SECTION - I

Sealed tenders are invited by the office of Varanasi Municipal Corporation from experienced and competent organizations / consultants for preparation of revised City Development Plan of Varanasi City, in accordance with guidelines under Jawahar Lal Nehru Urban Renewal Mission including modified guidelines, toolkits and instructions issued by Min. of Urban Development, GOI (Vide letter No. K/14012/282/2006/NURM dated 05.01.2007).

The interested parties are required to submit Technical Bid “Part A” in separate envelope consisting of work experience and other credentials in this field and Financial Bid “Part B” in separate envelope consisting of the tender documents issued by the office, in which the rate of charge be quoted. The tender shall be submitted on or before the time and date as mentioned below:-

SUB: TENDER FOR ENGAGEMENT OF CONSULTANT FOR THE PREPARATION OF REVISED CITY DEVELOPMENT PLAN OF VARANASICITY UNDER JNNURM SCHEME OF GOI.

Tender document for the above job is issued to you and following requirement are brought to your notice for information and compliance. Non compliance of these will render your tender liable for rejection.

CONDITIONS:

  1. No Conditional tender will be accepted. Conditional tenders will be rejected.
  2. The Income Tax Clearance Certificate should be valid up to date of receipt of tender, and should accompany the tender.
  3. Telegraphic offers and tenders received late will not be accepted.
  4. Invitation for application for the issue of tender to the applicants, the decision for issue of tender or otherwise of the Municipal Commissioner shall be final and the applicant will not be entitled for any compensation for rejection of his application.
  5. The applicant / firm should specify the constitution of the firm and a certified true copy of power of attorney executed in favor of the signatory to the tender document, should be attached. Power of attorney should be executed as below and shall specially state that signatory has authority to bind the person or the firm, as the case may be, in all matters pertaining to this contract including the arbitration clause.

A)In the case of an individual or proprietary concern, power of attorney shall be executed by him.

B)In the case of partnership concern, power of attorney shall be executed in accordance with the constitution of the concern / firm.

C)In the case of company, power of attorney shall be executed in accordance with the constitution of the company.

  1. The tender shall remain open for acceptance for the period of 90 days from the date of its submission.
  2. The contractor will have to start the work within 15 days of receipt of work order, failing which his contract shall stand terminated automatically without giving any further notice.
  3. The Municipal Commissioner reserves the right to accept or reject any or all the tenders received without assigning any reason thereto.
  4. The tenderer who do not fulfill the requirement of earnest money which is to be enclosed with tender in the form of Cash/FDR/ Demand Draft in favor the Addl. Municipal Commissioner, Varanasi Municipal Corporation, Varanasiand above mentioned requirements, his tender shall be treated as invalid.
  5. The period of contract is 2months from the issue of Work Order. The ttime line for completion of work can be further extended on request form contractor by the Municipal Commissioner according to need and circumstances.
  6. The tenderer shall sign all the documents attached herewith and shall submitto the Municipal Commissioner in a sealed envelope issued by office. If a tenderer is not interested to quoting his rates then he should return all the documents attached herewith duly written blank at the top ofenvelope and tender form. Blank tender must reach on or before the scheduled date and the time of opening of the tenders, failing which will not be able to participate in future tender action of the Varanasi Municipal Corporation.
  7. Tenders will be received by 1600 hours on Dated-05.12.2012 and shall be opened in case of those applicants who qualify under technical bid scrutiny at 1630 hours on Dated-05.12.2012. This letter shall part of the contract and should be returned along with the tender documents duly signed.
  8. The tenderer shall quote his rates both in words and figures.

SECTION - II

General Conditions of Contract

The successful tenderer shall be required to prepare the revised CDP after carrying out detailed survey, physical supervision and determination of data required for the purpose, at his own cost, to the entire satisfaction of Varanasi Municipal Corporation as well as, other competent authorities and directions/ requirements under JNNURM Scheme of GOI.

