  1. Brett Catone with Legacy Homes requests front yard and rear yard setback variances for a doublewide home on Prospect Avenue. Pauline Rice property: next to 342 Prospect Avenue. Site plan to follow. REMOVED BY Ms Rice, the Mom.
  1. Customary Home Occupation request: Mr. Kevin Do wants to buy a house with a full basement where he wants to do a small nail salon. Indian Hills area, 824 Hiwassee Street. The R-1 zone allows CHO with NRPC approval. A nail salon is similar to a beauty shop, I believe. Two customers max per 1 ½ hour by appointment time frame. Removed by Mr. Do, no longer interested in the neighborhood.

  1. Gary and Ray Hawk site plan for review and approval: parcel#018.00, Group B, map 46P

167 Carson Springs Rd. 2nd to last parcel on the right before the Carson Springs Rd underpass,

and behind the Comfort Inn of Smokey Mtn Lane [site plan approved. Drainage came up at next item: why not question issue with Gary Hawk?]

  1. Ellen Shelton Real-estate site plan review for approval: 2 story medical building proposed. Vacant parcel next to Bojangles Restaurant, on Newport Towne Centre Way. Property owner says the property with detention pond is same property. Ellen Turner researched the property deed and stated this detention pond property is in the City of Newport’s name. Dan questioned storm water design/hydrolics to pond. Mr.
  1. Mike Copenhaver, DVM, owner of Appalachian Veterinary Hospital is requesting the rezoning of a parcel (108 Jaybird Road) behind his animal hospital (231 West Broadway) to purchase for possibly enlarging his building and provide additional parking. Zone change R-2 to C-2. POSTPONED TILL NEXT MONTH
  1. Parcel 12.0 rezone request by Manit Subhakul, owner at 108 English St, from R-1 to C-2 commercial, adjacent to the white trailer (zoned C-2) on the corner of English St and Cosby Hwy.

Minutes of the Regular, Monthly Meeting of the Newport Board of Zoning Appeals

(BZA) July 25, 2017

Call to Order

The BZA met Tuesday, July 25, 2017, at 3:30 p.m. in the Council Room at Newport City Hall, 300 East Main Street, Newport, Tennessee. Chairman Cecil Gilland called the meeting to order and welcomed those Planners present: Jim McSween, Tommy Crowder, Randall Freeman, and Mansfield McMahan.

Also present were: Dan Hawk, East Tennessee Development District Planning Consultant; Mark Robinson, the Newport Building, Zoning, and Codes Compliance Official; Gary Carver Planning Director, Mayor Connie Ball and other interested citizens.

Minutes

Minutes of the June 27, 2017 meeting was approved as submitted, after motion by Randall Freeman, and seconded by Jim McSween. The minutes were approved unanimously.

With no further business to come before the BZA, the meeting was adjourned.

Minutes of the Regular, Monthly Meeting of the Newport Regional Planning Commission

(NRPC) July 25, 2017

Chairman Cecil Gilland reconvened the meeting as NRPC.

Minutes

Minutes of the June 25, 2017 meeting was approved as submitted, after motion by Randall Freeman, and seconded by Jim McSween. The minutes were approved unanimously.

Newport Dance and Cheer Academy property use request prior to purchase

The owners of Newport Dance and Cheer Academy, Aaron and Susan McMahan, came to the Board with a request for approval to build a new dance academy at the corner of 6th Street and Lincoln Avenue. The property is in an R-2 residential zone. Mr. McMahan is asking if the academy is considered a school and if a school is allowed in this zone. Mr. Hawk stated a school is allowed in a residential zone. Mr. Hawk read the zoning regulations. Mr. Hawk stated there would be a 40 foot setback requirement and with no access of the property off of 6th Street. The property owners may need to come back to ask for setback variances. Mr. McMahan stated all adjoining property owners are fine with the dance academy being in the neighborhood and signed a statement saying so.

Motion was made by Jim McSween and second by Mansfield McMahan to approve upon application since it was determined that the Newport Dance and Cheer Academy is an educational project and would be an allowed use within an R-2 zone. Approved of request was unanimously.

Re-Subdivision

A request of re-subdivision approval consideration showing lot lines cleanup was made by K3X, LLC Properties (presented by Randall Freeman), located on East Broadway and being: tax map 470, Group C, Parcels 3.0, 4.0, 5.0 & 14.0. This property is between Long John Silver’s Restaurant and Wall Street.

Motion was made by Tommy Crowder and second by Mansfield McMahan to approve the re-subdivision for lot lines cleanup that was requested by K3X, LLC properties on East Broadway tax map 470, Group C, Parcel 3, 4, 5 & 14. Approved of request was unanimously with Randall Freeman abstaining.
