Prequalification bid will be opened at 3.00 pm on the same day.

The qualified bidders will be intimated the time of opening of final bid.

Late tenders will not be accepted.

If the tender date happens to be a declared holiday the tender process will be done on the next working day at the same time and same place. The cost of the tender forms may be paid as cash/demand draft in favour of Divisional Manager, KFDC Ltd, Thrissur and is not refundable under any circumstances. Attested copy of relevant page of Contractors Registration Card may also be enclosed. Cheque or any other type of remittance will not be accepted for the cost of tender forms. Tenders are to be accompanied with a preliminary agreement executed in Kerala Stamp paper worth `100/- and EMD at the rate of 2.5% (`.50,000)of the estimate PAC.

The EMD shall be paid/ produced in any one of the following.

Demand draft on scheduled bank/ nationalized bank made payable to the MD, KFDC.
Deposit on scheduled bank pledged in favour of Managing Director, KFDC LTD, Kottayam.

Tender without EMD, attested copy of the registration, cost of tender form, preliminary agreement, without specified details and signatures will not be considered. Further details can be had from the office of the Divisional Manager, Thrissur & Managing Director, KFDC LTD, Kottayam during working hours. There shall be no negotiation after opening the tender and if quoted PAC of the lowest tender exceeds local market rate,justifying estimate, work will be retendered. More over if the tender quoted PAC is less than 75% of the estimate PAC, such tenders will be accepted only after assessing the feasibility of carrying out the work.

The selected bidders shall produce security deposit equal to 10 % of the contract amount in the form of bank guarantee from any nationalized bank which shall remain valid till 28 days from completion of defect liability period.

All other existing conditions related to the tender of Kerala PWD will be applicable in this tender also.

Dear Sir,

I / We examined the tender documents, drawings, specifications, designs and schedule of quantities in the tender documents, of work of Developing basic infrastructure facility for ecotourism at Nelliampathy in Palakkad District and I/We having examined, visited the site and fully satisfied with the provisions, specifications, relating to the works specified in the memorandum and having enquired the local labour and material cost and information relating there to, as affecting the work, I/We hereby offer to execute the works specified in the Bill of Quantities (BOQ) at the rates mentioned in the attached schedule and in accordance with all respects with the Indian Standard Specifications, designs, and instructions in writing referred to in Conditions of Tender, the Articles of Agreement, Special Conditions, Schedule and Conditions of Contract. 2.On acceptance of our tender I/We hereby agree to execute the work as per the Tender Condition and Contract Conditions,

I/We also enclose herewith financial stability certificate issued by our Bankers:
I/We enclose herewith copy of memorandum of association of our firm/company along with power of attorney for authorized signatory.
I/We also know that arbitration will not be a means to settle any dispute arising in this contract.
The contractor shall employ engineering personnel as detailed below for such period according to the tenure of the contract paying minimum wages.

If the contractor has not employed the technically qualified person as per special conditions, the contractor shall be subject to pay daily damage at a rate Rs.673/- per day for one Engineering Diploma holder and Rs.852/- per day for one Engineering Graduate.
The contractor shall not without the previous sanction in writing of the authority accepting the tender, execute any power of attorney in respect of any matter, touching in this contract, and it will be entirely within the discretion of the authority accepting the tender either to grant such sanction or to refuse it or to revoke a sanction once given.
The contractor will provide his own tools, plants & machinery and store shed to store his own materials.
The contractor shall be responsible for the safety of the labour employed by him and he shall be liable to pay the necessary compensation in case of accidents, as per the ‘Workmen’s Compensation Act. The contractor will also be liable to abide by the fair wage clause condition attached separately.
Tenders which are not in conformity with this tender notice are liable for rejection.
This tender notice with the conditions stated herein will form part of the contract documents.
The entries in the bid document issued by the corporation is in no way to be corrected by the tenderers and if corrections are made, such tenders are likely to be rejected.
This is a percentage rate contract and all unit rates and percentage rate quoted by the contractor shall not be varied on any account whatsoever and it shall hold good to all items done irrespective of variations in quantities.

