At their meeting on 18 January 2012 the Planning Committee of the Regulatory Committee on behalf of the County Council resolved, for the purposes of Regulation 3 of the Town and Country Planning General Regulations 1992 to grant planning permission for the development referred to above and a copy of the Decision Notice is attached.

Therefore, in accordance with Regulation 3 would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

In pursuance of their powers under the above mentioned Act, Order and Regulations, the Council as the local planning authority hereby GRANT PLANNING PERMISSION for variation of Condition 2 attached to consent RR/2866/CC to extend hours of operation of MUGA until 2200 hours Monday - Friday, 2000 hours on Saturday and 1900 on Sundays and Bank Holidays. Rye College, Love Lane, Rye, TN31 7NQ (Within land edged red on applicants plan no. 02 Rev C) in accordance with your application validated by the Director of Economy, Transport & Environment, East Sussex County Council on 22 November 2011 and the plans and particulars submitted in connection therewith and listed below and subject also to due compliance with the condition(s) specified here under:-

1. The MUGA shall be used between the hours of use hereby permitted for a limited period only until 31st July 2013, thereafter the hours of use will revert to those detailed in Condition 2 attached to RR/2866/CC..

Reason: To safeguard the amenities of the occupiers of properties in the vicinity of the site and to comply with Policy GD1 of the Rother District Local Plan 2006.

2. The development hereby permitted shall be carried out in accordance with the plans listed in the Schedule of Approved Plans.

Reason: For the avoidance of doubt and in the interests of proper planning.

3. The MUGA shall not be used other than between the hours of 0830 and 2200 on Mondays to Fridays, 1000 and 2000 on Saturdays and 1000 and 1900 on Sundays and Bank Holidays, except for works of essential maintenance, which are to be carried out in accordance with a schedule first submitted to and approved by the Director of Economy, Transport and Environment.

Reason: To ensure that the amenities of the occupiers of properties in the vicinity of the site are safeguarded and to comply with Policy GD1 of the Rother District Local Plan 2006

The Development Plan policies of relevance to this Decision are:-

South East Plan 2009: Policies S5 (Cultural and Sporting Activity), S6 (Community Infrastructure) and C3 (Areas of Outstanding Natural Beauty)

On the 27 May 2010 the Secretary of State for Communities and Local Government highlighted the Government’s commitment to the intention to rapidly abolish Regional Strategies and return decision making powers on housing and planning to local Councils. On the 6 July 2010 the Secretary of State revoked, with immediate effect, Regional Strategies. However, a High Court decision on the 10 November 2010 found that Regional Strategies could not be revoked in their entirety. The effect of this decision is to re-establish Regional Strategies as part of the development plan and due weight will therefore be given to The South East Plan policies. However, the Government has indicated that it will enact its commitment to abolish Regional Strategies as part of the Localism Act which received Royal Assent on 15 November 2011. An Order is now required to revoke the Regional Strategy. The Government’s intention to revoke Regional Strategies is therefore a material consideration in the decision making process.

Rother District Local Plan 2006: Policies GD1 (General Development Criteria) and DS1 (Development Principles)

Policy Statement on Planning for Schools Development: On the 15 August 2011 the Government issued, with immediate effect, a new policy statement on planning for school development. In this context, the policy statement states that the planning system, when dealing with planning applications for state-funded schools should operate positively and there should be a presumption in favour of the development of state-funded schools. The policy statement encourages a collaborative approach to applications, particularly encouraging pre-application discussions and the use of planning obligations to help mitigate adverse impact of developments. It further asserts that where it is necessary to impose conditions, they should be necessary in order to make the development acceptable and be clearly justified, thereby demonstrably meeting the tests as set out in Circular 11/95. The policy statement indicates that the Secretary of State will be minded to consider refusal of any application for state-funded schools to be unreasonable conduct, unless it is supported by clear and cogent evidence.

Reasons for approval

The proposal will allow for a more flexible use of the sports facility by the College and the wider community (children and adults). It is considered that a temporary planning permission to monitor the use of the facility for one year is appropriate such that impacts can be monitored. Therefore, the proposal complies with policies with Policies S5, S6 and C3 of the South East Plan; with Policies GD1 and DS1 of the Rother District Local Plan 2006.
