263.Ms V Knoetze to ask the MEC responsible for Cooperative Governance and Traditional Affairs:

(1)How much of the budget has been spent by his Department on legal claims for the 2017/18 financial year as at the latest specified date for which information is available;

(2)can he kindly provide a breakdown of (i) cases lost, (ii) cases won and (iii) cases settled during the financial year specified above;

(3)how much of the budget was spent on legal services;

(4)how many of the cases were handled by the office of the State Law Advisor;

(5)(a) how many cases were outsourced and (b) what did the legal fees amount to?

264.Ms V Knoetze to ask the MEC responsible for Cooperative Governance and Traditional Affairs:

With reference to the Port St Johns Municipal Manager (MM) who has reportedly been dismissed approximately two weeks ago:

(1)Whether he has been informed of the dismissal of the MM of the abovementioned municipality; if so,

(2)can he kindly provide details of the processes that were followed to effect such dismissal;

(3)whether the council was consulted with regard to such dismissal; if not, why;

(4)whether an acting MM has been appointed; if so, what processes were followed;

(5)whether the post has been advertised; if so, (a) where and (b) when;

(6)whether the appointment has been made in accordance with Section 54A of the Local Government Municipal Systems Act 32 of 2000, as amended (Act 32 of 2000 as amended); if not;

(7)when will he investigate the said appointment;

(8)if the appointment was in contravention of the Act 32 of 2000 as amended, as referred above, when will he declare the appointment null and void;

(9)can he kindly provide details of the consequences in the case of an irregular appointment of an MM?

265.Ms V Knoetze to ask the MEC responsible for Cooperative Governance and Traditional Affairs:

With reference to the advertisement of the vacancies of the Municipal Manager (MM) for IntsikaYethu Municipality in the Daily Dispatch dated Friday, 12 May 2017 with an indicated salary bracket of R885395 – R 1104 25.

Noting further that in the case of a Community Services Manager appointment, who has been acting both as MM and a Community Services Manager and that may further imply that there could be a conflict of interest when it comes to screening and interviewing of candidates for community services:

(1)Whether he can he kindly provide clarity on the processes followed in the appointment of the Section 56 Managers as well as the panels for screening and interviewing of candidates;

(2)(a) whether he can kindly specify the final salary amount of the MM, (i) yearly and (ii) monthly as reflected in the final contract entered into and (b) can he kindly provide a copy in this regard?

266. Mr JPJ Botha to ask the MEC responsible for Education:

With reference to Carinus Primary School situated in the Chris Hani District Municipality in the local municipal area of InxubaYethemba – Ward 4 in Cradock:

(1)Whether the school has been identified for the Accelerated School Infrastructure Delivery Initiative (ASIDI); if not why; if so,

(2)can he kindly provide the name of the company/s that was awarded the contract for the project;

(3)what total budget amount was allocated and approved for the project;

(4)can he kindly list the (a) budget expenditure milestones or phases, (b) amounts spent and (c) timeframes over the duration of the project;

(5)whether the scope of the project allows Small Medium Micro Enterprises (SMMEs) from Cradock to participate in the project; if so, in which parts of the scope of the project;

(6)can he kindly provide names of the School Building Steering Committee (SBSC) members with their respective portfolios?

267.Mr P E van Vuuren to ask the MEC responsible for Education:

In pursuance to the response provided for question 187 (3) of IQP 33dated Friday, 29 September, where it has been stated that there are 20956 progressed learners enrolled in the 2017 National Senior Certificate (NSC). Subsequent to that, in a committee meeting, the MEC stated that there was an error in the response received and that there are in fact less progressed learners enrolled:

Whether he can kindly provide the correct number of progressed learners enrolled for the 2017 NSC together with the number of these learners that are going to modularise?

268.Mr P E van Vuuren to ask the MEC responsible for Education:

Regarding Bayview Primary School in Helenvale in Port Elizabeth:

(1)Whether the school is in the B5 list of schools intended for repair; if not, why; if so,

(2)can he kindly provide details of the status and progress of the repairs in the abovementioned school?

269.Mr P E van Vuuren to ask the MEC responsible for Education:

As per the Report of the Portfolio Committee on Education dated, 15 February 2012, regarding Alheit van der Merwe Primary School, the recommendation states “The Department must build a permanent structure replacing the prefabs since they expose children to danger and health hazards”:

Whether the above recommendation has been implemented; if not, can he kindly provide reasons for the non-implementation of the recommendation 5 years after it was made?

270.Mr R S Stevenson to ask the MEC responsible for Finance, Economic Development, Environmental Affairs and Tourism:

(1)What is the projected under collection of revenue at a national level for the current tax year;

(2)whether any possible implications of the under collection stated above have been communicated to the province; if not, why;

(3)whether Treasury has made any inquiries as to the possible impact; if not, why;

(4)how is it anticipated that the under collection will impact the province; can he kindly provide relevant details in this regard;

(5)whether his Department has any plans to mitigate against a possible reduction in equitable share; if so, what plans?

271.Mr R S Stevenson to ask the MEC responsible for Finance, Economic Development, Environmental Affairs and Tourism:

(1)What amount was budgeted for the compensation of employees (COE) in each municipality in the province in (i) 2015/16, (ii) 2016/17 and (iii) 2017/18 financial years as at the latest specified date for which information is available;

(2)what amount was budgeted for overtime in respect of each municipality in the province for the above specified years as at the latest specified date for which information is available;

(3)what total amount in respect of each municipality in the provincewas spent on overtime in the above specified years as at the latest specified date for which information is available;

(4)whether any abuses have occurred regarding overtime in respect of each municipality in the province in the above specified years as at the latest specified date for which information is available;

(5)whether each municipality in the province has an overtime policy; if not, (a) why and (b) which municipalities do not have overtime policy;

(6)whether the overtime policy is adhered to; if not, can he kindly provide relevant details in this regard?

272. Ms J Cowley to ask the MEC responsible forFinance, Economic Development, Environmental Affairs and Tourism:

Noting that after a full month there reportedly continues to be a massive sewage spill in Burgersdorp in the Joe Gqabi District Municipality, and further noting that the spokesperson of the district municipality in question has allegedly stated that the municipalityis unable to resolve the issue until funding becomes available from the NationalDepartment of Water Affairs and Sanitation:

(1)As the sewage is alleged to be flowing down the street in Thembisa, thus adversely affecting the lives of the people who live there, as well as flowing into the StormbergSpruit River, (a) whether the Environmental Affairs Directorate can intervene and assist in resolving the spill before it escalates into an even bigger health and environmental issue; if not, why ; if so,

(2)what steps his Department envisages to take with a view to resolving the issue?

273. Ms J Cowley to ask the MEC responsible for Rural Development and Agrarian Reform:

With reference to the Lukhanyiso Poultry Co-op Abattoir, which was reportedly constructed in Grahamstown in 2013 to process 2000 broilers per day and benefit 278 people:

(1)Whether the total amount of 7,6 million was the total amount for the project or did itincur extra costs; if so,

(2)can he kindly provide reasons for the fact that the project has not operated to date;

(3)whether he can provide assurance that the abovementioned project can be revived so that the potential beneficiaries can be empowered and begin contributing to the economy; if not, why?

274.Mr M von Buchenroder to ask the MEC responsible for Transport, Safety andLiaison:

(1)Whether the Mthatha Airport is currently operational; if not operational, (a) why and (b) how long has it not been operating;

(2)whether the abovementioned airport has a fire engine truck; if so, can she kindly state, (a) how many and (b) whether it is in working condition; if not,

(3)what steps her Department envisages to take with a view to acquiring one?
