DECEMBER 7, 2009
Pursuant to the terms of the RFP#11-15 MAINTENANCE SERVICES issued by the Neshaminy School District with a proposal due date of Decemebr 14th, 2009 at 10 :00am , this Addendum will clarify or modify certain identified aspects of the Specifications. This Addendum is made a part of the contract and is enforceable under the same terms and conditions as the original Specifications.
The items included in this Addendum are a result of a further review of the requirements by the District, and/or questions or requests that were raised before,during, and /or after the pre-proposal meeting that was held on DECEMBER 1, 2009.
1) The following attended the pre-proposal meeting of December 1 , 2009:

2) The following handouts were provided to all attendees :
- Revised Specification- 34 pages
- Vehicle Exhibit B- 1 page
- Budget excerpts- 4 pages
- Current contract – 26 pages
- Maps/addresses/phone #s- 1 page
3) The revised specification as handed out at the above referenced meeting is available on the District’s website.
4) The proposal due date was changed to Monday December 14, 2009 at 10:00 AM .

6) The following questions we asked subsequent to the preproposal meeting :
1- Section 15.7.4 on page 30 of the RFP states that “the Contractor hereby expressly waives any immunity under the Worker’s Compensation Act, either as an employer or statutory employer, for any claim brought by the School District. This waiver is intended to comply with the provisions of 303(b) [77 P.S. 481(b)] of said act.” Section 303(b) of the Worker’s Compensation Act states that “in the event injury or death to an employee is caused by a third party, then such employee…may bring an action against such third party, but the employer, his insurance carrier, their servants and agents, employees, representatives on their behalf or at their request shall not be liable to a third party for damages, contribution, or indemnity in any action of law…”
Please confirm that the waiver of immunities referenced in Section 15.7.4 of the RFP only allows an employee to recover medical expenses and lost wages under the Worker’s Compensation Act and is not intended to allow an employee to subsequently initiate an action at law against its employer for additional damages.
ANSWER: THE ABOVE INTERPRETATION IS NOT THE INTENT . THE WORDS ARE AS WRITTEN .
2- Is the contract manager going to be paid for by ARAMARK?
If yes how much?
ANSWER: YES – RANGE FOR MANAGERS ARE $ 70,000 – 78,000 .
3- If #2 is yes, does the Contract Managers 40 hour count against the 520 production hours that we are obligated to provide?
ANSWER: YES INCLUDED IN 520 MANHOURS.
4- What are the union health and welfare benefits? Per union agreement, they get 100% dependent coverage, what is the cost of that plan.
ANSWER: SEE ABOVE TABLE – COST NOT AVAILABLE AT THIS TIME .
