Puppy Sale Contract and Health Guarantee

  1. Initial____Balancemustbe paid in full (including shipping cost if applicable) before puppy leaves for its new home, via postal money order or PayPal invoice. If using PayPal, then a 3.5% fee is added to cover the fees imposed on Breeder. I do not accept personal or cashiers checks (unless I know you personally) or overages in money orders or PayPal. If a puppy is older than 9 weeks and seller is asked to keep the puppy past one week of actual sale then a charge of $10 per day boarding fee will be charged. Any additional vaccinations needed due to the delay will also be charged. If balance is not paid by the agreed time for the puppy to go to new home, then contract is null and voided, and puppy held will be released to new buyers.

  1. Initial_____Puppies are to be kept INSIDE YOUR HOME! By signing this contract, you agree to make this puppy a loving member of your family that lives in your house with you, is given lots of love, attention, socialization, training, vet care, and is brushed and groomed regularly. Puppies are not sold on a trial basis! Please be

commited for the life of this dog.

  1. Initial_____I am here for you for the life of your puppy and beyond. If there are ever any medical or behavioral concerns, please notify me right away. Please respond to occasional health and behavioral surveys I send out via email.
  1. Initial_____Please provide me with pictures and updates on your puppy. I have loved this puppy from the moment it was born! I chose you to be his new family and I genuinely want to know how you are all doing. Please call, text, email, or send me facebook messages, but please do share your success and struggles as you become a family. Ask questions and if I don’t know the answer, I will help you find it! And cute pics are just always greatly appreciated! Consider friending me on facebook and interacting with your littermates’ families.
  1. Initial_____Puppies are microchipped. Puppies will be microchipped and registered in my name initially. Upon receipt of puppy, I will add your name and contat information to the record to be notified. I do it this way so that I am notified immediately of anyof my puppies end up lost or in a shelter. I have found that owners will either not get around to registering them, will not include my name and not keep records updated. Please keep me updated if your address or phone number changes so I can update it.
  1. Initial____Ignore if this does not apply to Doodle puppies. Send in your AKC and UKC registrations!If you would like to include Moonstruck or Touchstone in the name, I would love it. But you don’t have to. Note that UKC does not provide as many spaces so do the UKC name first so you are sure it will fit. *** An exception is if the dogs is sold on a co-onership/show contract. Both parties would then agree on a name and “Touchstone” would be requires somewhere in the name. Guardianed pup names are chosen by the breeder with input from homes and will start with “Touchstone”.
  1. Initial____If for some reason, beyond your control you are unable to care for your dog any longer, by default you MUST return the dog to the Breeder. If time allows, I will either help you find a new home while the dog is still in your care, or after it is returned to me. Breeder MUST be contacted for permission in writing prior to selling of giving this puppy away to another party. Registration papers will be signed over and conveyed with the dog so that the new owner can register the dog under their name. Under NO circumstances should the pupp/dog be turned in to a shelter or rescue or sold on Craigslist! Return the dog to my care. I want to ensure this dog finds a loving home. Many illegal fighting rings acquirefreeir inexpensive dogs from Craigslist to use as bait dog for their fighting dogs to tear up. Please consider adding your plans for your pet to your will should something happen to you ( so that your beloved pet does not end up in a shelter or on Craigslist), and let your loved ones and your Breeder know of these plans (at least have a plan that you have communicated). Provide them with my contact information and let them know I will always take a puppy back throughout its lifetime or help them place him/her.
  1. Initial____LimitedBreedingRights:Buyer understands that this puppy will not be bred under any circumstances and registration papers (for purebred Poodles) will be marked “limited” which means you will not be able to register a litter. If you cannot guarantee this, do not get a puppy from me. ***If this puppy was sold with limited registration (no breeding rights) and it was determined the dog was bred anyway, then the health guarantee and contract is null and void and Breeder has right to reclaim dog and any puppies that resulted (or proceeds of the puppies). In addition, Breeder has the right to recoup damages to breeder’s breeding program and reputation in court, as well as court fees.
  1. Initial____NO EARLY SPAY/NEUTER while you are not allowed to breed (unless you are on a full rights agreement), you should also NOT spay/neuter early. The science has shown that dogs need their hormones to properly grown and to be healthy. There are lasting potential effects on the health of the dog if spay/neutered too early. Issues from being spayed or neutered too early can include unbalanced growth (gangly legs), hip dysplaysia, endocrine issues, bone cancer, tumors/sarcomas, decreased longevity, increased humping behavior, and incontinence (no control of bladder and peeing in the house).
