CONTRACT


I have been made aware of the available history of the below mentioned dog and understood it is adopted as a family pet companion. FHGRR makes no warranties or representations regarding the dog’s health or temperament. It is agreed and understood by ADOPTER that while every effort is made to provide an accurate history and assessment of a dog, FHGRR does not warrant any dog regarding medical status, behavior, or disposition. It is further agreed that environmental changes may effect and change the temperament of the above named dog and that FHGRR has no liability or responsibility of any nature regarding defects with the dog, or injuries or damage to any person or property which may be caused by the dog. It is understood that any dog, being a wild, but domesticated animal, may bite or cause harm in any situation. It is agreed and understood by ADOPTER and FHGRR that this written agreement sets forth all promises, agreements, conditions, and understanding between them, oral or written, and that both parties have fully read and understood all of this agreement. The signature of the adopting party or parties below operates as consent to relieve FHGRR and it volunteers of any liability and/or obligation of conduct to the adopting party or parties as related to the above statements.

TERMS AND CONDITIONS FOR DOG # , ADOPTER Last Name:

ADOPTER agrees to the following terms and provisions (please initial each item after careful review):

  1. ADOPTER agrees to take the dog to a licensed veterinarian within 7 days of this contract for a check-up and to establish a doctor, owner, and pet relationship with the veterinarian for the purpose of continued medical care at the owner’s expense. In addition to a well check exam, a heartworm test should be performed at this time along with any other baseline test or exam as recommended by the veterinarian. And after initial exam, ADOPTER agrees to take the dog to a licensed veterinarian at least once a year for an examination and the following routine vaccinations and tests at the intervals required by law and/or as advised by their veterinarian: rabies, distemper/parvo/corona combination, and a heart worm test followed by a regular course of preventative, year round. And ADOPTER agrees to provide the dog with necessary veterinary care upon sickness, disease, and/or injury. ADOPTER understands that violation of this will result in immediate reclamation of the dog. FHGRR makes no representations or warranties regarding the health of this dog.
  1. ADOPTER understands that the dog is not to be solely an outside pet, will not be left outside in bad weather or at night or when the owner or designated caretaker is not at home or it's safety from theft cannot be assured. And ADOPTER agrees that the dog shall be protected from the elements, and provided with adequate food, fresh water, shade, shelter and protection from abuse and loss due to theft, illness or escape.
  1. ADOPTER understands that the dog is not to ride loose in the back of an open vehicle in any manner, is not to be chained or tied-out, and the ADOPTER warrants that the dog will not be contained solely by a hidden fence when no one is home. ADOPTER agrees that this dog will not be allowed to roam freely and/or wander off of property and when not fenced or off property will be supervised, under control and/or on leash. ADOPTER understands that violation of this will result in immediate reclamation of the dog.
  1. ADOPTER agrees to give this dog adequate daily exercise and attention, especially in situation where the dog has to be confined or left alone, to promote good mental and physical health and avoid behavior problems.
  1. ADOPTER agrees to provide this dog with a safe home, proper care and attention, and humane treatment in accordance with all current and future state, county, and local laws and ordinances where ADOPTER resides. Adopter understands that should the dog be picked up for any reason by animal control or other animal related law enforcement or animal related citation be issued ownership shall revert back to FHGRR and the animal will be reclaimed. After which time the ADOPTER may petition the Board for review and reinstatement.
  1. ADOPTER understands that there are costs involved in maintaining a dog, and agrees to assume full responsibility for the food bills, health care and licensing of the dog.
  1. ADOPTER agrees that the dog will reside in his/her home, will be kept as a household pet, and will not be used for breeding, fighting, or exclusively as a hunting or guard dog.
  1. ADOPTER agrees to provide a collar and identification tag for the dog to wear at all times when allowed outdoors, and if provided with a FHGRR identification tag, that will also remain affixed to the collar. If other means of identification are not completed, such as tattoo and/or microchip implant ADOPTER agrees to return upon request of FHGRR for such identification to be completed.
  1. ADOPTER agrees to indemnify and hold harmless FHGRR, its members and representatives against any and all claims, known or unknown, now or hereafter arising in connection with this dog.

  1. ADOPTER specifically acknowledges and understands that dogs are territorial animals, and that a pre-existing dog in the household can raise issues of territorial supremacy and/or primacy in both the existing dog and the adoptive dog. Adopter further specifically acknowledges and understands that the dogs may fight, with either dog being the aggressor. Adopter understands that any person, either adult or child, that interferes in a dog fight or display of aggression, defense and/or fear may be injured. Adopter hereby specifically accepts the risk of such behavior, and waives any claims whatsoever, whether for damages or injuries inflicted upon property, person, or canine(s), resulting from fights between the dogs.
  1. ADOPTER consents to interview and/or examination of this dog by FHGRR at any time and acknowledges that FHGRR has the right to reclaim the dog at any time for failure to comply with the terms of this contract or for any misrepresentations of fact ADOPTER made on the adoption application incorporated herein by reference or in this contract.
  1. ADOPTER understands that no refund will be given after the initial fourteen (14) days.
  1. ADOPTER understands if the ADOPTER cannot keep the animal, the ADOPTER must return it to FHGRR. The dog shall not be given away, sold, or exchanged without prior written consent of FHGRR. In the event of the ADOPTER’s death, FHGRR should be notified. Transfer of ownership to another qualified member of the family member after application is at the discretion of the board.
  1. ADOPTER understands that if for any reason this dog has not been spayed or neutered prior to the execution of this contract, he/she agrees to have the appropriate surgical procedure performed on or before and to provide documentation that this has been performed. ADOPTER acknowledges that until this has been accomplished, his/her adoption of the dog is not complete and that FHGRR has the right to and will reclaim the dog if the operation is not performed.
  1. Special Provisions (if none, indicate by N/A):
  1. ADOPTER agrees to pay FHGRR for any and all expenses, including court costs and reasonable attorney’s fees, in enforcing the terms and provisions of this contract. Payment of these damages shall not excuse ADOPTER from returning the dog to FHGRR.
  1. ADOPTER understands that it is highly recommended and may be required, especially in a dog under 2 years of age, to attend a formalized obedience course within eight weeks from adoption and completing the said course may enhance bonding and alleviate many adjustment and behavior problems. (A $50 deposit may be required and refunded after proof of course completion is provided. If attendance is required and deposit is retained it is noted under item 15.)
  1. ADOPTER understands that a dog is a domesticated wild animal whose behavior may not be predicted and may bite or cause harm.