Sealed tender under two cover system super scribing the name of work addressed to Divisional Manager, Kerala Forest Development Corporation,Kottayam.3, on or before, 2.00 pm on 15.01.2013 .

Tenderer shall inspect the site, study the specification, drawings, conditions of tender, conditions of contract, and terms of payment etc. in detail before submission of tender.

The quantities shown in BOQ (Bill of Quantities) in the tender documents are approximate and shall vary widely. It is likely to delete items which are in the BOQ or add items which are not in the BOQ, if found necessary during execution of work. The owner/architect reserves the right to alter the drawings, specifications, in the interest of the work/project.

Tender documents consist of Notice inviting tender, Form of tender, prequalification details ,Article of agreement, General conditions, Conditions of contract, Special condition, Communications for conduct of contract work, Safety code, Labour laws, Fair wage clause, Accident, Schedule of quantities and drawings, Mode of measurement etc. Tenderer shall sign all the pages of the documents in token of having read the tender documents fully.

The tenderer shall submit his rate in full without, leaving/altering the BOQ or specification contained in the tender documents. The owner reserves the right to adjust arithmetical or other errors in the tender. Arithmetical error in the event of quoting, if found, the description in words should prevail over figures. In the event of error in the amount column arising out of multiplication of quantities and rates, unit rate of item shall be regarded as firm and the amount appropriated / amended accordingly.

The rate quoted in the tender shall remain firm for the entire period of contract and shall be extended till the end of Defect Liability Period. The price shown in the BOQ shall include all items and the rates quoted are for completed work as per specification and to the full satisfaction of the owner. The rate quoted is inclusive all taxes and compensations. The rate quoted is firm for 120 days after the receipt date of tender.

The tenderer shall submit a project schedule with a list of machinery to be deployed and key personnel supervising the work. Only approved materials and workmanship are permitted. Design mix shall be allowed, subject to the approval of the architect/owner. No escalation of rate of any sort either on labour or materials will be allowed.

Tender documents issued to one contractor cannot be resold or used by any other tenderer. Tender documents drawings shall remain the property of the .KFDC and shall not be used either in part or in full for any other purpose. The tenderer shall bear all the cost of investigation, site inspection for the purpose of preparation and submission of the tender and such cost shall not be payable by owner to any of the tenderers.

The owner reserves the right to accept/reject any of the tender or accept a lowest tender or reject the same without assigning any reason. Owner reserves the right to reject all the tenders. Tenders submitted other than in the prescribed form will not be considered. Tenders received after the due date and time will not be opened/considered.

FORM OF AGREEMENT

Preliminary Agreement entered into on this ...... day of ...... 2012 between Managing Director /Divisional Manager, KFDC, Thrissur /...... AND WHEREAS Para 13 of the notice inviting tenders stated as follows.

Before commencing the work or within a week after the date when the acceptance of the tender has been intimated to him, the tenderer shall deposit a sum sufficient security deposit for the proper fulfillment of the same and shall execute an agreement for the work in the PWD Schedule Form. If he fails to do this or in the case of PWD contract maintain a specified rate of progress ( to be specified in each case of tender schedule ) the earnest money and security deposit shall be forfeited to the Corporation and fresh tenders shall be called for or the matter otherwise disposed off. If as a result of such measures due to the default of the tenderer to pay the requisite deposit, sign contract or take possession of the work any loss to the Corporation results the same will be recovered from him as arrears of revenue, but should it be a saving to the Corporation , the original contractor shall have no claim whatever to the difference. Recoveries on this or any other account will be made from the sum that may be due to the contractor on this or any or other subsisting contracts or under the Revenue Recovery Act or otherwise the Government may decide. NOW THEREFORE IN THE PRESENCE OF WITNESS it is mutually agreed as follows.

The terms and conditions for the said contract having been stipulated in the said tender form to which the contractor has agreed, a copy of which is hereto appended which forms the part of the agreement, it is agreed that the terms and conditions stipulated therein shall bind the parties to this agreement except to the extent to which they are abrogated or altered by express terms and conditions herein agreed to and in which respect the express provisions herein shall supersede those of said tender form.