  1. Initial____For males and females, no earlier than a year old, but prefer 15 months. This requires a lot of viginance and responsibility on your part! Contact me prior to your appointment to spay or neuter and send record of when it is done. If you don’t want to wait that long, there are new modified ovary sparing spay/gonad hormone spareing neuter procedures that preserve the hormone producing organs that can be done very early, however, you will need to look around for a et that does them. Most vets do not do them as they did not learn in vet school. If there is some medical reason the dog must be spayed prior to this recommendation, please contact me. There can be exceptions, based on veterinary recommendations, but NO PEDIATRIC SPAY/NEUTER!
  1. Initial____This puppy is warrantied to be in good health and free from disease when they leave my home. This puppy has been vaccinated and de-wormed properly for the puppy’s present age. Breeder will provide accurate health records for this puppy. If puppy is shipped, breeder will scan in and email records so owner has them for initial vet visit.
  1. Initial____Puppies must be vet checked within 3 days of receiving the puppy. Any major health issues must be communicated immediately. If the puppy is not examined within this time frame ANY health guarantee will be null and void. Breeder is NEVER responsible for any vet bills and please have your Vet appointment made before taking your puppy home.
  1. Initial____Should the veterinatian (within 3 days of purchaser receipt of puppy) find this puppy to have a serious life threatening illness or disease, (excluded parasites) breeder will replace with puppy of equal value, when available. Puppy must be returned and accompanied with document proof of qualifying illness from a licensed veterinarian, within 7 days of purchase. Breeder not responsible for transportation cost or vet bills. Documentation from the vet must be accompanied by contact information for the veterinary office. Breeder reserves the right to have the puppy examined by a licenses veterinarian of her choice to verify diagnosis.
  1. Initial____This puppy is guaranteed to the original buyer for (2) two years from date of birth against serious hereditary/genetic disease and hip dysplasia. Hip issues can be environmental as well as genetic and hips can be affected early as a puppy by diet, stairs, slippery floor surfaces, jumping on and off beds or couches, running or too much exercise when young.   1. Initial____This puppy contract does not cover any problems caused by overfeeding/underfeeding, over exercising, over vaccinating, failing to vaccinate, food or toxic poisoning, or not feeding a quality diet. Only feed a quality diet. Please contact me for recommendations and explanation on evaluating ingredients lists and feeding guidelines on bag. There is much misinformation on the internet about dog feeding guidelines and ratings of dog foods. Some of the studies are “bad science” and I would be happy to help you feel comfortable about what you decide to feed. I can also recommend, based on the food you are feeding, whether I would recommend a large breed or regular puppy formula, or whether/when to switch to an adult dog food.
  1. Initial____Puppy will go home withsome of what food they are raised on and what brand that is. If you decide to feed something other it is recommended feed this brand for at least a couple of weeks, and to change very gradually in order to avoid diarrhea from sudden change or stress.
  1. Initial____There are some foods and plants that are toxic to dogs and some that can lead to disease or death. Toxic foods include grapes, raisins, onions, some nuts, Xylotol (artificial sweetener found in some gum, some peanut butters, and other diet/sugar free and diet foods), alcohol, caffeine. This list is not exhaustive. Please research toxic foods and plants for yourself and keep your pet safe. You may find some plants in your part of the country that your dog may be exposed to that I am not aware of here.
  1. Initial____If a dog is found to have a serious herieditary illness/genetic disease or hip dysplasia, within two years from birth and contract was abided by, then a replacement puppy of equal value will be given whenavailable (same color or markings not guaranteed). Doccumentation from a licensed veterinarian must be given to breeder, and you must give permission fo veterinarian to talk to breeder and share the dogs records. If the worst happens, and the dog dies from a hereditary disease, then an autopsy must be performed by a laboratory and reports provided to the breeder. It is understood that breeder is never responsible for veterinarian bills, transportation costs, or return purchase price.
  1. Initial____If breeder does not have a litter due within a reasonable time frame from a valid invokement of the health guarantee (within 14 months) thenthe breeder has the right to replace with puppy of equal value from another reputable breeder (with communication and agreement by all) or refund the purchase price at Breeder’s discretion.

I (We) acknowledge that I (We) have read, understand and agree to the conditions of this sales and health agreement. I (We) understand by signing this agreement it becomes a binding contract, entered into and interpreted by the laws of the state of New York.
