents of understanding must be approved and signed on behalf of North Yorkshire Police by the Commissioner’s Chief Finance Officer.
The retrieval of all charges will be through the standard financial systems. The financial product of all charges will be subject to the usual accounting and other financial procedures.
4.0 Standard charges for police officer and police staff time
Purpose of charges
Recovery of the costs of services delivered in addition to core services.
Rationale of charge calculations
The charging calculations are aligned to ‘National Police Chief’s Council, National Policing Guidelines on Charging for Police Services’ and ‘National Police Chiefs’ Council, National Policing Guidelines on Charging for Police Services: Mutual Aid Cost Recovery’.
Application of charges
The rates apply to all new agreements to make a charge made after 01 September 2015, or the date when new charges are approved. Those agreements negotiated prior to 01 September 2015 but delivered after that date may be honoured at the previous rates when appropriate.
Charges are identified for the provision of special policing services and those services akin to special policing services. In some circumstances, charges for special policing services may be abated in compliance with the North Yorkshire Police procedure for the delivery of such services.
Charging rates are identified relevant to the provision of mutual aid to other forces. The rates shown form the basis of the calculation for the charges relevant to the provision of mutual aid. The calculation applied is aligned to the relevant national guidance and regional agreement and varies dependent on the grade and band of the aid provided.
Other and lesser charges are identified for services that are delivered by police officers and staff but are not special policing services/ mutual aid or akin to special policing services. These charges are used in the calculation of the costs of the provision of a non-core service and will be the subject of a specific agreement.
The sets of charges differ to account for the difference in the costs of the delivery of the types of service. The rates identified for special policing services and other services akin to special policing services include, estimates for overtime and other costs that are not included in the lesser charge. An additional set of rates are identified for the attendance of officers and selected staff at civil court cases. These charges are based on the salary and allowance costs of the provision of such services.
The approved standard charges for police officer and police staff time represent an estimate for the rate of charge required to recover the costs of the provision of such time. The identified rates are used to calculate the appropriate charge for the delivery of services when such delivery is not otherwise directed by specific legislation, national agreement or an already approved North Yorkshire Police charging methodology.
Application of VAT
VAT may be applied to the charges made, dependent on the nature of those charges, the obligations of the receiver of the services and the objectives of the services provided.