  1. Copies of the letter inviting tender, tender form and general conditions of contract, and other documents connected with the work are signed for the purpose of identification by the Municipal Commissioner. The tenderers shall be deemed to have satisfied themselves generally as to the scope of the work to be done, whether he has inspected them or not. Tenderers are required to inspect the site of Varanasi Municipal Corporation ( with regard to the scope of work before tendering.
  2. Qualification Criteria (Eligibility): The consultant must fulfill the following eligibility criteria:-
  • The consultancy firms/ companies having a minimum 10 years experience in the organized sector as Consultant and who have previous experience in the work of similar nature or who have previous experience in preparation of Detailed Project Report (DPR) of government projects are eligible to submit their offer.
  • The average annual Turnover of the bidder should be at least Rs. 2.00 crore during last 3 financial years.
  • The agency should have sufficient technical staff with M. Arch, B. Arch, B. Tech / BE (Civil / Environmental Engineer) Degree holders along with other supporting staff as per requirements.
  1. Rs. 50,000/- as earnest money in cash / pledged FDR or in the form of Demand Draft in favour of Addl. Municipal Commissioner, Varanasi shall be required to be enclosed by the tenderers, with the tender. In case of cash deposit, the Varanasi Municipal Corporation receipt issued by office should accompany the tender document, otherwise the tender shall be liable for rejection.
  2. Under no circumstances father and sons or brother worked or working in Municipal Corporation, Varanasishall be allowed to participate in the tender. Any firm having relationship as above among its partners shall also not participate in the tender against each other. All such tenders shall be rejected. The expenses, if any incurred by the Municipal Corporation on account of a litigation, shall also be payable by the contractors violating this conditions.
  3. The Municipal Corporation, Varanasi will be the accepting authority of the tender hereinafter referred to, as such, for the purpose of this contract. The accepting does not bind itself to accept the lowest or any tender, or to give any explanation for not doing so. It also reserves the right to accept counter offers or any option. The corporation also reserves the rights to accept the tender in part for any item or work.The tenderer should be very careful in quoting the rates, once a tender is accepted no representation with a view to amendments in rates will be considered.
  4. The submission of a tender by a tenderer implies that he has read this notice and conditions of contract agreement, and, has made himself aware of the scope of the work and has carefully studied local conditions and other factors involved for the proper execution of work.
  5. The Municipal Commissioner, Varanasi will return the earnest money wherever applicable to all unsuccessful tenderers on receipt of an application. The earnest money shall be refunded by way of a crossed and account payee cheque.
  6. The successful tenderer will have to deposit security money to the tune of 2% of the quoted rate in the form of F.D.R. or N.S.C. duly pledged in favor of the Municipal Commissioner or Demand Draft in favor of the Municipal Commissioner, Varanasi Municipal Corporation or in cash. The security money shall be deposited within fifteen days from the receipt of intimation along with necessary non judicial stamp papers of appropriate value for execution of contract agreement failing which the Addl. Municipal Commissioner shall have the right to forfeit the earnest money in whole or part, at his discretion, without any intimation of the tenderer, and the tenderer shall be deprived of the work.
  7. After depositing the security money and the non judicial stamp paper for execution of agreement if the contractor fails to execute or to sign the contract agreement within fifteen days from the receipt of the intimation. The Addl. Municipal Commissioner, Varanasi shall be at its liberty to forfeit the earnest money, security money as the case may be, and the tenderer shall be deprived of the subjected work, as well as future tender activities / works in Varanasi Municipal Corporation.
  8. The Addl. Municipal Commissioner, Varanasi will open the tenders i.e. Part ‘B’ (financial bids) in the presence of the successful tenderers or their duly authorized agents, present at the time, and date fixed for the purpose.
  9. The security deposit will be released to the successful tenderer after the lapse of six months from the date of completion of work.
  10. A penalty to the extent of 10% of the contract amount shall be imposed as fine by the Municipal Corporation in case of cancellation of the contract on default of the contractor or non completion of entire work of the contract by the contractor. The decision of Municipal Corporation shall be final, binding and conclusive on the contractor.
  11. Income Tax as per the prevailing rate fixed by Income Tax Department (GOI) for the financial year in which the subject work is being executed, on such type nature works, shall be recovered by the municipal corporation and paid to the Income Tax Department. This amount will be adjustable towards actual assessment of tax payable by the contractor and a certificate of deduction shall be given to him.
  12. No liability shall be incurred by the Municipal Corporation nor shall the acceptance of a tender be considered binding until the final contract documents has been signed by the authority competent and the contractor.
  13. Terms of the contract will be rigidly enforced and no excuse will be considered for incompletion of works especially if such excuse is based merely on fact that the work is not profitable to the contractor.
  14. The tender document shall on acceptance of tender be attached to and to be deemed to from part of the contract document. Corrections in tender should be initiated. Conditional, incomplete and unsigned tender shall be rejected. All pages of tender documents shall have to be signed by the tenderers. In case of variation of rates written in figure and in words the lower of the two shall be considered. No special rate, if quoted by any tenderer shall be accepted.
  15. In case of dispute arising out of this tender the matter shall be referred to the sole arbitration of the Municipal Commissioner, Varanasi, whose award shall be final and binding on both the parties.
  16. The contractor must write their correct and complete address in tenders and arrange to take delivery of all letter, If any letter is sent through registered post is received back undelivered, it will be the contractor own responsibility and contractor shall be bound for action as required through the contents of such letter.
  17. PERIOD FORREMAINING TENDER OPEN : The tender shall remain open for acceptance for a period of 60 days from the date specified for its submission.
  18. SECURITY OF CLASSIFIED DOCUMENTS: The contractor shall not communicate any classified information regarding the works either to sub contractor or others without prior approval of the Municipal Commissioner in writing. No subletting of contract shall be permitted without approval of the Addl. Municipal Commissioner. The contractor shall employ only Indian National after verifying their antecedents and locality. He shall ensure that no person of doubtful antecedents and nationality is in any way is associated with the work.
  19. In case of a tenderer submitting ‘Blank Tender he is required to indicate same on envelope duly signed by him. If the tenderer does not desire to submit the tender on any pretext, he must return the tender from and documents of the office with reasons for not submitting the tender, failing which he will be deprived of the next tender and a penalty of Rs. 5,000/- (Rupees Five Thousand) shall be imposed on him.
  20. The time period for completion of work is specified hereinafter. In case the contractor fails to complete particular work within specified time, as per work order, the Municipal Commissioner, Varanasi shall be empowered to impose a penalty to the tune of 1% of the cost of work order, per week, if in the opinion of the Addl. Municipal Commissioner, the delay in completing the work is caused due to laxity improper performance or negligence on the part of the contractor. In spite of the above penalty, in case the contractor further delays in completing till a time period of two months, after the targeted date of completion, as specified in the work order, the matter should be referred to the consideration of the Municipal Corporation for its decision to get the work executed through other agency / contractor, at the risk and cost of the contractor. However, if in the opinion of the Municipal Commissioner the delay in completing or commencing the work is caused due to any accident or natural calamity or any unavoidable circumstance, the Municipal Commissioner empowered to grant extension of time, as deemed fit, at the sole discretion of the Municipal Commissioner, whose decision in this regard shall be final & conclusive.
  21. Service Tax Deduction, Service Tax imposed by the Govt. of India as per rate or percentage fixed by the Govt. for the type of work mentioned in this tender document will be paid to the concerned department by the successful tenderer and a certificate of deduction of service tax will have to be submitted in the Varanasi Municipal Corporation office.
  22. Tender notice shall from part of the contract.
  23. Minimum Wages Act. The tenderer / contractor shall abide byall the provisions of Minimum Wages Act and other enactments applicable to labour laws during the execution of the work and period of contract. The tenderer / contractor shall be fully responsible for implementing the Minimum Wages Act and ensuring that nothing is adverse the provision of the said Act during the execution of contract. An under taking to the effect has to be given by the applicant tenderer to the Municipal Corporation.
  24. The tenderer shall act as a consultant to the Varanasi Municipal Corporation, and the project to be undertaken is as specified hereinafter the detailed scope of work and deliverables shall be as per the clause-5 of section-4 of (TOR) term of reference appearing hereinafter. The area of VaranasiCity is the territorial limits. The tenderer shall be required to prepare the Revised City Development Plan (CDP) of VaranasiCity. The Revised CDP shall be prepared as per the tool kits, guidelines and instructions provided by the MoUD and MoUEPA and the Department of Urban Development (DoUD) Government of Uttar Pradesh (GoUP) form time to time.

  1. DURATION OF THE ASSIGNMENT

The time for completion of the project will be Sixty Days (60) as mentioned in the Section – IVof TOR. The commencing date for the Assignment will be deemed to be date of execution of the agreement.Time schedule and payment terms shall be same as indicated in Section – IV of TOR.
